    In Race, Rights, and Recognition, Dean J. Franco explores the work of recent Jewish American writers, many of whom have taken unpopular stances on social issues, distancing themselves from the politics and public practice of multiculturalism. While these writers explore the same themes of group-based rights and recognition that preoccupy Latino, African American, and Native American writers, they are generally suspicious of group identities and are more likely to adopt postmodern distancing techniques than to presume to speak for "their people." Ranging from Philip Roth's scandalous 1969 novel Portnoy's Complaint to Gary Shteyngart's Absurdistan in 2006, the literature Franco examines in this book is at once critical of and deeply invested in the problems of race and the rise of multicultural philosophies and policies in America.Franco argues that from the formative years of multiculturalism (1965-1975), Jewish writers probed the ethics and not just the politics of civil rights and cultural recognition; this perspective arose from a stance of keen awareness of the limits and possibilities of consensus-based civil and human rights. Contemporary Jewish writers are now responding to global problems of cultural conflict and pluralism and thinking through the challenges and responsibilities of cosmopolitanism. Indeed, if the United States is now correctly-if cautiously-identifying itself as a post-ethnic nation, it may be said that Jewish writing has been well ahead of the curve in imagining what a post-ethnic future might look like and in critiquing the social conventions of race and ethnicity

    Over the past fifty years, debates about human rights have assumed an increasingly prominent place in postcolonial literature and theory. Writers from Salman Rushdie to Nawal El Saadawi have used the novel to explore both the possibilities and challenges of enacting and protecting human rights, particularly in the Global South. In Fictions of Dignity, Elizabeth S. Anker shows how the dual enabling fictions of human dignity and bodily integrity contribute to an anxiety about the body that helps to explain many of the contemporary and historical failures of human rights, revealing why and how lives are excluded from human rights protections along the lines of race, gender, class, disability, and species membership. In the process, Anker examines the vital work performed by a particular kind of narrative imagination in fostering respect for human rights. Drawing on phenomenology, Anker suggests how an embodied politics of reading might restore a vital fleshiness to the overly abstract, decorporealized subject of liberal rights.Each of the novels Anker examines approaches human rights in terms of limits and paradoxes. Rushdie's Midnight's Children addresses the obstacles to incorporating rights into a formerly colonized nation's legal culture. El Saadawi's Woman at Point Zero takes up controversies over women's freedoms in Islamic society. In Disgrace, J. M. Coetzee considers the disappointments of post-apartheid reconciliation in South Africa. And in The God of Small Things, Arundhati Roy confronts an array of human rights abuses widespread in contemporary India. Each of these literary case studies further demonstrates the relevance of embodiment to both comprehending and redressing the failures of human rights, even while those narratives refuse simplistic ideals or solutions

    Sodom on the Thames looks closely at three episodes involving sex between men in late-nineteenth-century England. Morris Kaplan draws on extensive research into court records, contemporary newspaper accounts, personal correspondence and diaries, even a pornographic novel. He focuses on two notorious scandals and one quieter incident.In 1871, transvestites "Stella" (Ernest Boulton) and "Fanny" (Frederick Park), who had paraded around London's West End followed by enthusiastic admirers, were tried for conspiracy to commit sodomy. In 1889-1890, the "Cleveland Street affair" revealed that telegraph delivery boys had been moonlighting as prostitutes for prominent gentlemen, one of whom fled abroad. In 1871, Eton schoolmaster William Johnson resigned in disgrace, generating shockwaves among the young men in his circle whose romantic attachments lasted throughout their lives. Kaplan shows how profoundly these scandals influenced the trials of Oscar Wilde in 1895 and contributed to growing anxiety about male friendships.Sodom on the Thames reconstructs these incidents in rich detail and gives a voice to the diverse people involved. It deepens our understanding of late Victorian attitudes toward urban culture, masculinity, and male homoeroticism. Kaplan also explores the implications of such historical narratives for the contemporary politics of sexuality

    The word "elegy" comes from the Ancient Greek elogos, meaning a mournful poem or song, in particular, a song of grief in response to loss. Because mourning and memorialization are so deeply embedded in the human condition, all human societies have developed means for lamenting the dead, and, in "That the People Might Live" Arnold Krupat surveys the traditions of Native American elegiac expression over several centuries.Krupat covers a variety of oral performances of loss and renewal, including the Condolence Rites of the Iroquois and the memorial ceremony of the Tlingit people known as koo'eex, examining as well a number of Ghost Dance songs, which have been reinterpreted in culturally specific ways by many different tribal nations. Krupat treats elegiac "farewell" speeches of the eighteenth and nineteenth centuries in considerable detail, and comments on retrospective autobiographies by Black Hawk and Black Elk.Among contemporary Native writers, he looks at elegiac work by Linda Hogan, N. Scott Momaday, Gerald Vizenor, Sherman Alexie, Maurice Kenny, and Ralph Salisbury, among others. Despite differences of language and culture, he finds that death and loss are consistently felt by Native peoples both personally and socially: someone who had contributed to the People's well-being was now gone. Native American elegiac expression offered mourners consolation so that they might overcome their grief and renew their will to sustain communal life

    How a society defines crimes and prosecutes criminals illuminates its cultural values, social norms, and political expectations. In Murder Most Russian, Louise McReynolds uses a fascinating series of murders and subsequent trials that took place in the wake of the 1864 legal reforms enacted by Tsar Alexander II to understand the impact of these reforms on Russian society before the Revolution of 1917. For the first time in Russian history, the accused were placed in the hands of juries of common citizens in courtrooms that were open to the press. Drawing on a wide array of sources, McReynolds reconstructs murders that gripped Russian society, from the case of Andrei Gilevich, who advertised for a personal secretary and beheaded the respondent as a way of perpetrating insurance fraud, to the beating death of Marianna Time at the hands of two young aristocrats who hoped to steal her diamond earrings.As McReynolds shows, newspapers covered such trials extensively, transforming the courtroom into the most public site in Russia for deliberation about legality and justice. To understand the cultural and social consequences of murder in late imperial Russia, she analyzes the discussions that arose among the emergent professional criminologists, defense attorneys, and expert forensic witnesses about what made a defendant's behavior "criminal." She also deftly connects real criminal trials to the burgeoning literary genre of crime fiction and fruitfully compares the Russian case to examples of crimes both from Western Europe and the United States in this period.Murder Most Russian will appeal not only to readers interested in Russian culture and true crime but also to historians who study criminology, urbanization, the role of the social sciences in forging the modern state, evolving notions of the self and the psyche, the instability of gender norms, and sensationalism in the modern media

    The poet Langston Hughes was a tireless world traveler and a prolific translator, editor, and marketer. Translations of his own writings traveled even more widely than he did, earning him adulation throughout Europe, Asia, and especially the Americas. In The Worlds of Langston Hughes, Vera Kutzinski contends that, for writers who are part of the African diaspora, translation is more than just a literary practice: it is a fact of life and a way of thinking. Focusing on Hughes's autobiographies, translations of his poetry, his own translations, and the political lyrics that brought him to the attention of the infamous McCarthy Committee, she shows that translating and being translated-and often mistranslated-are as vital to Hughes's own poetics as they are to understanding the historical network of cultural relations known as literary modernism.As Kutzinski maps the trajectory of Hughes's writings across Europe and the Americas, we see the remarkable extent to which the translations of his poetry were in conversation with the work of other modernist writers. Kutzinski spotlights cities whose role as meeting places for modernists from all over the world has yet to be fully explored: Madrid, Havana, Buenos Aires, Mexico City, and of course Harlem.     This is not a book on rhetoric in any narrow sense, but rather concerns its general ambiance and also some of its quite specific manifestations. The thirteen chapters that comprise the book move chronologically from the Renaissance up to the present time. Chapter 2 shows the continuity of verbal expression during the English Renaissance with earlier speech and thought patterns before the invention of writing. In the third chapter, a detailed report is given on the entire production of English-language books on rhetoric and poetic and literary criticism or theory during the Tudor age, from the late 15th through the beginning of the 17th century. The fourth chapter indicates the central significance of the art of memory.The chapters from 5 through 12 treat the interrelationships between social institutions and modes of thought and expression (Latin Language Study as a Renaissance Puberty Rite; Ramist Classroom Procedure and the Nature of Reality; Ramist Method and the Commercial Mind; Swift on the Mind: Satire in a Closed Field; Psyche and the Geometers; Associationist Critical Theory; J. S. Mill's Pariah Poet; Romantic Difference and the Poetics of Technology; and The Literate Orality of Popular Culture Today).     In Dirt for Art's Sake, Elisabeth Ladenson recounts the most visible of modern obscenity trials involving scandalous books and their authors. What, she asks, do these often-colorful legal histories have to tell us about the works themselves and about a changing cultural climate that first treated them as filth and later celebrated them as masterpieces?Ladenson's narrative starts with Madame Bovary (Flaubert was tried in France in 1857) and finishes with Fanny Hill (written in the eighteenth century, put on trial in the United States in 1966); she considers, along the way, Les Fleurs du Mal, Ulysses, The Well of Loneliness, Lady Chatterley's Lover, Tropic of Cancer, Lolita, and the works of the Marquis de Sade. Over the course of roughly a century, Ladenson finds, two ideas that had been circulating in the form of avant-garde heresy gradually became accepted as truisms, and eventually as grounds for legal defense. The first is captured in the formula "art for art's sake"-the notion that a work of art exists in a realm independent of conventional morality. The second is realism, vilified by its critics as "dirt for dirt's sake." In Ladenson's view, the truth of the matter is closer to -dirt for art's sake-"the idea that the work of art may legitimately include the representation of all aspects of life, including the unpleasant and the sordid.Ladenson also considers cinematic adaptations of these novels, among them Vincente Minnelli's Madame Bovary, Stanley Kubrick's Lolita and the 1997 remake directed by Adrian Lyne, and various attempts to translate de Sade's works and life into film, which faced similar censorship travails. Written with a keen awareness of ongoing debates about free speech, Dirt for Art's Sake traces the legal and social acceptance of controversial works with critical acumen and delightful wit

    Public academic prize contests-the concours académique-played a significant role in the intellectual life of Enlightenment France, with aspirants formulating positions on such matters as slavery, poverty, the education of women, tax reform, and urban renewal and submitting the resulting essays for scrutiny by panels of judges. In The Enlightenment in Practice, Jeremy L. Caradonna draws on archives both in Paris and the provinces to show that thousands of individuals-ranging from elite men and women of letters artisans, and peasants-participated in these intellectual competitions, a far broader range of people than has been previously assumed.Caradonna contends that the Enlightenment in France can no longer be seen as a cultural movement restricted to a small coterie of philosophers or a limited number of printed texts. Moreover, Caradonna demonstrates that the French monarchy took academic competitions quite seriously, sponsoring numerous contests on such practical matters as deforestation, the quality of drinking water, and the nighttime illumination of cities. In some cases, the contests served as an early mechanism for technology transfer: the state used submissions to identify technical experts to whom it could turn for advice. Finally, the author shows how this unique intellectual exercise declined during the upheavals of the French Revolution, when voicing moderate public criticism became a rather dangerous act

    In 2002 a manga (comic book) was for the first time successfully charged with the crime of obscenity in the Japanese courts. In The Art of Censorship Kirsten Cather traces how this case represents the most recent in a long line of sensational landmark obscenity trials that have dotted the history of postwar Japan. The objects of these trials range from a highbrow literary translation of Lady Chatterley’s Lover and modern adaptations and reprintings of Edo-period pornographic literary "classics" by authors such as Nagai Kafu to soft core and hard core pornographic films, including a collection of still photographs and the script from Oshima Nagisa’s In the Realm of the Senses, as well as adult manga. At stake in each case was the establishment of a new hierarchy for law and culture, determining, in other words, to what extent the constitutional guarantee of free expression would extend to art, artist, and audience.The work draws on diverse sources, including trial transcripts and verdicts, literary and film theory, legal scholarship, and surrounding debates in artistic journals and the press. By combining a careful analysis of the legal cases with a detailed rendering of cultural, historical, and political contexts, Cather demonstrates how legal arguments are enmeshed in a broader web of cultural forces. She offers an original, interdisciplinary analysis that shows how art and law nurtured one another even as they clashed and demonstrates the dynamic relationship between culture and law, society and politics in postwar Japan.The Art of Censorship will appeal to those interested in literary and visual studies, censorship, and the recent field of affect studies.
