    International knowledge spillovers, especially through multinational companies (MNCs), have recently been a major topic of the academic and management discussion. However, most studies treat MNC subsidiaries as relatively passive actors without clear knowledge protection strategies. The goal of this study is to extend this stream of research by investigating both market-based (e.g. secrecy, lead time) as well as legal knowledge protection strategies (e.g. patents, trademarks) of MNC subsidiaries. We argue that these strategies are not independent from the opportunities and challenges of the host country. We suggest that the host country leadership status influences the choice of knowledge protection strategies along two major dimensions: geographical and industry strength of host country firms. We test our hypotheses for a broad sample of more than 1,500 firms in Germany. The results indicate that legal forms of knowledge protection are used more restrictively if the host country geographical environment is technologically leading while technological leadership of host country competitors within the industry leads to less restrictive market-based knowledge protection strategies. We develop management recommendations based on these trade-offs between reliable knowledge protection and the need for reciprocity in exchanging knowledge.

    We consider the problem of scheduling a project when there is an adversary from whom you want to conceal the project’s progress. Interfering with the progress by the adversary is called interdiction. Interdiction may involve hiring away key employees, campaigning for a change in zoning laws, etc. In this paper we take the perspective of a project manager with an adversary. The project manager seeks to limit the adversary’s opportunity to interdict, and, therefore, tries to keep the adversary “in the dark” as long as possible while completing the project on time. In the context of a leader-follower game, we formulate and analyze a new form of project management problem for secret projects where the project manager uses a combination of deception, task scheduling, and crashing to minimize the time between the adversary’s awareness and reaction and the project’s completion. We formulate a novel mixed-integer linear program and determine characteristics of optimal schedules. Using a detailed example of nuclear weapons development we illustrate the interconnectedness of deception, task scheduling, and crashing and the resulting influence on adversary behavior

    We experimentally test whether intentional and observable discriminatory pay of symmetric agents in the Winter (2004) game causes low paid agents to reduce effort. We control for intentionality of wages by either allowing a principal to determine wages or by implementing a random process. Our main observations are that discrimination has no negative effect on efforts and principals do not shy away from using discriminatory pay if it is observable. Rather, with experience discrimination enhances efficiency as it facilitates coordination among agents.     We analyze the strategic protection decision of an innovator between a patent and secrecy in a setting with horizontally differentiated products. By introducing the patenting decision into the well known circular city model, the impact of the disclosure requirement linked to a patent application as well as the problem of legally inventing around a patent can be taken into account. Asymmetry in the circular market leads to a consumer migration effect.     In this paper we empirically investigate the theoretical results obtained in Zaby (2009). From the theoretical model, which introduces the decision to patent into a setting with horizontally differentiated products we deduce several hypotheses and test these empirically. We find that the propensity to patent increases when market entry costs decrease. Furthermore, if the disclosure requirement linked to a patent has an impact, the propensity to patent decreases with the strength of the disclosure effect. -- patenting decision ; secrecy ; disclosure requirement ; market entry ; horizontal product differentiation

    This paper empirically investigates a firm’s propensity to patent. It thereby builds on a theoretical model on a firms' patenting decision in a market with vertically differentiated products. We deduce and empirically test several hypotheses from the theoretical results regarding patenting and rival's market entry decision presented in Zaby (2009). Our main finding is that in industries which are characterized by easy-to-use knowledge spillover, the technological lead of the inventor is reduced to such an extent that the propensity to patent increases.
