    Die Tsunami-Katastrophe und neue internationale Vorschläge zur Entwicklungshilfe haben dem Thema Gerechtigkeit und Entwicklung erneut einen hohen Stellenwert in den internationalen Beziehungen gegeben. Bringt jedoch eine Erhöhung der Entwicklungshilfe tatsächlich mehr Wohlstand für arme Länder? Was bedeutet »gerechte Entwicklung « und wozu ist die entwickelte Welt moralisch verpflichtet? Unter der Moderation von Theo Sommer, DIE ZEIT, diskutierte der Bergedorfer Gesprächskreis in Kairo die Frage einer gerechten Weltordnung aus der Perspektive von Politik, Wirtschaft und Wissenschaft. Es entstand eine lebhafte Kontroverse zwischen Teilnehmern aus Europa, Amerika und der arabischen und afrikanischen Welt, zwischen Repräsentanten verschiedener Religionen und zwischen Kritikern und Vertretern internationaler Institutionen wie EU, Weltbank und WTO. Eine angeregte und facettenreiche Diskussion löste die Frage aus, ob ein universaler Minimalkonsens über »Gerechtigkeit« erreicht werden könne oder ob man sich mit Überschneidungen unterschiedlicher Konzepte zufrieden geben müsse. Grundlage hierfür lieferten die Referate des ägyptischen Großmufti Ali Goma’a und des Frankfurter Philosophen Rainer Forst. Praktiker aus afrikanischen, nahöstlichen oder asiatischen Staaten konfrontierten die theoretische Debatte mit ihren Erfahrungen der täglichen Wirklichkeit von Entwicklungshilfe.

    This historical novel, Encounter (Mannam), by Hahn Moo-Sook, one of Asia's most honored writers, is a story of the resilience in the Korean spirit. It is told through the experiences of Tasan, a high-ranking official and foremost Neo-Confucian scholar at the beginning of the nineteenth century. Because of Tasan's fascination with Western learning, then synonymous with Catholicism, he is exiled to a remote province for 18 years. In banishment he meets people from various social and religious backgrounds—Buddhist monks, peasants, shamans—whom he would not otherwise have met. The events of Tasan's life are effectively used to depict the confluence of Buddhist, Neo-Confucian, Taoist, and shamanistic beliefs in traditional Korea.A subplot involves three young sisters, the daughters of a prominent Catholic aristocrat, and affords the reader vivid glimpses into Yi-dynasty women's lives, particularly those of palace ladies, scholars' wives, tavern keepers, shamans, and slaves. In contrast to the long-held Confucian stereotype of female subservience, this story illustrates the richness of women's contribution to Korean culture and tradition.Encounter's detailed narrative provides a broad and informed view of nineteenth-century Korea, making it a highly useful book for courses on Korean literature and society.     Die Arbeitsmarktpolitik auf europäischer Ebene hat durch die Krisen der letzten Jahre wiederholt neue Impulse erhalten. Mit den Initiativen für eine europäische Arbeitslosenrückversicherung, einen europäischen Mindestlohn, eine europäische Jugendgarantie und - vor kurzem - Europäische Sozialanleihen, ist die EU mittlerweile ein arbeitsmarktpolitischer Akteur, der die nationalen Aktivitäten ergänzt oder unterstützt. Die COVID-19-Krise könnte ein Gelegenheitsfenster sein, den Europäischen Sozialfonds um bestimmte Elemente einer Europäischen Arbeitslebensversicherung weiter zu entwickeln. Das Ziel sollte nicht nur darin bestehen, in europäischer Solidarität auf zyklische oder pandemische Krisen des Arbeitsmarkts zu reagieren, sondern auch die nationalen Kapazitäten zu stärken, um Einkommensrisiken im gesamten Erwerbsverlauf abzusichern. Die Innovation dieses Essay besteht darin, die Grundzüge einer Arbeitslebensversicherung auf die revolutionäre Trias "Freiheit, Gleichheit, Selbständigkeit" von Immanuel Kant zurückzuführen. Kants Konzept der "bürgerlichen Selbständigkeit" - anstelle der "Solidarität" - erweist sich als überaus fruchtbar, um ein institutionell fundiertes Grundrecht auf würdige Arbeit zu begründen. The labour market policy at the European level has been repeatedly given new impetus by the crises of recent years. With its initiatives for a European unemployment re-insurance scheme, a European minimum wage, a European Youth Guarantee, and - most recently - European Social Bonds, the EU has become an actor in the field of labour market policy that complements or supports national activities. The COVID-19 crisis could be a window of opportunity to further develop the European Social Fund through certain elements of work-life-insurance. The aim should not only be to respond in European solidarity to cyclical or pandemic labour market crises, but also to enhance the national capacities for social protection against income risks during the whole work-life course. The innovation of this essay is to argue for a work-lifeinsurance on the basis of Kant's triad "freedom, equality, self-reliance". Kant's concept of "civic self-reliance" - instead of "solidarity" - turns out to be quite fruitful to argue for a right to decent work based on sound legal institutions.

    One of the new forms of prose fiction that emerged in the eighteenth century was the first-person narrative told by things such as coins, coaches, clothes, animals, or insects. This is an ambitious new account of the context in which these "it narratives" became so popular. What does it mean when property declares independence of its owners and begins to move and speak? Jonathan Lamb addresses this and many other questions as he advances a new interpretation of these odd tales, from Defoe, Pope, Swift, Gay, and Sterne, to advertisements, still life paintings, and South Seas journals. Lamb emphasizes the subversive and even nonsensical quality of what things say; their interests are so radically different from ours that we either destroy or worship them. Existing outside systems of exchange and the priorities of civil society, things in fact advertise the dissident obscurity common to slave narratives all the way from Aesop and Phaedrus to Frederick Douglass and Primo Levi, a way of meaning only what is said, never saying what is meant. This is what Defoe's Roxana calls "the Sense of Things," and it is found in sounds, substances, and images rather than conventional signs. This major work illuminates not only "it narratives," but also eighteenth-century literature, the rise of the novel, and the genealogy of the slave narrative. --

    Worldwide, politics are challenged to achieve economic stability, socialjustice, and ecological sustainability. These goals are often played offagainst each other,and some suspect that market economies (aka capitalism) are basically unable to solvethese dilemmas. This article explores the normative foundations of market economy asa robust, self-regulating system enabling just exchange in large (anonymous) groups.The primary principle of justice for market exchange is reciprocity, i.e., the balanceof costs and benefits from any kind of social exchange. The corresponding socialnorm is calledMeritocratic Principle. It can be implemented and its contestednessavoided by concentrating on "non-merit", i.e., institutionally draining the wellspringsof systematically undeserved incomes (economic rents). Economic rents as violationsof reciprocity can be viewed as a key problem of justice in any economic system. Thispolitical compass can guide consistent policy measures and is applied to two economichot spots: land rents and resource consumption. The measures discussed follow theGerman neo-liberal ideal of an "economic order" by setting only few general caps.This improves stability, justice and sustainability of market economies and makes theliberal vision of self-regulating markets more realistic.

    Die Debatte um das Verhältnis von Geschlecht und Gerechtigkeit in technischen Organisationen zeigt Geschlechtergerechtigkeit als ein widersprüchliches Phänomen. Es stellt sich die Frage, wie mit Geschlechtergerechtigkeit in der organisationalen Praxis umgegangen wird. In diesem Buch werden über eine prozesshafte Verknüpfung von Theorie, Empirie und Reflexion historisch und sozial hervorgebrachte Gestaltungskontexte untersucht und in einen Gesamtkontext gestellt. Grundwidersprüche werden nachvollziehbar in Vergleich gesetzt. Verdeutlicht wird die Notwendigkeit einer der Komplexität von Geschlechtergerechtigkeit angemessenen Auseinandersetzung, deren Gelingen eine organisierte Teilhabe und Befähigung aller Beteiligten offenkundig voraussetzt. The debate about the relationship between gender and justice in technology organisations shows gender equality as a contradictory phenomenon, which raises the question of how gender equality is dealt with in organisational practice. In this book, historically and socially produced design contexts are examined through a process-driven combination of theory, empiricism and reflection and put in an overall context. Moreover, basic contradictions are compared in a comprehensible way. The book illustrates the need to spur a debate that is appropriate to the complexity of gender equality, the success of which obviously presupposes the organised participation and empowerment of all those involved.

    Wie stehen Methodenlehre und juristische Argumentation zueinander? Was ist juristische Argumentation, was „bloße“ Rhetorik? Das Lehrbuch zur juristischen Argumentationstheorie stellt die Modelle juristischen Argumentierens vor und unterzieht sie einer (kritischen) Würdigung. Das betrifft etwa die Argumentationsanalyse seitens der „Strukturierenden Rechtslehre“ und das sogenannte „pragma-dialektische“ Modell der Argumentation. Explizit warnt der Band vor einem postmodernen Irrationalismus, der die Regelorientierung juristischen Argumentierens grundsätzlich in Zweifel zieht. Das Lehrbuch zeigt auf, wie die „Produktion“ von rechtlichen Entscheidungen und subgesetzlichen Regeln rational kontrollierbar und kritisierbar wird; es leistet damit einen Beitrag zu einer im besten Sinne kritischen Rechtswissenschaft.

    This paper investigates whether and how litigant peer stock ownership by federal district judges affects characteristics of case outcomes for large corporate litigants. We find that industry-peer stock ownership by district judges is associated with the following outcomes for corporate litigants named in their assigned cases: 1) an increased likelihood of judgments for the corporate litigants, 2) a decrease in the amount received by the parties suing these corporate litigants, and 3) a decrease in the length of the litigation proceedings. The random assignment of district judges to cases provides exogenous variation in the judge stock ownership. We further identify the association outlined in our base results by examining appellate court reversals of district judgments, a triple difference analysis isolating large-stake investments, and outcomes in case types that should impact industries either cooperatively or competitively. Our results survive a falsification test as well as a battery of robustness tests. Our findings underscore the importance of mandates governing judge stock ownership, and more broadly, judge conflicts of interest

    Studies on salvation in the Luke 19:1-10 Zacchaean story generally tend to exhibit an underdeveloped analysis of its rhetoric as part of the controversy genre. This paucity reduces salvation to an individual event and ignores the social effect of Lukan salvation in the story. To remedy this, it is here argued that the weight of the controversy genre is felt specifically in the rhetorical use of enthymeme in verse 9, and that Jesus’s enthymemic pronouncement of salvation reveals a social aspect to Zacchaeus’s salvation. The enthymeme supports Zacchaeus’s refutation of the crowd’s position; it insinuates and infers from contrariety and obligates the crowd to distribute honour to Zacchaeus. This function of enthymeme is based on the evidence of first-century rhetors, whose position differs from modern scholarship’s view of the enthymeme as a truncated logical syllogism. Salvation has a social effect. Jesus’s enthymemic pronouncement crowns Zacchaeus’s refutation by calling the crowd to reinterpret Zacchaeus’s social-religious status on the basis of legal precedent.
