    Wie stehen Methodenlehre und juristische Argumentation zueinander? Was ist juristische Argumentation, was „bloße“ Rhetorik? Das Lehrbuch zur juristischen Argumentationstheorie stellt die Modelle juristischen Argumentierens vor und unterzieht sie einer (kritischen) Würdigung. Das betrifft etwa die Argumentationsanalyse seitens der „Strukturierenden Rechtslehre“ und das sogenannte „pragma-dialektische“ Modell der Argumentation. Explizit warnt der Band vor einem postmodernen Irrationalismus, der die Regelorientierung juristischen Argumentierens grundsätzlich in Zweifel zieht. Das Lehrbuch zeigt auf, wie die „Produktion“ von rechtlichen Entscheidungen und subgesetzlichen Regeln rational kontrollierbar und kritisierbar wird; es leistet damit einen Beitrag zu einer im besten Sinne kritischen Rechtswissenschaft.

    Klappentext: Die Theorie des wilden Übersetzens, die dieses Buch entwickelt, beschreibt Verfahren des Übersetzens, die als generativer Mechanismus zur Produktion eigenständiger literarischer Texte eingesetzt werden. In diesem Umgang mit Übersetzung liegt ein gezielter Verstoß gegen die konventionellen Übersetzungsnormen, insofern sich das literarische Verfahren, das dabei zum Einsatz kommt, von der Bedeutung der fremdsprachigen Wörter löst. Das wilde Übersetzen orientiert sich stattdessen an den Zeichenträgern des fremden Sprachmaterials. Die theoretischen Überlegungen werden ergänzt durch zwei Lektüren, welche die Emergenz dieser Konstellation in zwei unterschiedlichen literaturgeschichtlichen Kontexten in Johann Fischarts Geschichtklitterung (1575) und in Arno Schmidts Zettel's Traum (1970) nachzeichnen. Über den Nachweis der Verfahren selbst und die Rekonstruktion ihrer jeweiligen Funktionsweise hinaus rekonstruiert diese Studie die poetologischen Reflexionen, die in beiden Texten zur Explikation des Verfahrens angestellt werden. Die Lektüren zeigen, dass das wilde Übersetzen nicht nur die formale Gestalt der Texte bestimmt, sondern auch Konsequenzen für deren inhaltliche Interpretation mit sich bringt. It describes literary strategies that not only serve to translate content but also produce new poetic texts out of foreign linguistic material. Section One consists of chapters focusing on semiotic methodologies for the study of religion and theology. The remaining part of the book focuses on detailed empirical applications while still considering methodological issues. Section Two focuses on semiotics of ritual, both ritual performance and texts about ritual transformation. Section Three looks at the semiotics of visual religious imagery, ranging from colour terms to icons. Es reagiert damit auf die latente Machtvergessenheit hermeneutischer Tradition, profiliert sowohl die Arbeit am Deutungs- als auch am Machtbegriff und versucht, die Verschränkungen von Deutungs- und Machtprozessen aufzuzeigen. Dabei werden besonders konkurrierende Deutungen und ihre konfligierenden Geltungsansprüche in den Blick genommen. Dieser Band entfaltet das Potential von Deutungsmachtanalysen erstmalig innovativ und multiperspektivisch im Kontext praktisch-theologischer Reflexion. In einem ersten Teil werden Grundfragen der Deutungsmachtanalyse aufgenommen und entfaltet, wie das Fach Praktische Theologie überhaupt von Fragen der Macht affiziert werden kann. Dabei werden auch das modale Machtverständnis und die Diskursanalyse Foucaults auf die Praktische Theologie bezogen. Grundlegende Diskurse wie die des Alterns oder der Kulturhermeneutik werden entsprechend deutungsmachtaffin erschlossen. In einem zweiten Teil werden Formen religiöser und kirchlicher Kommunikation auf Phänomene von Deutungsmachtansprüchen hin untersucht und die rhetorischen, metaphorischen und performativen Strategien der Aufmerksamkeitserzeugung und der Vermittlung von Evidenzansprüchen kritisch freigelegt. Dabei werden verschiedene Handlungsfelder der Praktischen Theologie berücksichtigt wie z.B.
