    We use a unique data set on post-release behavior of former Italian inmates to estimate the effect of prison conditions on recidivism. By combining different sources of data we exploit variation in prison conditions measured by: 1) the extent of overcrowding at the prison level, 2) the number of deaths in the facility of detention during an inmate's stay and 3) the distance of the prison from the chief town of the province where the prison is located. By considering inmates who served their sentence in a jurisdiction different from the hometown in which they live after release, we can include province of residence fixed effects and account for the main source of unobserved heterogeneity correlated to prison conditions. We find that a harsher prison treatment does not reduce former inmates' criminal activity. The extent of overcrowding and the number of deaths do not decrease the probability to be re-arrested. Instead, we find evidence that the degree of isolation measured by distance from the prison of detention to the chief town of the province where the prison is located increases recidivism. -- Crime ; prison ; deterrence

    "One-third of children in the United States are born to unmarried parents. A substantial number of black and Hispanic children live with a never-married mother. Children of never-married mothers are more likely to drop out of high school, repeat grades, and have behavioral problems than are children raised in more traditional family structures. But these relationships may be driven by other factors that affect marital status at birth, post-conception marriage decisions, and later child outcomes, rather than causal effects of family structure. Given that changes in the availability of men in the marriage market should affect marriage decisions, we use incarceration rates for men as an instrumental variable for family structure in estimating the effect of never-married motherhood on the likelihood that children drop out of high school, focusing on blacks and Hispanics. Instrumental variables estimates suggest that unobserved factors rather than a causal effect drive the negative relationship between never-married motherhood and child outcomes for blacks and Hispanics, at least for the children of women whose marriage decisions are most affected by variation in incarceration rates for men. For Hispanics, in particular, we find evidence that these children may actually be better off living with a never-married mother"--National Bureau of Economic Research web site

    Based on a „theoretical„ framework on custodial and non-custodial sentencing, the paper provides econometric tests on the effectiveness of police, public prosecution and courts. Using a unique dataset covering German states for the period 1977-2001, a comprehensive system of criminal prosecution indicators is derived and subsequently related to the incidence of aggravated assault by young offenders using panel-econometrics. Empirical evidence suggests that the criminal policy of diversion failed as increasing shares of dismissals by prosecutors and judges enhance crime rates in Germany. Crime is significantly deterred by higher clearance and conviction rates, while the effects of indicators representing type (fine, probation, imprisonment) and severity (length of prison sentence, size of fine) of punishment are often small and insignificant.
