    " What challenges face jurisdictions that attempt to conduct law in two or more languages? How does choosing a legal language affect the way in which justice is delivered? Answers to these questions are vital for the 75 officially bilingual and multilingual states of the world, as well as for other states contemplating a move towards multilingualism. Arguably such questions have implications for all countries in a world characterized by the pressures of globalization, economic integration, population mobility, decolonization, and linguistic re-colonization. For lawyers, addressing such challenges is made essential by the increased frequency and scale of transnational legal dealings and proceedings, as well as by the lengthening reach of international law. But it is not only policy makers, legislators, and other legal practitioners who must think about such questions. The relationship between societal multilingualism and law also raises questions for the burgeoning field of language and law, which posits--among other tenets--the centrality of language in legal processes. In this book, Janny H.C. Leung examines key aspects of legal multilingualism. Drawing extensively on case studies, she describes the implications of the legal, practical, and ideological dilemmas encountered in a given country when it becomes bilingual or multilingual, discussing such issues as: how legal certainty and the linguistic ideology of authenticity may be challenged in a multilingual jurisdiction; how courts balance the language preferences of different courtroom participants; and what historical, socio-political and economic factors may influence the decision to cement a given language as a jurisdiction's official language. Throughout, Leung elaborates a theory of "symbolic jurisprudence" to explore common dilemmas found across countries, despite their varied political and cultural settings, and argues that linguistic equality as proclaimed and practiced today is a shallow kind of equa lity. Although officially multilingual jurisdictions appear to be more inclusive than their monolingual counterparts, they run the risk of disguising substantive inequalities and displacing real efforts for more progressive social change. This is the first book to offer overarching discussion of how such issues relate to each other, and the first systematic study of legal multilingualism as a global phenomenon. "--

    ger: Die Geschichte der Donauschwaben auf dem Gebiet des ehemaligen Jugoslawien reicht bis in das 18. Jahrhundert zurück und endet nach dem Zweiten Weltkrieg mit ihrer Vertreibung. Seit wenigen Jahren findet eine Aufarbeitung ihres Schicksals statt, welche sich auch in der Literatur bemerkbar macht. Bauer, Jergović und Šnajder setzen sich in den ausgewählten Werken mit ihrer Identität auseinander und behandeln zudem Erinnerung und Gedächtnis. Ziel dieser Arbeit ist festzustellen, wie der Zusammenhang von Erinnerung bzw. Gedächtnis und Identität dargestellt wird. Da der literarische Stoff viele historische Bezüge aufweist, wird ein historischer Überblick über die Donauschwaben vorangestellt. Der erste Teil ist als theoretische Abhandlung über Erinnerung und Gedächtnis anzusehen. Es werden grundlegende Erkenntnisse dargestellt und der Einfluss von Erinnerung und Gedächtnis auf Identität besprochen. Die erlangten Methoden dienen der Analyse und werden um Konzepte der traditionellen Literaturwissenschaft ergänzt. Es stellt sich die Frage, wie Erinnerung und Gedächtnis in den Werken literarisch inszeniert werden und wie sich ihr Einfluss auf die Identität der Figuren bemerkbar macht. Da der Raum in vielen Gedächtniskonzepten eine wichtige Rolle einnimmt, wird untersucht, welche Funktionen die dargestellten Räume haben. In der Analyse zeigt sich schließlich, dass Erinnerung und Gedächtnis durch verschiedene narrative Mittel dargestellt werden, wobei die Darstellung der Zeit hervorsticht, und dass diese die Identitätsbildung je nach Qualität unterstützen oder stören können. Zudem konnte festgestellt werden, dass Räume als Auslöser und / oder Inhalt von Erinnerung fungieren und nationale Identitätskonzepte in Frage gestellt werden, indem kollektive Vereinnahmungen zugunsten von individuellen Identitätskonzepten durchbrochen werden eng: The history of Danube Swabians located in the territory of the former Yugoslavia goes back to the 18th century and ends after the Second World War with the displacement of the majority of their descendants. After decades of silence, a reappraisal of their fate has been taking place in Croatia over the last few years. This shift is also reflected in literature, as authors are increasingly discussing the topic. Among these authors are Bauer, Jergović and Šnajder. In the light of their identity, they each cover the themes recollection and remembrance. The aim of this work is to determine how the correlation between recollection or remembrance and identity is depicted. Since the literary topic features various historical references, an overview of the Danube Swabians is prefixed. The first part is a theoretical discourse of the terms recollection and remembrance. It presents fundamental knowledge and discusses the impact of recollection and remembrance on identity. The attained techniques are applied in the analysis and are complemented by concepts of traditional literary criticism. The question is how recollection and remembrance are utilized and how their impact on the identity of the characters becomes noticeable. Furthermore, since space plays such a significant role in various memory concepts, the function of the depicted spaces is investigated. In conclusion, the analysis shows that recollection and remembrance are represented through various narrative techniques. The most prominent one of them is the depiction of time which depending on quality can facilitate or disrupt identity formation. In addition, it became apparent that space acts as a trigger and / or as storyline for recollection and that national identity concepts are disputable by breaking through collective cooptation in favour of individual identity concepts.
