    Corporate social responsibility (CSR) has become an integral part of many companies' business strategy. A detailed analysis of 579 RTAs, including 305 agreements currently in force and notified to the WTO (as of December 2020), reveals that a limited but increasing number of RTAs, namely 65 agreements, refer explicitly to CSR. These CSR-related provisions are particularly heterogeneous in terms of location in the RTA, language, scope and commitments. An increasing number of RTAs incorporate an article dedicated to CSR in different chapters, including on investment, labour or environment. Most CSR-related provisions are formulated in best endeavour language. These provisions promote the voluntary adoption and respect of CSR, including internationally recognized CSR principles standards and guidelines. Building on provisions included in some bilateral investment treaties (BITs), only a couple of recent RTAs have expanded the scope of CSR-related provisions by requiring investors to make their best efforts to comply with some of the principles established under the Organisation for Economic Co-operation and Development (OECD) Guidelines for Multinational Enterprises.

    The WTO has not been able to recover since the collapse of the Doha Round in July 2008. Several ministerial conferences including the Buenos Aires meeting in December 2017 failed to reach agreement. The US Trump Administration launched a campaign to reform the WTO in 2018 and 2019. This book argues that the Trump Administration reform proposals have been much more aggressive and far-reaching than the Obama Administration before it, threatening to erode hard-won special and differential treatment rights of developing countries. By blocking the appointment of new Appellate Body members, the US has effectively paralysed the Appellate Body and deepened the crisis of the multilateral trading system. Developing countries have responded to the proposals and called for the WTO to be development-oriented and inclusive. This book provides a critical analysis of the US-led reform proposals and seeks to build a discourse around an alternative set of concepts or principles to guide the multilateral trading system based on fairness, solidarity, social justice, inclusiveness and sustainability.

    Regional Trade agreements (RTAs) are sometimes considered as laboratories in which new types of provisions are negotiated to address recent trade-related issues. Although the inclusion of gender-related provisions in RTAs is not a recent phenomenon, only a limited but increasing number of RTAs refer explicitly to gender-related issues. These gender-related provisions are highly heterogeneous and differ in terms of location in the RTA, language, scope and commitments. Some of the most detailed gender-related provisions are found in stand-alone chapters on gender. Cooperation provisions on gender-related issues, including labour, health and social policy, remain the most common type of gender-related provisions found in RTAs. The remaining types of genderrelated provisions, included in a relatively limited number of RTAs, cover different issues, including upholding domestic gender-policies, implementing international gender-related agreements and instruments, and establishing institutional arrangements to oversee the implementation of the gender-related provisions and resolve issues through consultations. The first Global Trade and Gender Arrangement (GTGA), negotiated by Canada, Chile and New Zealand in 2020, builds on many of the gender-related provisions found in RTAs but sets out also new types of gender-related provisions, such as the principle not to weak or reduce the protection provided in gender equality laws and regulations to promote trade or investment.

    This paper compares different just transition pathways in China, the European Union and the United States of America by comparing the current state of the coal sector and just transition policies away from coal. How can social justice in the energy transition be achieved under different models of energy governance? Since these three blocs have only made some progress on just transition policies and legislations for workers and communities impacted by the coal phase down or phase out in recent years, there have not been many studies comparing them to each other. The analysis in this paper shows that while all three blocs work towards ensuring the integration of coal workers and coal communities into the clean economy in the process of coal reduction, their approaches to achieving a just transition differ in terms of policy frameworks, financing resources, specific measures and public participation. This paper is part of a series of FEEM working papers of comparison studies of China, the EU and the US in the field of climate and energy.
