    Erste kritische Stellungnahmen zu den neuen Verfahren der Information und Konsultation in multinationalen Unternehmen innerhalb der EU stellen ernsthaft in Frage, ob solche Strukturen überhaupt die Möglichkeit bieten, "europäische" Bedingungen bzw. solche für die Errichtung von "Betriebsräten " zu schaffen. In dem Artikel werden einige Dimensionen der Transnationalität näher untersucht, die die Delegierten im Rahmen der Europäischen Betriebsräte durchgesetzt sehen wollen. In diesem Zusammenhang sind Elemente genannt worden wie beispielsweise faire und eindeutige Verhaltensregeln für alle Beteiligten; der EBR als Organisationsform, innerhalb derer Weiterbildung möglich ist, Festlegung der Wahlkreise, Solidarität und ein auf Mehrsprachigkeit basierender, multikultureller Ansatz. Alle diese Punkte werden als entscheidend für die Bildung eines transnationalen Arbeitnehmerorgans angesehen, dessen Ziel vorrangig darin besteht, über die Grenzen der nationalen Kultur hinauszugehen. Die Entwicklung entsprechender Ziele und Verfahren ließe sich vielleicht auf dem Wege einer neuen gewerkschaftlichen Aufklärungsarbeit erreichen. Angesichts der Tatsache, daß das Thema "Ausbildung" in der Richtlinie weitgehend unberücksichtigt bleibt, ist davon auszugehen, daß die europäische Gewerkschaftsbewegung heute, wo sich die Möglichkeit zur Überprüfung der Richtlinie bietet, an einem kritischen Punkt angelangt ist. (Transfer / FUB) Early critiques of the new procedures for information and consultation within multinationals in the EU pose serious questions as to whether such structures have the potential for being either 'European' or a 'works' council. This article attempts to clarify some of the dimensions of a transnationality which delegates would like to see prevail within their European works councils. Such elements as 'a level playing field'; the EWC as a learning organisation, awareness of constituencies, solidarity and multilingualism and multiculturalism have been advanced as a key set of organisational features of a transnational worker body seeking to transcend national culture. The development of such values and practices may be achievable via a new trade union pedagogy. However, given the absence of any steer within the Directive on training the European trade union movement would appear to be at a critical juncture as the opportunity for a revision arises. (Transfer / FUB) Les premieres critiques concernant les nouvelles procedures en matiere d'information et de consultation au sein des multinationales dans l'UE soulevent d'importantes questions quant a savoir si de telles structures pourraient un jour devenir "europeennes" ou de veritables "comites d'entreprise". Cet article essaie de clarifier certaines dimensions de la transnationalite que les delegues voudraient voir prevaloir dans les comites d'entreprise europeens. Il a ete mis en avant que des elements tels que "terrain d'egalite", comite d'entreprise europeen en tant qu'organisation d'apprentissage, conscience des electeurs, solidarite, multilinguisme, et multiculturalisme sont des caracteristiques organisationnelles cle d'un organisme transnational des travailleurs cherchant a transcender sa culture nationale. Le developpement de telles valeurs et pratiques peut etre realise via une nouvelle pedagogie syndicale. Neanmoins, compte tenu de l'absence dans la directive d'indications precises sur la formation, le mouvement syndical europeen semblerait etre dans une situation critique au moment ou la revision pointe a l'horizon.     Die EBR-Richtlinie verdankt ihre erstaunlich erfolgreiche Umsetzung in der Praxis der Erfindung einer neuen Form der Implementierung von Recht. Das Prinzip der doppelten Subsidiarität mit seinem schrittweise ansteigenden rechtlichen Zwang führte dazu, daß die Ziele der Richtlinie bereits partiell wirksam werden konnten, bevor sie in den Mitgliedstaaten umgesetzt worden ist. Dadurch bewirkt sie die Entstehung einer genuin europäischen Praxis der Mitbestimmung. Der Aufsatz untersucht, in welchem Ausmaß die Umsetzungsbestimmungen von nationalen Traditionen der Arbeitsbeziehungen geprägt sind und deshalb voneinander - und von den Vorgaben der Richtlinie - abweichen. Dies wird an jeweils einem Beispiel aus den fünf charakteristischen Modellen der industriellen Beziehungen in Europa dargestellt. Anschließend werden zentrale Probleme, die sich aus den Besonderheiten der nationalen Umsetzungsbestimmungen in Frankreich, Irland, Schweden, Spanien und Deutschland für das Ziel einer Vereinheitlichung des Rechts der Mitbestimmung ergeben, erörtert. Für die Weiterentwicklung und Harmonisierung des europäischen Rechts der betrieblichen Mitbestimmung kommt den gerichtlichen Auseinandersetzungen eine zunehmend große Bedeutung zu. Dies zeigen erste Erfahrungen in den Fällen RENAULT und PANASONIC. Abschließend werden Anforderungen formuliert, die aus juristischer Sicht zur Steigerung der Effektivität der Mitbestimmung beitragen können und bei der im Herbst 1999 anstehenden Überprüfung der Richtlinie bedacht werden sollten. (Transfer / FUB) The European Works Councils Directive owes the astonishing success of its transposition to the devising of a new mode of legislative implementation. The principle of double subsidiarity, with the progressive manner in which the provisions acquire a legally binding character, has led to a situation in which the aims of the Directive had been realised in part even before its formal implementation in the Member States. In this way it facilitates the emergence of a genuinely European practice of information and consultation. The article investigates to what extent the transposition regulations bear the stamp of national industrial relations traditions and hence diverge from one another - and from the prescriptions of the Directive - and this is demonstrated by taking one example of each of the five characteristic industrial relations models found in Europe. This exposition is followed by a discussion of certain problems that have arisen from the specific features of national transposition regulations in France, Ireland, Sweden, Spain and Germany in relation to the goal of harmonising the legislation on codetermination. Litigation is playing an increasingly significant role in the further development and harmonisation of European law on workplace codetermination, as evidenced by the initial outcomes of the Renault and Panasonic cases. Finally, the author formulates a number of demands which would contribute to strengthening the legal basis for effective codetermination and which should be borne in mind in the run-up to the revision of the Directive in autumn 1999. (Transfer / FUB) Le succes de la transposition de la directive sur les Conseils d'entreprise europeens (CEE) tient du fait d'une nouvelle forme d'application du droit. Grace au principe de la double subsidiarite et de son obligation legale progressive, les buts de la directive ont ete partiellement realises avant meme sa transposition dans les Etats Membres, donnant naissance ainsi a une reelle pratique europeenne d'information et de consultation des travailleurs. L'article examine dans quelle mesure les dispositions des transpositions sont influencees par les traditions nationales en matiere de relations industrielles et, partant, se differencient les unes des autres ainsi que des prescriptions de la directive. Ceci est demontre par un exemple pour chacun des cinq modeles caracteristiques de relations industrielles en Europe. Sont analyses ensuite des problemes essentiels pour l'harmonisation du droit sur l'information et la consultation des travailleurs et qui resultent des specificites nationales des dispositions de transposition en France, en Irlande, en Suede, en Espagne et en Allemagne. Pour le developpement et l'harmonisation du droit europeen d'information et de consultation des travailleurs au niveau de l'entreprise les litiges jouent un role grandissant, ce qui est demontre par les premieres experiences des cas RENAULT et PANASONIC. Finalement, l'auteur fait des propositions qui, d'un point de vue juridique, peuvent contribuer a ameliorer l'information et la consultation des travailleurs et dont on devrait tenir compte lors de la revision de la directive en automne 1999.
