    In Zeiten der Globalisierung und der Entgrenzung und Infragestellung staatlicher Souveränität erhält die Frage nach der Legitimität des Staates besondere Brisanz. Wenn Macht durch das Konzept der Legitimität in gerechtfertigte Herrschaft überführt werden soll, bedarf die Legitimität als solche genauer Betrachtung. Dabei ist nicht nur zu fragen, worauf die Anerkennung einer Rechtsordnung beruht, sondern auch, wie ihre Anerkennungswürdigkeit begründet werden kann. Die Vielschichtigkeit des Legitimitätsbegriffs legt es dabei nahe, ihn aus unterschiedlichen Perspektiven zu betrachten und diese Perspektiven zu einem möglichst umfassenden Gesamtbild zusammenzufügen. Das Spektrum der an diesem Band beteiligten Disziplinen umfasst die Ethnologie, die Psychologie, die Rechtswissenschaft, die Staatstheorie, die Politikwissenschaft und die Philosophie. Er gliedert sich in folgende thematische Blöcke: Empirische Zugänge, Sozialwissenschaftliche Zugänge, Theoretische Zugänge und Entwicklungsfragen. If power is to be transformed into justified rule through the concept of legitimacy, legitimacy as such requires close examination. In this context, it is not only necessary to ask what the recognition of a legal system is based on, but also how its recognition can be justified. The complexity of the concept of legitimacy suggests that it should be considered from different perspectives and that these perspectives should be combined to form a comprehensive overall picture. The spectrum of disciplines involved in this volume includes ethnology, psychology, law, state theory, political science and philosophy. It is divided into the following thematic blocks: empirical approaches, social science approaches, theoretical approaches and development issues. Denn für Schleiermacher war nicht die Hermeneutik, sondern die philosophische Ethik die Basis aller Geisteswissenschaften, und diese waren ihm deshalb nicht interpretierende, sondern ethisch-geschichtliche Wissenschaften. Die Hermeneutik aber ist in seinem System ebenso wie Staatslehre, Ästhetik und Religionsphilosophie von jener Ethik abhängig; von einer Ethik, die eine praktische Philosophie im umfassendsten Sinne und eine Theorie der modernen Kultur ist.

    Traditionally, the Netherlands has enjoyed being a test market for many ideas in the media. But over the last decade, progress has been severely hampered by lengthy discussions on the future structure of just one sector of media, namely public broadcasting via radio and television. The narrow approach results in a lot of paper, speeches and theories, but little in the way of definitive policy making. In a report to the government, published in February 2005, the Scientific Council for Government Policy (WRR) argued for very different approaches to policy making. The recommendations are not only much broader than "broadcasting"; they tackle the challenges of making robust policy from new angles. Instead of trying to repair the old compass, the approach has been to find new instruments to help policymakers navigate the stormy and often confusing waters ahead. Perhaps the problem in the Netherlands is not accepting the new media, but rather accepting that the role "old" media has undergone a paradigm shift. Since the bulk of the WRR findings were published in the Dutch language, this summary is intended to provide readers outside the Netherlands with an insight into the issues at stake - and the solutions suggested by the WRR.     At the heart of this book are some trials conducted in Athens in the fourth century BCE. In each case, the charges involved a combination of supernatural activities, including potion-brewing and cult activity; the defendants were all women. Because of the brevity of the ancient sources, and their lack of agreement, the precise charges are unclear; the reasons for taking these women to court, even condemning some of them to die, remain mysterious. This book takes the complexity and confusion of the evidence not as a riddle to be solved, but as revealing multiple social dynamics. It explores the changing factors—material, ideological, and psychological—that may have provoked these events. It focuses in particular on the dual role of envy (phthonos) and gossip as processes by which communities identified people and activities that were dangerous, and examines how and why those local, even individual, dynamics may have come to shape official civic decisions during a time of perceived hardship. At first sight so puzzling, these trials come to provide a vivid glimpse of the sociopolitical environment of Athens during the early to mid-fourth century BCE, including responses to changes in women’s status and behaviour, and attitudes to particular supernatural/religious activities within the city. This study reveals some of the characters, events, and local social processes that shaped an emergent concept of magic: it suggests that the legal boundary of acceptable behaviour was shifting, not only within the legal arena, but also with the active involvement of society beyond the courts.

To manifest itself, touch makes a movement outwards, beyond the body, and relies on a specific physical involvement other senses do not require: to touch is already to be active and to activate. This fundamental ontology makes touch the most essential of all senses. This volume in the Law and the Senses series attempts to illuminate and reconsider the complex and interflowing relations and contradictions between the tactful intrusion of the law and the untactful movement of touch. Compelling contributors from arts, literature and social science disciplines alongside artist presentations explore touch’s boundaries and formal and informal ‘laws’ of the senses. The law and its normative gaze can be understood as that which decrees what is permitted to be and become visible and what is not. Indeed, even if law’s perspectival view is bound to be betrayed by the realities of perception, it is nonetheless productive of real effects on the world. This first title in the interdisciplinary series ‘Law and the Senses’ asks how we can develop new theoretical approaches to law and seeing that go beyond a simple critique of the legal pretension to truth. This volume aims to understand how law might see and unsee, and how in its turn is seen and unseen.     We may consider labour as boon or bane ‒ man’s existence is not conceivable without labour. The expulsion from the Garden of Eden can be understood as a punishment for the consumption of the forbidden fruit from the tree of knowledge, but it can likewise be interpreted as the perfection of God’s creation. Hence only beyond Eden, God’s creature becomes man. He or she becomes human by cultivat-ing the earth, by working. Labour is not only a necessary evil in order to secure existence, nor does it serve as a means for self-preservation, but also for self-fulfillment. Labour is the epitome of the ability of self-being and thus of man’s liberty. Mögen wir Arbeit als Fluch betrachten oder als Segen – das Sein des Menschen ist ohne Arbeit nicht denkbar. Man kann die Vertreibung aus dem Garten Eden als Strafe für den unerlaubten Genuss der Frucht vom Baume der Erkenntnis ver-stehen, man kann sie aber auch als Vollendung der göttlichen Schöpfung deuten. Denn erst jenseits von Eden wird das Geschöpf Gottes Mensch. Er wird Mensch, indem er die Erde bebaut, indem er arbeitet. Arbeit ist nicht nur ein notwendiges Übel zur Sicherung der Existenz, sie dient nicht nur der Selbsterhaltung, sondern auch der Selbstentfaltung. Arbeit ist der Inbegriff des Selbstseinkönnens und damit der Freiheit des Menschen.

    Taste usually occupies the bottom of the sensorial hierarchy, as the quintessentially hedonistic sense, too close to the animal, the elemental and the corporeal, and for this reason disciplined and moralised. At the same time, taste is indissolubly tied to knowledge. To taste is to discriminate, emit judgement, enter an unstable domain of synaesthetic normativity where the certainty of metaphysical categories begins to crumble. This second title in the ‘Law and the Senses’ series explores law using taste as a conceptual and ontological category able to unsettle legal certainties, and a promising tool whereby to investigate the materiality of law’s relation to the world. For what else is law’s reduction of the world into legal categories, if not law’s ingesting the world by tasting it, and emitting moral and legal judgements accordingly? Through various topics including coffee, wine, craft cider and Japanese knotweed, this volume explores the normativities that shape the way taste is felt and categorised, within and beyond subjective, phenomenological and human dimensions. The result is an original interdisciplinary volume – complete with seven speculative ‘recipes’ – dedicated to a rarely explored intersection, with contributions from artists, legal academics, philosophers, anthropologists and sociologists.

    It is a medieval truism that the poet meddles with words, the lawyer with the world. But are the poet’s words and the lawyer’s world really so far apart? To what extent does the art of making poems share in the craft of making laws, and vice versa? Framed by such questions, Piers Plowman and the Reinvention of Church Law in the Late Middle Ages examines the mutually productive interaction between literary and legal "makyngs" in England’s great Middle English poem by William Langland. Focusing on Piers Plowman’s preoccupation with wrongdoing in the B and C versions, Arvind Thomas examines the versions’ representations of trials, confessions, restitutions, penalties, and pardons. Thomas explores how the "literary" informs and transforms the "legal" until they finally cannot be separated. Thomas shows how the poem’s narrative voice, metaphor, syntax and style not only reflect but also act upon properties of canon law, such as penitential procedures and authoritative maxims. Langland’s mobilization of juridical concepts, Thomas insists, not only engenders a poetics informed by canonist thought but also expresses an alternative vision of canon law from that proposed by medieval jurists and today’s medievalists

    We present evidence on the way personal and institutional factors could together guide public company directors in decision-making concerning shareholders and stakeholders. In a sample comprising more than nine hundred directors originating from over fifty countries and serving in firms from twenty three countries, we confirm that directors around the world hold a principled, quasi-ideological stance towards shareholders and stakeholders, called shareholderism, on which they vary in line with their personal values. We theorize and find that in addition to personal values, directors' shareholderism level associates with cultural norms that are conducive to entrepreneurship. Among legal factors, only creditor protection exhibits a negative correlation with shareholderism, while general legal origin and proxies for shareholder and employee protection are unrelated to it.

    Abstract This article discusses the “heart” as part of the terminology for selfhood in ancient Jewish literature. After discussing a couple of criticisms of studies of the self and showing how these criticisms fail to persuade, the paper examines a range of texts in the Hebrew Bible, the Dead Sea Scrolls, and beyond for conceptions of the moral self. Special attention is given to the legal S tradition in the Scrolls as a fruitful illustration of how the self and law are recurring conceptual companions. In this legal tradition, a universalizing conception of selfhood and agency is rooted in local, practical concerns of a community.

    Based on technical assistance to central banks by the IMF's Monetary and Capital Markets Department and Information Technology Department, this paper examines fintech and the related area of cybersecurity from the perspective of central bank risk management. The paper draws on findings from the IMF Article IV Database, selected FSAP and country cases, and gives examples of central bank risks related to fintech and cybersecurity. The paper highlights that fintech- and cybersecurity-related risks for central banks should be addressed by operationalizing sound internal risk management by establishing and strengthening an integrated risk management approach throughout the organization, including a dedicated risk management unit, ongoing sensitizing and training of Board members and staff, clear reporting lines, assessing cyber resilience and security posture, and tying risk management into strategic planning.. Given the fast-evolving nature of such risks, central banks could make use of timely and regular inputs from external experts

Es gewährt daher einen Blick auf das Verhältnis dieser verschiedenen Formen sozialer Verbindlichkeit zueinander. Weil das Versprechen seine eigene Wirkung aber nie gewährleisten kann, sondern immer voraussetzen muss, wirft es in allen Anwendungsfeldern die Frage auf, wie Bindung gelingt. Dies untersuchen die hier versammelten Beiträge an der Schnittstelle von Recht und Literatur. To commit oneself by way of giving one´s word is a basic condition of social life. Promise is at work in morality, in law, but also in love. It therefore provides a view of the relationship between these different forms of social commitment. Because a promise can never guarantee its own effect, but must always suppose it, it raises the question of how binding through self-commitment can succeed in all its various fields of application. The contributions making up this volume examine this question at the interface of law and literature.

    Der Band versammelt Beiträge, die anlässlich des 7. Seoul-Freiburger Rechtswissenschaftlichen Symposiums im September 2019 in Seoul gehalten wurden. Die Zusammenarbeit und der akademische Austausch zwischen den juristischen Fakultäten der Seoul National University (SNU) und der Albert-Ludwigs-Universität Freiburg hat eine alte und wertvolle Tradition der engen Beziehungen zwischen dem koreanischen und dem deutschen Recht lebendig gehalten. Das 7. Symposium war dem Thema "Rechtstheorie und -auslegung in einer dynamischen Gesellschaft" gewidmet und deckte ein breites Spektrum an Themen ab, die in sechs Sektionen unterteilt waren: I. Rechtstheorie und -auslegung, II. Unternehmensrecht, III. Internationales Privatrecht und Zivilprozessrecht, IV. Recht der künstlichen Intelligenz, Eigentumsrecht und Strafrecht. V. Vertragsrecht, und VI. das Verhältnis von supranationalem und innerstaatlichem Verfassungsrecht. Die meisten der auf dem Symposium gehaltenen Vorträge sind in diesem Band versammelt. This volume is a collection of edited papers presented at the occasion of the 7th Seoul-Freiburg Law Faculties Symposium held in Seoul in September 2019. The cooperation and academic exchange between the Law Faculties of the Seoul National University (SNU) and the Albert-Ludwigs-Universität Freiburg keeping alive an old and precious tradition of close relationship between Korean and German law. The 7th Symposium was devoted to “Legal Theory and Interpretation in a Dynamic Society” and covered a broad range of subjects divided in six sections on I. Legal Theory and Interpretation, II. Enterprise Law, III. International Private Law and Civil Procedure Law, IV. Artificial Intelligence Law, Property Law, Criminal Law. V. Contract Law, and VI. the Relation of Supranational and Domestic Constitutional Law. Most of the papers presented at the Symposium are collected in this volume.

    Derzeit wird an zahlreichen Orten der Welt diskutiert, ob Rechte der Natur ein adäquates juristisches Werkzeug für den Umgang mit den Umweltkrisen unserer Zeit sein könnten. Die Arbeit befasst sich mit der weltweit ersten verfassungsrechtlichen Anerkennung solcher Rechte in der ecuadorianischen Verfassung von 2008 und wählt hierfür einen insbesondere auf Postkoloniale Theorien gestützten theoretischen Zugang. Sie deutet diese neuen Berechtigungen als hybrides Recht, das allgemeine Impulse zum Nachdenken über Rechtssubjektivität gibt und in Richtung eins partizipativen und inklusiven Modells der Rechte weist, das die Abhängigkeiten und das gegenseitige Aufeinanderverwiesensein der Rechtssubjekte in den Vordergrund rückt. Currently, there is a debate in numerous places around the world whether rights of nature could be an adequate legal tool for dealing with the environmental crises of our time. This paper deals with the world's first constitutional recognition of such rights in the Ecuadorian Constitution of 2008 and takes a theoretical approach based in particular on postcolonial theories. It interprets these new rights as a hybrid right that provides general impulses for thinking about legal subjectivity and points in the direction of a participatory and inclusive model of rights that foregrounds the interdependencies and interrelatedness of legal subjects.
