    Penology in the Jim Crow South centered on the chain gang. Gangs ostensibly served three purposes: their severity served as a deterrent; their putting convicts to work on roads and other public improvements reduced the taxpayers' costs of infrastructure; and their discriminatory implementation reinforced the social order defined by Jim Crow. Drawing on insights from the economics of crime literature, this paper analyzes whether chain gangs reduced road maintenance costs. Using a fixed-effects design, the analysis finds that the costs of using gangs in road maintenance were marginally lower on average than using wage labor. The results are consistent with county officials choosing between convict and free labor in manner consistent with minimizing taxpayers' costs

    We analyze the extent and consequences of unequal representation on juries in Harris County, Texas. We first document that residents from predominantly white and high-income neighborhoods are substantially over-represented on juries. Using quasi-random variation in those called for jury duty each day, we next establish that Black defendants are more likely to be convicted and receive longer sentences from juries with more residents from these over-represented neighborhoods. We estimate that equal representation would reduce Black defendants' median sentence length by 50 percent and the probability of receiving a life sentence by 67 percent. Straightforward remedies could mitigate this severe bias

    We examine 70,581 felony court cases filed in Chicago, IL during the period 1990-2007. We exploit case randomization to assess the impact of judge assignment and sentencing decisions on the arrival rates of new charges. Relative to prior research, we document an important source of heterogeneity in the impact of incarceration on recidivism. Incarceration creates lasting reductions in recidivism among first offenders but not repeat offenders. We present suggestive evidence that these reductions among first offenders primarily reflect outcomes for offenders who live in lower-crime areas of the city and are not involved in the drug trade. During our sample period, Illinois parole officers were able to issue arrest warrants for former inmates under their supervision. These powers place former inmates at significant risk of returning to prison as punishment for violations of technical conditions of their supervision. However, we find no evidence that these police powers increased the arrival rate of new charges against formerly incarcerated offenders. Incarceration does not reduce the arrival of new criminal charges among repeat offenders, and this outcome is not the result of parole officers over-policing repeat offenders.

    This paper estimates teachers' impacts on their students' future criminal justice contact (CJC). Using a unique data set linking the universe of North Carolina public school data to administrative arrest records, we find a standard deviation of teacher effects on students' future arrests of 2.7 percentage points (11% of the sample mean). Teachers' effects on CJC are orthogonal to their effects on academic achievement, implying assignment to a high test score value-added teacher does not reduce future CJC. However, teachers who reduce suspensions and improve attendance substantially reduce future arrests. Similar patterns emerge when allowing teacher impacts to vary by student sex, race, socio-economic status, and school. The results suggest that the development of non-cognitive skills is central to the returns to education for crime and highlight an important dimension of teachers' social value missed by test score-based quality metrics

    We examine the short- and medium-term effects of announcements of changes in anti-crime policies in the distant future (news shocks) and provide a first extension of the analysis to cases where the announced policy changes may not be realized in the end (noise shocks). We further innovate by analyzing the effects of policy changes that increase the variance while holding the expected values of policy instruments constant. We confirm that news shocks can bring about immediate changes in delinquency. However, announcements of tighter anti-crime policies may even increase delinquent activities, at least temporarily. In the case of noise shocks, we observe persistent reactions of potential offenders, indicating that a credible communication strategy may generate an impact on crime politics. Finally, increasing the variance of policy instruments without changing the mean expected detection rate may have similar effects.

    State and local policies increasingly restrict employers' access to criminal records, but without addressing the underlying reasons that employers may conduct criminal background checks. Employers may thus still want to ask about a job applicant's criminal record later in the hiring process or make inaccurate judgments based on an applicant's demographic characteristics. In this paper, we use a field experiment conducted in partnership with a nationwide staffing platform to test policies that more directly address the reasons that employers may conduct criminal background checks. The experiment asked hiring managers at nearly a thousand U.S. businesses to make incentive-compatible decisions under different randomized conditions. We find that 39% of businesses in our sample are willing to work with individuals with a criminal record at baseline, which rises to over 50% when businesses are offered crime and safety insurance, a single performance review, or a limited background check covering just the past year. Wage subsidies can achieve similar increases but at substantially higher cost. Based on our findings, the staffing platform relaxed the criminal background check requirement and offered crime and safety insurance to interested businesses

    Domestic abuse is a pervasive global problem. Here we analyze two approaches to reducing violent DA recidivism. One involves charging the perpetrator with a crime; the other provides protective services to the victim on the basis of a formal risk assessment carried out by the police. We use detailed administrative data to estimate the average effect of treatment on the treated using inverse propensity-score weighting (IPW). We then make use of causal forests to study heterogeneity in the estimated treatment effects. We find that pressing charges substantially reduces the likelihood of violent recidivism. The analysis also reveals substantial heterogeneity in the effect of pressing charges. In contrast, the risk-assessment process has no discernible effect

    Most of the 600,000 adults returning to the community from state and federal prisons annually in the U.S. carry substantial debt, have low income and low education, and limited formal employment prior to entering prison. Upon reentry, they face financial hardship, high rates of morbidity and mortality, and high incidence of re-offense. Medicaid coverage, as a means-tested transfer program providing subsidized health insurance, may influence reincarceration through both financial and health channels. In this paper, we provide a comprehensive look at the effects of public health insurance coverage on post-release behavior of formerly incarcerated adults. We study a natural experiment in which two separate state policy changes resulted in a 60 percentage point increase in Medicaid enrollment at release. Using a series of linked individual level administrative datasets, we estimate the effects of this change in Medicaid enrollment, finding declines in reincarceration, increased employment, and higher health care use. Leveraging data on financial concerns and need for mental health and substance use treatment to examine mechanisms, we find support for a financial channel and mixed support for health channels. Policies that enhance access to healthcare and provide financial security for this population may have significant benefits for individuals and society

    Low-income individuals arrested on criminal charges face disproportionately high rates of pretrial detention and conviction. We study a novel approach to addressing this inequity: providing low-income individuals with access to legal counsel immediately following their arrest. Focusing on a pilot program in a large urban county, we estimate the causal impact of early representation by a public defender on release and case outcomes, leveraging quasi-random variation in access to counsel pre-arraignment. Low-income individuals who met with a public defender shortly after arrest were 28 percentage points more likely to be released pretrial, and 36 percent more likely to see their cases dismissed, relative to otherwise similar individuals who would first meet with a public defender at their arraignment. These results suggest that providing timely access to legal representation could improve release and case outcomes for public defender clients
