    Like other compilations of medieval urban drama, the plays that were performed in the streets of York on the Feast of Corpus Christi from the late fourteenth century until the third quarter of the sixteenth have most frequently been discussed in the context of the devotional cultures and practices of the later Middle Ages. The pageants' preoccupation with law, and with witnessing in particular, has received much less attention, Emma Lipton observes, yet the cycle of forty-seven plays, which together tell the story of human history from the Creation through the Last Judgment, contains an extended sequence that stages the trials of Christ leading up to the Crucifixion, and legal discourse features prominently elsewhere as well. While the play collections associated with other cities also engage with legal concepts, the York Plays devote an unusual amount of attention to the law, Lipton contends. It is no coincidence that the plays themselves are preserved alongside a wide range of legal records in the York Memorandum Books, repositories of civic documents that were kept in the city's guildhall.Engaging both theater and legal studies, Lipton is concerned in particular with the interfaces in the York Plays between dramatic practice and legal concepts of witnessing. In medieval English courts, witnesses were defined as neighbors; they spoke both to what they had seen and heard and also to common knowledge of events. At the same time, many legal theorists were concerned by how the temporal gap between initial experience and testimony might reshape the record of the past in light of the motives and emotions of individual witnesses and allied groups. With chapters focusing on space, speech, affect, and temporality, Cultures of Witnessing considers how civic performance and the legal theory and practice of witnessing promoted a shared sense of urban citizenship, and how this in turn provides a way to theorize late medieval religious drama, whose players performed on the streets and neighborhoods in which they conducted their daily lives

Sie geben subjektive Sichtweisen, wo man gern auf Objektivität vertrauen würde. Mit Hilfe des Zeugen aber können Tatsachen im Zusammenhang begriffen werden. Und erst dadurch wird es möglich, über vergangene Ereignisse zu verhandeln. Der Zeuge verkörpert den narrativen Kern des Rechts - und das Recht der Literatur, von Welt und Wahrheit zu erzählen. Das Buch rekonstruiert diesen Zusammenhang ausgehend von der Epoche der Aufklärung, die gleichermaßen ein neues, zeugenschaftliches Beweisrecht und neue literarische Formen schuf, die von der Figur des Zeugen getragen wurde

    Throughout the Middle Ages, witnessing was a crucial way religious and legal "truths" were understood and produced. Religious and secular officials alike harnessed the power of testimony to assert doctrinal, political, or legal responsibilities. Swearing an oath, testifying in court, and signing a deposition were common ways to shape and discipline both devotional and legal communities. In this book, the author traces depictions of witnessing in a wide range of late medieval texts and shows how witnessing practices formed and reformed, policed and challenged medieval communities. Through close study of texts like the Man of Law's Tale and Piers Plowman alongside sermon exempla, common law statutes, and pastoral treatises, this book argues that vernacular literature was a vital site of criticism and dissent.

    "Queer Postcolonial Narratives and the Ethics of Witnessing is a critically engaged exploration of power and its relation to ethics and bodies. By revisiting and revising Judith Butler's and Homi Bhabha's queer and postcolonial theories of literary performance, McCormack expands current understandings of the performative workings of power through an embodied, multisensory ethics.     "Queer Postcolonial Narratives and the Ethics of Witnessing is a critically engaged exploration of power and its relation to ethics and bodies. By revisiting and revising Judith Butler's and Homi Bhabha's queer and postcolonial theories of literary performance, McCormack expands current understandings of the performative workings of power through an embodied, multisensory ethics. That remembering is an embodied act which necessitates an undoing of one's sense of self captures how colonial and familial histories silenced by hegemonic structures may only emerge through opaque bodily sensations. These non-institutionalised forms of witnessing serve both to reconfigure theories of performativity, by re-situating the act of witnessing as integral to the workings of power, and to interrogate the current emphasis on speech in trauma studies, by analysing the multifarious, communal and public ways in which memories emerge. In Queer Postcolonial Narratives and the Ethics of Witnessing the body is reinstated as central to both the workings of and the challenges to colonial discourses"..

    This book looks at witnesses to suffering and death in ancient Greek epic (Homer’s Iliad) and tragedy. Internal spectators abound in both genres, and have received due scholarly attention. The present monograph covers new ground by dealing with a specific subset of characters: those who are put in the position of spectator to (and, often, commentator on) their own deed(s). By their very nature, protagonists are confined to the role of witness to the suffering (or deaths) they have caused only for brief stretches of time — often a single scene or even just the length of a speech — but every instance is of central importance, not just to our understanding of the characters in question, but also to the articulation of fundamental themes within the poetic works under examination. As they shift from the status of agent to that of witness, these protagonists, qua spectators to the consequences of their actions, give voice to, dramatize, and enact the tragic motifs of human helplessness and mortal fallibility that lie at the core of Homeric epic and Greek tragedy and that define the human condition, in a manner that leads the audience looking on to ponder their own.

    Like other compilations of medieval urban drama, the plays that were performed in the streets of York on the Feast of Corpus Christi from the late fourteenth century until the third quarter of the sixteenth have most frequently been discussed in the context of the devotional cultures and practices of the later Middle Ages. The pageants' preoccupation with law, and with witnessing in particular, has received much less attention, Emma Lipton observes, yet the cycle of forty-seven plays, which together tell the story of human history from the Creation through the Last Judgment, contains an extended sequence that stages the trials of Christ leading up to the Crucifixion, and legal discourse features prominently elsewhere as well. While the play collections associated with other cities also engage with legal concepts, the York Plays devote an unusual amount of attention to the law, Lipton contends. It is no coincidence that the plays themselves are preserved alongside a wide range of legal records in the York Memorandum Books, repositories of civic documents that were kept in the city's guildhall.Engaging both theater and legal studies, Lipton is concerned in particular with the interfaces in the York Plays between dramatic practice and legal concepts of witnessing. In medieval English courts, witnesses were defined as neighbors; they spoke both to what they had seen and heard and also to common knowledge of events. At the same time, many legal theorists were concerned by how the temporal gap between initial experience and testimony might reshape the record of the past in light of the motives and emotions of individual witnesses and allied groups. With chapters focusing on space, speech, affect, and temporality, Cultures of Witnessing considers how civic performance and the legal theory and practice of witnessing promoted a shared sense of urban citizenship, and how this in turn provides a way to theorize late medieval religious drama, whose players performed on the streets and neighborhoods in which they conducted their daily lives
