    A common claim holds that investment treaties reduce the willingness of host countries to regulate foreign-owned, environmentally-stranded, investments. A counter-argument is that the treaties can yield incentives for environmentally friendly replacement investment. This paper examines these claims in a stylised setting with a stranded investment and a potential replacement investment, both of which are protected by an investment agreement. The paper shows how treaty protection weakens incentives for environmental protection. The paper also shows how the extent of environmental damage depends on the implementation of core legal notions, such as investor legitimate expectations, the full compensation requirement, carve-outs from compensation obligations, and what qualifies as an investment.

    Halting the ongoing global loss of biodiversity will require extensive phase-out of harmful production. A significant share of the affected production will be foreign-owned, and can therefore potentially be covered by investment treaties. These treaties are sometimes alleged to dissuade host countries from phasing out harmful investments, while other observers argue that the treaties are needed to provide incentives for the replacement investments that are required to prevent large income losses. To examine the impact of investment treaties on biodiversity protection, this paper studies a setting with both a stranded and a replacement investment. Among other findings, the paper shows how the dissuading effect of the agreement on host country regulation of the replacement investment, induces the investor to choose a replacement investment that is harmful to biodiversity, and how this in turn reduces the host country's willingness to phase out the stranded investment. The framework also sheds light on fundamental legal notions such as investor "legitimate expectations," "full compensation," and "investment."

    This paper examines the intensive and extensive margins of carbon leakage. The analysis uses an increase in the Swedish electricity price to identify the impact on imports at the firm and product level. Our model of heterogenous firms predicts that higher domestic electricity prices lead firms to substitute towards imports of electricity-intense products. We test the predictions of the model using detailed firm-level data for Swedish manufacturing that includes the firm's electricity use, their electricity cost, and the products they import, over the years 2001-2006 inclusive. We find evidence that the impact of the electricity price is mostly a story about the extensive margin of firm imports: firms with a certain productivity respond to higher electricity prices by substituting towards relatively electricity-intense imported products. We do not find much support of an intensive margin effect, i.e. for the notion that an electricity price increase induces a broad response across firms in a given sector. Our empirical results identify the magnitude of the impact of the electricity price increase on imports and our findings characterize the firms that could be at risk to leakage.
