    A "patent box" is a term for the application of a lower corporate tax rate to the income derived from the ownership of patents. This tax subsidy instrument has been introduced in a number of countries since 2000. Using comprehensive data on patents filed at the European Patent Office, including information on ownership transfers pre- and post-grant, we investigate the impact of the introduction of a patent box on international patent transfers, on the choice of ownership location, and on invention in the relevant country. We find that the impact on transfers is small but present, especially when the tax instrument contains a development condition and for high value patents (those most likely to have generated income), but that invention itself is not affected. This calls into question whether the patent box is an effective instrument for encouraging innovation in a country, rather than simply facilitating the shifting of corporate income to low tax jurisdictions.

    This paper revises and updates the Campi-Nuvolari index of intellectual property protection for plant varieties (Campi and Nuvolari, 2015). The new index has been updated and provides yearly scores for the period 1961-2018 for a total number of 104 countries, which have legislation on plant variety protection in force. The new evidence highlights the tendency towards more similar and stronger systems of intellectual property rights (IPRs) worldwide, regardless of individual characteristics of countries. The signing of the TRIPS and of trade agreements with TRIPS-Plus provisions are major drivers of this process. In addition, certain features of countries such as the regulatory environment, the level of human capital, the importance of agricultural production, and openness to trade, are also significant determinants of the evolution of IPRs systems. We conclude discussing other possible applications of the data.

    This paper investigates the effect of patenting on follow-on knowledge in cancer research. Using a difference-in-difference approach on an original dataset of patent-paper-pairs we are able to estimate the causal effect of the granting of a patent on scientic development in the same domain. Furthermore, we disentangle between private companies and universities in order to assess whether patenting impacts differently on the two groups. In addition, we study to which extend the degree of applicability of an innovation is further affects the relation. To address these issues we build a novel dataset matching patent data (retrieved from USPTO) and publication data (retrieved from Thompson-Web of Science). Results show that patenting reduces the rate of citations of the paired publication indicating a decrease of related scientic activity only in case the citing agent belongs to a public institution. In addition, the the more invention is applied, the weaker is the negative effect. This paper makes a contribution to the debate on IPR and economics of science.

    Dieser Beitrag analysiert die Patentaktivität deutscher Unternehmen im Kfz-Bereich. Dies geschieht auf Basis der IW-Patentdatenbank, die alle offengelegten Patentanmeldungen beim Deutschen Patent- und Markenamt (DPMA) seit 2005 abdeckt. Die Kfz-Unternehmen nehmen in Deutschland eine Schlüsselposition bei der Innovationstätigkeit ein. Gut 47 Prozent der Patentanmeldungen von juristischen Personen (Unternehmen) beim DPMA beschäftigten sich 2016 mit Kraftfahrzeugen. Auch die technologischen Schwerpunkte der Forschung im Kfz-Bereich können identifiziert werden. Hier haben Patentanmeldungen mit Bezug zu Elektronik und Digitalisierung inzwischen das größte Gewicht. Ferner wurden Analysen zur räumlichen Verteilung der Anmeldungen und zur soziodemografischen Struktur der Erfinder im Jahr 2016 durchgeführt. Ergänzt werden diese Analysen um eine Zeitreihenbetrachtung ab 2005 für ausgewählte Aspekte. Diese zeigen beispielsweise, dass die Kfz-Unternehmen ihre Patentleistung seit 2005 um etwa 70 Prozent gesteigert haben, während die Gesamtzahl der Anmeldungen stagnierte. The present paper uses the IW Patent Database to analyse the patent activity of German companies in the automotive sector. The database covers all patent applications disclosed to the German Patent and Trade Mark Office (DPMA) since 2005. Car and truck manufacturers play a key role in German innovation activity. A good 47 per cent of patent applications filed by legal entities (companies) with the DPMA in 2016 concerned motor vehicles. It is also possible to identify the technologies focused on by research in the automotive sector, with the majority of patent applications relating to electronics and digitisation. Further analyses were carried out on the spatial distribution of applications and on the socio-demographic structure of inventors in 2016, supplemented by a time series analysis starting in 2005 for selected factors. These show, for example, that motor vehicle companies have increased their patent performance by about 70 percent since 2005, while the total number of applications has stagnated.

    Patenting in software, cloud computing, and artificial intelligence has grown rapidly in recent years. Such patents are acquired primarily by large US technology firms such as IBM, Microsoft, Google, and HP, as well as by Japanese multinationals such as Sony, Canon, and Fujitsu. Chinese patenting in the US is small but growing rapidly, and world-leading for drone technology. Patenting in machine learning has seen exponential growth since 2010, although patenting in neural networks saw a strong burst of activity in the 1990s that has only recently been surpassed. In all technological fields, the number of patents per inventor has declined near-monotonically, except for large increases in inventor productivity in software and semiconductors in the late 1990s. In most high-tech fields, Japan is the only country outside the US with significant US patenting activity; however, whereas Japan played an important role in the burst of neural network patenting in the 1990s, it has not been involved in the current acceleration. Comparing the periods 1970-89 and 2000-15, patenting in the current period has been primarily by entrant assignees, with the exception of neural networks

    We estimate differences in innovation behavior between foreign versus U.S.-born entrepreneurs in high-tech industries. Our data come from the Annual Survey of Entrepreneurs, a random sample of firms with detailed information on owner characteristics and innovation activities. We find uniformly higher rates of innovation in immigrant-owned firms for 15 of 16 different innovation measures; the only exception is for copyright/trademark. The immigrant advantage holds for older firms as well as for recent start-ups and for every level of the entrepreneur's education. The size of the estimated immigrant-native differences in product and process innovation activities rises with detailed controls for demographic and human capital characteristics but falls for R&D and patenting. Controlling for finance, motivations, and industry reduces all coefficients, but for most measures and specifications immigrants are estimated to have a sizable advantage in innovation.

    This paper examines intellectual property litigation as a method of protection from patent-infringing imports. Claims against patent-infringing imports entering the United States may be filed before the International Trade Commission (ITC) or in district court. The ITC applies injunctions (import prohibitions) that would seem to provide more protection from infringing imports than the standard license fee remedy in court. Settlements prior to legal adjudication are common in both venues. Using a model with Nash bargaining and Cournot competition, we show that an ITC filing may restrict imports by less than in court. This result tends to apply if product differentiation is high and the size of the patented cost-reducing innovation is large

    Why do firms outsource research and development (R&D) for some products while conducting R&D in-house for similar ones? An innovating firm risks cannibalizing its existing products. The more profitable these products, the more the firm wants to limit cannibalization. We apply this logic to the organization of R&D by introducing a novel theoretical model in which developing in-house provides the firm more control over the new product's location in product space. An empirical analysis of our testable predictions using pharmaceutical data concerning patents, patent expiration, and outsourcing at various stages of the R&D process supports our theoretical findings
