    The economic crisis following the COVID-19 pandemic has increased the debt levels of corporations and reduced the level of investments. From a tax perspective, interest payments on debt are generally deductible from the corporate tax base, while costs related to equity are not. This debt-equity bias is a deep-rooted issue in today's tax system and inhibits equity-financed investments. From a microeconomic perspective, the bias leads to socially undesirable inefficiencies in capital markets, resulting in welfare losses. From a macroeconomic point of view, high debt levels hinder economic growth. To provide a stable and supportive tax environment for a sustainable recovery after the corona crisis, the European Commission has published a framework on "Business Taxation for the 21st Century" in May 2021. Besides other (long-term) proposals, a debt equity bias reduction allowance (DEBRA) should be developed to address the tax-induced distortions of debt financing. For a legislative proposal, the European Commission identified three possible concepts: First, a Comprehensive Business Income Tax (CBIT) that disallows the tax-deductibility of any financing cost. Second, an Allowance for Corporate Equity (ACE) that provides for the deductibility of notional interest on either all equity or new equity. And third, an alignment of the treatment of debt and equity financing by deducting a notional return on all capital, namely an Allowance for Corporate Capital (ACC).

    In order to curb tax-motivated profit shifting and limit international tax competition, 137 signatory coun- tries to the Inclusive Framework on Base Erosion and Profit Shifting (BEPS) agreed in 2021 to introduce a global minimum tax on multinational corporations. At first glance, the introduction of the minimum tax would effectively limit international tax competition to a rate of 15%. However, this would require the global implementation of the scheme, as well as the harmonization of tax-base calculation methods. Ful- filment of these conditions is unrealistic, however, due to non-cooperative countries as well as current political tensions. In addition, high administrative and compliance costs would result. Our estimates show that the additional tax declaration costs for affected German corporations would amount to around 319 million euros for implementation and to around 100 million euros annually for ongoing compliance. In September 2022, the German government announced that, if necessary, Germany will unilaterally intro- duce the global minimum tax scheme. This is not advisable, however, since a unilateral move would not reduce tax-motivated profit shifting or international tax competition. At the same time, it would lead to high one-sided costs and a reduction in Germany's attractiveness as a location for business and invest- ment, while also generating little in the way of new revenues.

    Anfang 2021 hat die Europäische Kommission den formalen Prozess zur Entwicklung eines stabilen regulatorischen und steuerlichen Rahmens zur Bewältigung der Herausforderungen der digitalen Wirtschaft wieder aufgenommen. Bereits 2018 wollte die Europäische Kommission eine politische Einigung über einen Richtlinienentwurf für eine Digitalsteuer als "schnelle Lösung" für eine internationale Steuerreform erzielen. Eine Einigung über den Richtlinienentwurf ist ausgeblieben. Seitdem haben mehrere EU-Mitgliedstaaten den Entwurf der Digitalsteuer als Vorlage für nationale Reformen genutzt. Diese unilateralen Reformen stehen im Widerspruch zum Vorschlag der OECD, die weltweite Unternehmensbesteuerung grundlegend zu reformieren, und den Bemühungen um einen multilateralen Konsens. Die Europäische Kommission will bei ihrem aktuellen Vorgehen die Entwicklungen auf internationaler Ebene zwar berücksichtigen, empfiehlt aber drei zusätzliche Optionen zur Besteuerung digitaler Unternehmen. Erstens erwägt sie wieder eine Digitalsteuer, also eine Steuer auf Umsätze, die durch bestimmte digitale Aktivitäten in der EU erzielt werden. Zweitens schlägt sie einen Aufschlag auf die Körperschaftsteuer vor, der auf alle Unternehmen angewendet werden soll, die bestimmte digitale Aktivitäten in der EU durchführen. Drittens schlägt sie eine Steuer auf digitale Transaktionen zwischen Unternehmen innerhalb der EU vor.     Um steuerlich motivierte Gewinnverlagerungen einzudämmen und den Steuerwettbewerb einzugrenzen, einigten sich im Jahr 2021 im Rahmen des "Inclusive Framework" 137 Staaten darauf, eine globale Min- destbesteuerung für multinationale Konzerne einzuführen. Auf den ersten Blick begrenzt die Mindestbe- steuerung den internationalen Steuerwettbewerb auf effektiv 15 Prozent. Allerdings setzt dies voraus, dass die Mindeststeuer tatsächlich global umgesetzt und die steuerliche Gewinnermittlung harmonisiert wird. Durch nicht-kooperative Staaten sowie aktuelle politische Spannungen ist dies unwahrscheinlich. Zudem entstehen hohe Kosten für Administration und Deklaration. Unsere Schätzungen ergeben, dass die zusätzlichen Deklarationskosten der betroffenen deutschen Unternehmen sich auf jährlich knapp 100 Mio. EUR laufende Kosten sowie Einmalkosten in Höhe von rund 319 Mio. EUR bemessen. Im September 2022 kündigte das Bundesministerium der Finanzen an, dass Deutschland die (globale) Mindeststeuer im Alleingang einführen wird. Hiervon ist abzuraten, da eine unilaterale Einführung weder einer steuerlich motivierten Gewinnverlagerungen noch dem internationalen Steuerwettbewerb ausreichend entgegenwir- ken kann. Gleichzeitig würde sie allenfalls geringe Steuermehreinnahmen generieren, jedoch zu hohen einseitigen Kosten führen und der Standortattraktivität Deutschlands schaden.

    This paper evaluates the Multilateral Convention to implement Pillar I Amount A, released by the OECD in October 2023, and the alternative proposal of Art. 12B for tax treaties suggested by the UN, with a particular emphasis on the perspective of developing countries. We conduct a comparative analysis of the proposals using an integrated economic and legal approach. Our assessment is based on the two proposals' ability to generate tax revenue and their implications for net-importing countries. Our legal analysis demonstrates significant differences between the two proposals in the implied reallocation of taxing rights, depending on the considered (digital) business model. Interestingly, we find that overall and despite its complexity, Pillar I Amount A addresses the specific interests of developing countries better than Art. 12B UN Model. In particular, Pillar I Amount A will likely outperform the UN's proposal in terms of its tax revenue potential.

    What are the sources of the commonly held presumption that reading literature should make people more just, humane, and sophisticated? Rendering literary history responsive to the cultural histories of reading, publishing, and education, The Pleasures of Memory illuminates the ways in which Dickens’s serial fiction shaped not only the popular practice of reading for pleasure and instruction but also the school subject we now know as "English."Winter shows how Dickens’s serial fiction instigated specific reading practices by reworking the conventions of religious didactic tracts from which most Victorians learned to read. Incorporating an influential associationist psychology of learning founded on the cumulative functioning of memory, Dickens’s serial novels consistently led readers to reflect on their reading as a form of shared experience.Dickens’s celebrity authorship, Winter argues, represented both a successful marketing program for popular fiction and a cultural politics addressed to a politically unaffiliated, social-activist Victorian readership. As late-nineteenth century educational reforms consolidated British and American readers into "mass" populations served by state school systems, Dickens’s beloved novels came to embody the socially inclusive and humanizing goals of democratic education

    What are the sources of the commonly held presumption that reading literature should make people more just, humane, and sophisticated? Rendering literary history responsive to the cultural histories of reading, publishing, and education, The Pleasures of Memory illuminates the ways in which Dickens’s serial fiction shaped not only the popular practice of reading for pleasure and instruction but also the school subject we now know as "English."Winter shows how Dickens’s serial fiction instigated specific reading practices by reworking the conventions of religious didactic tracts from which most Victorians learned to read. Incorporating an influential associationist psychology of learning founded on the cumulative functioning of memory, Dickens’s serial novels consistently led readers to reflect on their reading as a form of shared experience.Dickens’s celebrity authorship, Winter argues, represented both a successful marketing program for popular fiction and a cultural politics addressed to a politically unaffiliated, social-activist Victorian readership. As late-nineteenth century educational reforms consolidated British and American readers into "mass" populations served by state school systems, Dickens’s beloved novels came to embody the socially inclusive and humanizing goals of democratic education
