    The translation of the Louisiana Civil Code into German gives research, doctrine and practice in German-speaking jurisdictions for the first time immediate access to one of the most illustrious, albeit in Europe relatively unknown, private law codifications.Louisiana belongs to the family of mixed jurisdictions. This is due to its history as the territory of what is today Louisiana was under French and Spanish colonial rule before being acquired by the United States.The Louisiana Civil Code boasts 3,556 provisions, which are housed in an introductory title and four books (governing persons, things, acquisition of ownership, and conflicts).The author teaches Louisiana Property Law, Public International Law and Introduction to U.S. Law at Loyola University New Orleans College of Law. He is a member of the Academy of European Private Law. Mit der Übersetzung des Zivilgesetzbuchs von Louisiana aus dem Englischen ins Deutsche wird Forschung, Lehre und Praxis im deutschen Sprachraum erstmals der unmittelbare Zugriff auf eine der bedeutendsten und dennoch in Europa weitgehend unbekannt gebliebenen Privatrechtskodifikationen ermöglicht. Louisiana wird der Rechtsfamilie der Mischsysteme zugerechnet. Dies hat zunächst geschichtliche Gründe, da das Gebiet des heutigen Bundesstaates vor dem Erwerb durch die Vereinigten Staaten unter französischer und spanischer Kolonialherrschaft stand. Das Gesetzeswerk umfasst 3.556 Vorschriften, die in einem Einleitungstitel und vier Büchern (Personen, Sachen, Eigentumserwerb und Kollisionsnormen) untergebracht sind. Der Autor lehrt Sachenrecht von Louisiana, Völkerrecht und Einführung in das U.S.-amerikanische Recht an der Loyola Universität in New Orleans (The Honorable Herbert W. Christenberry Professor of Law). Er ist Mitglied der Akademie für europäisches Privatrecht.

    In a Case Law regime Courts have more flexibility than in a Statute Law regime. Since Statutes are inevitably incomplete, this confers an advantage to the Statute Law regime over the Case Law one. However, all Courts rule ex-post, after most economic decisions are already taken. Therefore, the advantage of flexibility for Case Law is unavoidably paired with the potential for time-inconsistency. Under Case Law, Courts may be tempted to behave myopically and neglect ex-ante welfare because, ex-post, this may afford extra gains from trade for the parties currently in Court. The temptation to behave myopically is traded off against the effect of a Court's ruling, as a precedent, on the rulings of future Courts. When Case Law matures this temptation prevails and Case Law Courts succumb to the time-inconsistency problem. Statute Law, on the other hand pairs the lack of flexibility with the ability to commit in advance to a given (forward looking) rule. This solves the time-inconsistency problem afflicting the Case Law Courts. We conclude that when the nature of the legal environment is sufficiently heterogeneous and/or changes sufficiently often, the Case Law regime is superior: flexibility is the prevailing concern. By the same token, when the legal environment is sufficiently homogeneous and/or does not change very often, the Statute Law regime dominates: the ability to overcome the time-inconsistency problem is the dominant consideration. -- Statute law ; case law ; flexibility ; rigidity ; time-inconsistency ; precedents

    Most apparent differences between US and continental law lose their relevance once one looks beneath the doctrinal surface and checks how doctrine plays itself out in concrete cases. One of the few exceptions is standards of proof. Not only distinguishes US law between "preponderance of the evidence" and "beyond a reasonable doubt". It even constructs proof differently. In the US, proof is an objective, science-like affair. On the continent, proof is holistic and subjective. The decision maker is called upon to form a personal conviction, and to take on personal responsibility for her assessment of the facts. What seems utterly mystic actually has a sound scientific base. Continental law capitalises on the power of intuition. Intuition relies on unconscious mental machinery. This apparatus processes huge amounts of information in almost no time. It is programmed to come up with an assessment even if the evidence is patently incomplete. It does so by multiple feedback loops. At the end of this procedure, evidence conflicting with the final decision is devalued, whereas evidence supporting the decision is given greater weight. While instrumental in making most of the available evidence, the mental mechanism is not error proof. One particularly troublesome implication precisely concerns standards of proof. Given the mechanism is designed to force a decision, one might be afraid that it mutes the difference between standards of proof. A more stringent standard would be neutralised by an even stronger devaluation of conflicting evidence. Happily an experiment shows that the concern is misplaced. A plausible explanation is this: the standard of proof instruction tags convicting an innocent defendant by a somatic marker. If this hypothesis could be proven true, the presumption of innocence would have been rescued by an emotion.

    The translation of the Louisiana Civil Code into German gives research, doctrine and practice in German-speaking jurisdictions for the first time immediate access to one of the most illustrious, albeit in Europe relatively unknown, private law codifications.Louisiana belongs to the family of mixed jurisdictions. This is due to its history as the territory of what is today Louisiana was under French and Spanish colonial rule before being acquired by the United States.The Louisiana Civil Code boasts 3,556 provisions, which are housed in an introductory title and four books (governing persons, things, acquisition of ownership, and conflicts).The author teaches Louisiana Property Law, Public International Law and Introduction to U.S. Law at Loyola University New Orleans College of Law. He is a member of the Academy of European Private Law. Mit der Übersetzung des Zivilgesetzbuchs von Louisiana aus dem Englischen ins Deutsche wird Forschung, Lehre und Praxis im deutschen Sprachraum erstmals der unmittelbare Zugriff auf eine der bedeutendsten und dennoch in Europa weitgehend unbekannt gebliebenen Privatrechtskodifikationen ermöglicht. Louisiana wird der Rechtsfamilie der Mischsysteme zugerechnet. Dies hat zunächst geschichtliche Gründe, da das Gebiet des heutigen Bundesstaates vor dem Erwerb durch die Vereinigten Staaten unter französischer und spanischer Kolonialherrschaft stand. Das Gesetzeswerk umfasst 3.556 Vorschriften, die in einem Einleitungstitel und vier Büchern (Personen, Sachen, Eigentumserwerb und Kollisionsnormen) untergebracht sind. Der Autor lehrt Sachenrecht von Louisiana, Völkerrecht und Einführung in das U.S.-amerikanische Recht an der Loyola Universität in New Orleans (The Honorable Herbert W. Christenberry Professor of Law). Er ist Mitglied der Akademie für europäisches Privatrecht.
