    Welche besondere kollisionsrechtliche Funktion haben die Abgrenzungsnormen im internationalen Einheitsrecht? Wie wirkt sich die Doppelnatur staatsvertraglichen Einheitsprivatrechts auf die Methodenlehre aus? Welche Prinzipien liegen ihr zugrunde? Diese Fragen stellen sich, wenn neue, beim Abschluss der Konvention nicht absehbare Rechtsfragen methodensauber zu beantworten sind. Kilian Alexander Gramsch behandelt in diesem Zusammenhang die Auslegungsmethoden und Auslegungsgrenzen von Einheitsrecht. Er arbeitet heraus, dass die völkerrechtlichen Auslegungsvorschriften eine dynamische Auslegung international-einheitsrechtlicher Bestimmungen ermöglichen. Auf dieser Grundlage untersucht er die aktuelle und praxisrelevante Frage der Anwendbarkeit des UN-Kaufrechts auf Verträge über digitale Güter und bezieht dabei auch das Gewährleistungsrecht mit ein. Multilateral law-making treaties that are aimed at establishing private law exhibit a twofold legal nature which necessitates a particular methodology. Kilian A. Gramsch explores both the methods and limits of interpretation of international uniform law. This fundamental analysis serves as the basis for a detailed examination of the applicability of the UN Convention on Contracts for the International Sale of Goods (CISG) to contracts for digital goods, including the convention's specific system of remedies.
