    Bolzano hielt in den Jahren 1805–1819, in denen er als Professor und Studentenpfarrer in Prag tätig war, fast 680 sonn- und feiertägliche Reden. Künne beschreibt die Form dieser ‚Exhorten‘ und Bolzanos Auswahl der biblischen Ausgangspunkte. Er vergleicht die Ziele, die der Redner verfolgte, mit den Zielen, die er nach den Vorstellungen der Wiener Obrigkeit verfolgen sollte, er stellt Bezüge zu Bolzanos philosophischen Schriften heraus und kommentiert dann diejenigen Reden, in denen Bolzano die Diskriminierung der tschechischen Böhmen durch ihre deutschen Landsleute und die der böhmischen Juden durch ihre ‚christlichen‘ Landsleute anprangert, die Begriffe diverser Formen von Lug und Trug und den Begriff des Mutes analysiert und (vergebens) ein absolutes Suizid-Verbot zu rechtfertigen versucht. In der anschließenden Auseinandersetzung mit der Edition aller erhaltenen Exhorten im Rahmen der Gesamtausgabe wird das Verständnis vieler Reden durch zahlreiche Wort- und Sacherklärungen gefördert.

    The Architecture of Concepts proposes a radically new way of understanding the history of ideas. Taking as its example human rights, it develops a distinctive kind of conceptual analysis that enables us to see with precision how the concept of human rights was formed in the eighteenth century.The first chapter outlines an innovative account of concepts as cultural entities. The second develops an original methodology for recovering the historical formation of the concept of human rights based on data extracted from digital archives. This enables us to track the construction of conceptual architectures over time.Having established the architecture of the concept of human rights, the book then examines two key moments in its historical formation: the First Continental Congress in 1775 and the publication of Tom Paine’s Rights of Man in 1792. Arguing that we have yet to fully understand or appreciate the consequences of the eighteenth-century invention of the concept "rights of man," the final chapter addresses our problematic contemporary attempts to leverage human rights as the most efficacious way of achieving universal equality

    The Genocide Convention was drafted by the United Nations in the late 1940s, as a response to the horrors of the Second World War. But was the Genocide Convention truly effective at achieving its humanitarian aims, or did it merely exacerbate the divisive rhetoric of Cold War geopolitics? A Rhetorical Crime shows how genocide morphed from a legal concept into a political discourse used in propaganda battles between the United States and the Soviet Union. Over the course of the Cold War era, nearly eighty countries were accused of genocide, and yet there were few real-time interventions to stop the atrocities committed by genocidal regimes like the Cambodian Khmer Rouge. Renowned genocide scholar Anton Weiss-Wendt employs a unique comparative approach, analyzing the statements of Soviet and American politicians, historians, and legal scholars in order to deduce why their moral posturing far exceeded their humanitarian action

    This paper reflects upon the task of women in the context of the development of human rights. Human rights are depicted as something that is recognized personally. Since women have felt injustice for centuries, they constantly sought to solve this ethical problem by referring to the biblical, anthropological, philosophical, historical, and legal context. Even in our times the inequality is still evident in the field of human rights; however, not so de iure as in practice. Equality and human rights are for all. Inequality is embarrassing. Contemporary phase in the development of human rights, which includes massive gender ideology, rights of LGBT people, and practices of juvenile justice, becomes dangerous not only for women and men, but for children and families as well. Wide-spread construction of gender theories comes shoulder to shoulder with an ambivalent effect, which includes dismemberment of society, loosing personal identity, disintegration of families, incomprehension of the institute of marriage and thus leads to the dominance of minorities. European society looses rationality, which is substituted by manipulation. L’objectif principal de l’article est d’analyser la contribution des femmes à la promotion des droits de l’homme. Les droits de l’homme étaient perçus depuis toujours comme quelque chose dont on fait la connaissance personnellement. Ayant éprouvé durant bien des siècles différentes formes d’injustices, les femmes ont pris le défi de définir convenablement leur place dans la société en se référant à l’argumentation biblique, anthropologico-philosophique et historicojuridique. Malheureusement, en ce qui concerne le respect des droits de l’homme, différentes formes d’inégalités sont aussi présentes dans les sociétés contemporaines. À l’étape actuelle du développement des droits essentiels apparaît une autre nouvelle idéologie qui devient dangereuse non seulement pour les hommes et les femmes, mais aussi pour la famille et les enfants. À ces éléments principaux appartiennent la théorie de genre, les droits des personnes LGBTI et le système de justices pour mineurs (juvenile justice system). Une nouvelle interprétation des droits de l’homme conduit entre autres aux divisions dans la société, à la perte de l’identité, aux troubles de l’institution du mariage et à la domination des minorités. Dans le différend d’aujourd’hui sur les soi-disant nouveaux droits de l’homme, différentes formes de manipulations remplacent de plus en plus souvent une argumentation rationnelle dans beaucoup de sociétés européennes. L’obiettivo principale di questo articolo è quello di analizzare la partecipazione della donna alla promozione dei diritti umani. Da sempre i diritti umani sono stati visti come qualcosa che conosciamo personalmente. Dopo aver subito diverse forme di ingiustizia per molti secoli, le donne hanno intrapreso la sfida di determinare propriamente il loro posto nella società, riferendosi ad argomentazioni di carattere biblico, antropologico-filosofico e storico-giuridico. Purtroppo, anche nelle società contemporanee, sono presenti diverse forme di disuguaglianza quando si tratta di diritti umani. In seno allo stadio attuale di sviluppo dei diritti fondamentali nasce un’altra nuova ideologia che diventa pericolosa non solo per donne e uomini, ma anche per famiglie e bambini.     Contemporarily, modern slavery represents one of the most serious human rights violations. Although most countries officially abolished slavery and ratified the 1926 Slavery Convention of the League of Nations, slavery and slave like practices still exist in various forms throughout the world. This paper addresses why coercive relationships persist today and investigates how political decision-making, institutional environment and coercive labor practices are interlinked. Moreover, we investigate the interplay between domestic anti-slavery laws and the extent of modern slavery. This paper identifies social and economic determinants of modern slavery using a novel dataset. The panel data contain information on 189 countries and territories from 2002 - 2016 for various types of exploitation of adults and children. We study determinants of modern slavery using cluster analysis and fit a fixed-effects model to explain which factors drive exploitation. We find that different types of exploitation are driven by different factors. In addition, we show that slave-sending and slave-receiving countries differ significantly. We study transnational human trafficking and identify which social and economic factors determine this specialization. Moreover, we fit a model using Poisson regression to study why some countries detect victims, originating form more countries, than others do.

    In Article 25 (1) of the Universal Declaration of Human Rights, the United Nations recognized in 1948 the basic human right to “security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond ... control.” This paper examines how economic insecurity is related to, yet different from, poverty and inequality, why it matters for human well-being and how it has been changing in different countries around the world in recent years. The paper concludes with discussion of how economic insecurity has been and will be affected by the Covid-19 pandemic/recession.

    This paper reflects upon the task of women in the context of the development of human rights. Human rights are depicted as something that is recognized personally. Since women have felt injustice for centuries, they constantly sought to solve this ethical problem by referring to the biblical, anthropological, philosophical, historical, and legal context. Even in our times the inequality is still evident in the field of human rights; however, not so de iure as in practice. Equality and human rights are for all. Inequality is embarrassing. Contemporary phase in the development of human rights, which includes massive gender ideology, rights of LGBT people, and practices of juvenile justice, becomes dangerous not only for women and men, but for children and families as well. Wide-spread construction of gender theories comes shoulder to shoulder with an ambivalent effect, which includes dismemberment of society, loosing personal identity, disintegration of families, incomprehension of the institute of marriage and thus leads to the dominance of minorities. European society looses rationality, which is substituted by manipulation. L’objectif principal de l’article est d’analyser la contribution des femmes à la promotion des droits de l’homme. Les droits de l’homme étaient perçus depuis toujours comme quelque chose dont on fait la connaissance personnellement. Ayant éprouvé durant bien des siècles différentes formes d’injustices, les femmes ont pris le défi de définir convenablement leur place dans la société en se référant à l’argumentation biblique, anthropologico-philosophique et historicojuridique. Malheureusement, en ce qui concerne le respect des droits de l’homme, différentes formes d’inégalités sont aussi présentes dans les sociétés contemporaines. À l’étape actuelle du développement des droits essentiels apparaît une autre nouvelle idéologie qui devient dangereuse non seulement pour les hommes et les femmes, mais aussi pour la famille et les enfants. À ces éléments principaux appartiennent la théorie de genre, les droits des personnes LGBTI et le système de justices pour mineurs (juvenile justice system). Une nouvelle interprétation des droits de l’homme conduit entre autres aux divisions dans la société, à la perte de l’identité, aux troubles de l’institution du mariage et à la domination des minorités. Dans le différend d’aujourd’hui sur les soi-disant nouveaux droits de l’homme, différentes formes de manipulations remplacent de plus en plus souvent une argumentation rationnelle dans beaucoup de sociétés européennes. L’obiettivo principale di questo articolo è quello di analizzare la partecipazione della donna alla promozione dei diritti umani. Da sempre i diritti umani sono stati visti come qualcosa che conosciamo personalmente. Dopo aver subito diverse forme di ingiustizia per molti secoli, le donne hanno intrapreso la sfida di determinare propriamente il loro posto nella società, riferendosi ad argomentazioni di carattere biblico, antropologico-filosofico e storico-giuridico. Purtroppo, anche nelle società contemporanee, sono presenti diverse forme di disuguaglianza quando si tratta di diritti umani. In seno allo stadio attuale di sviluppo dei diritti fondamentali nasce un’altra nuova ideologia che diventa pericolosa non solo per donne e uomini, ma anche per famiglie e bambini. Fra i suoi elementi principali ci sono la teoria gender, i diritti delle persone LGBTI e il sistema di giustizia minorile (juvenile justice system).     Wie wird Migration "illegal"? Illegalität lässt sich nicht beobachten. Die Arbeit dekonstruiert die Vorstellung von „illegaler Migration“ oder „illegalen“ Migrant*innen als faktische Gegebenheiten, indem sie die zugrundeliegenden Prozesse herausarbeitet und analysiert und somit die Konstruiertheit als solche sowie deren spezifische Prägung herausstellt. Die Analyse konzentriert sich auf die Ebene des Unionsrechts und reicht von Migrationskontrollinstrumenten und dem Phänomen der Externalisierungen über die Involvierung Dritter und das Aufenthaltsrecht im engeren Sinne bis hin zu Einreiseverboten. Sie wird durch eine umfassende Auseinandersetzung mit terminologischen und methodischen Fragen ergänzt. How does migration become "illegal"? Illegality cannot be observed. The work deconstructs the notion of "illegal migration" or "illegal" migrants as factual circumstances by elaborating and analysing the underlying processes, thus highlighting the constructedness as such and its specific character. The analysis concentrates on the level of EU law and ranges from migration control instruments and the phenomenon of externalisation to the involvement of third parties, the right of residence and entry bans. It is supplemented by a comprehensive examination of terminological and methodological issues.

    Bolzano hielt in den Jahren 1805–1819, in denen er als Professor und Studentenpfarrer in Prag tätig war, fast 680 sonn- und feiertägliche Reden. Künne beschreibt die Form dieser ‚Exhorten‘ und Bolzanos Auswahl der biblischen Ausgangspunkte. Er vergleicht die Ziele, die der Redner verfolgte, mit den Zielen, die er nach den Vorstellungen der Wiener Obrigkeit verfolgen sollte, er stellt Bezüge zu Bolzanos philosophischen Schriften heraus und kommentiert dann diejenigen Reden, in denen Bolzano die Diskriminierung der tschechischen Böhmen durch ihre deutschen Landsleute und die der böhmischen Juden durch ihre ‚christlichen‘ Landsleute anprangert, die Begriffe diverser Formen von Lug und Trug und den Begriff des Mutes analysiert und (vergebens) ein absolutes Suizid-Verbot zu rechtfertigen versucht. In der anschließenden Auseinandersetzung mit der Edition aller erhaltenen Exhorten im Rahmen der Gesamtausgabe wird das Verständnis vieler Reden durch zahlreiche Wort- und Sacherklärungen gefördert.

    We analyze the effect of state visits by the Catholic pope on human rights in the host country to understand how a small theocracy like the Vatican can exert disproportionate political influence in international politics. Our theoretical model of the strategic interaction between the Catholic Church and host governments shows how the pope’s use of conditional approval and criticism incentivizes governments to refrain from human rights violations. Drawing on a new dataset of papal state visits outside Italy and a novel identification strategy, we test for the first time whether governments react by improving human rights protection in anticipation of a papal visit. Our empirical analysis offers robust evidence in support of this causal effect.

    The debate on sustainability related corporate due diligence obligations in global value chains has recently gained considerable momentum, in particular at EU level. However, so far, it has been dominated by the focus on human rights due diligence. By contrast, relatively little attention has been paid to the specifics of a stand-alone environmental due diligence obligation. In this respect, the main challenge remains to define a substantive normative environmental standard ("material scope"), which the due diligence obligation aims to promote. This paper examines how environmental due diligence can be designed and integrated in EU legislation applicable to undertakings in the European Union. It provides an overview of conceivable concepts for designing environmental due diligence’s "material scope". Namely, these include a positive and a negative general clause and various ways of referencing substantive environmental norms (international environmental agreements, local law at the "place of effect", home state law, and soft law). Subsequently the paper examines how the issue has been solved in the Draft for a Directive on Corporate Due Diligence and Corporate Accountability adopted by the European Parliament on March 10th, 2021: The relevant provision can be categorized as a combination of referencing international (hard and soft) law instruments and EU environmental norms that shall be listed in an annex. This legislative approach represents a significant shift from what was proposed by the Rapporteur in the original draft report (a negative general clause). However, the paper suggests to combine both approaches rather than choosing one of them. Die Debatte über nachhaltigkeitsbezogene Sorgfaltspflichten von Unternehmen in globalen Wertschöpfungsketten hat in letzter Zeit erheblich an Dynamik gewonnen, insbesondere auf EU-Ebene. Allerdings wurde sie bislang von der Konzentration auf menschenrechtliche Sorgfaltspflichten dominiert. Den Besonderheiten einer eigenständigen umweltbezogenen Sorgfaltspflicht wurde dagegen vergleichsweise wenig Aufmerksamkeit geschenkt. In dieser Hinsicht besteht die größte Herausforderung weiterhin darin, einen materiellen normativen Umweltstandard ("materieller Gegenstand") zu definieren, auf den sich die Sorgfaltspflicht bezieht. In diesem Bericht wird untersucht, wie eine umweltbezogene Sorgfaltspflicht für Unternehmen in der Europäischen Union gestaltet und im EU-Recht verankert werden kann. Der Bericht skizziert überblicksartig denkbare Konzepte zur Ausgestaltung des "materiellen Gegenstandes" einer umweltbezogenen Sorgfaltspflicht. Dazu gehören im Einzelnen eine positive und eine negative Generalklausel sowie verschiedene Arten der Bezugnahme auf materielle Umweltnormen (internationale Umweltabkommen, lokales Recht am Erfolgsort, heimatstaatliches Recht und soft law). Anschließend wird untersucht, wie die Problematik in dem vom Europäischen Parlament am 10. März 2021 verabschiedeten Entwurf für eine Richtlinie über die Sorgfaltspflicht und Rechenschaftspflicht von Unternehmen gelöst wurde: Die entsprechende Vorschrift kann dabei als eine Kombination aus Verweisen auf internationale (Hard- und Soft-)Law-Instrumente sowie auf EU-Umweltnormen eingeordnet werden, die jeweils in einem Anhang zur Richtlinie aufgelistet werden sollen. Dieser Ansatz stellt eine wesentliche Änderung gegenüber dem von der Berichterstatterin im ursprünglichen Berichtsentwurf vorgeschlagenen Ansatz (einer negativen Generalklausel) dar. Dieser Bericht schlägt jedoch vor, anstatt sich für eine der beiden Grundkonzepte zu entscheiden, beide miteinander zu kombinieren.
