Caleb Smith explores the confessions, trial reports, maledictions, and martyr narratives that juxtaposed law and conscience in antebellum America’s court of public opinion and shows how writers portrayed struggles for justice as clashes between human law and higher authority, giving voice to a moral protest that transformed American literature. Condemned to hang after his raid on Harper’s Ferry, John Brown prophesied that the crimes of a slave-holding land would be purged away only with blood. A study of omens, maledictions, and inspired invocations, The Oracle and the Curse examines how utterances such as Brown’s shaped American literature between the Revolution and the Civil War. In nineteenth-century criminal trials, judges played the role of law’s living oracles, but offenders were also given an opportunity to address the public. When the accused began to turn the tables on their judges, they did so not through rational arguments but by calling down a divine retribution. Widely circulated in newspapers and pamphlets, these curses appeared to channel an otherworldly power, condemning an unjust legal system and summoning readers to the side of righteousness. Exploring the modes of address that communicated the authority of law and the dictates of conscience in antebellum America’s court of public opinion, Caleb Smith offers a new poetics of justice which assesses the nonrational influence that these printed confessions, trial reports, and martyr narratives exerted on their first audiences. Smith shows how writers portrayed struggles for justice as clashes between human law and higher authority, giving voice to a moral protest that transformed American literature.

    Set at the intersection of Human Rights, social justice and Literature, this cutting edge book examines a range of literary texts, fiction, plays and poetry, and through them considers representations of Human Rights and their violations. Examining violated bodies and subjects, the settings and environments in which these are embedded and the witnessing of atrocities, it considers how the ‘subject’ (or ‘person’ of Human Rights) emerges within fiction or poetry. Structured so as to move outward from the individual body to the world, the study progresses from the preconditions or settings for Human Rights violations through to atrocity, from witnessing to the making of a specific kind of public around traumatic recall. It addresses representations of destroyed corporeality and subjectivity, the violations and dissolution of the subject and the construction of trauma-memory citizenship to the making of communities of mourning.     Der Band bietet eine Einführung in die Rechtssoziologie und die interdisziplinäre Rechtsforschung, die sich im Anschluss an die Socio-legal Studies und die Law and Society-Forschung im angelsächsischen Raum auch im deutschsprachigen Raum herausbildet. Die 16 Beiträge erschließen in exemplarischer Weise die theoretischen, methodischen und inhaltlichen Grundlinien der Beforschung von Recht in den verschiedenen wissenschaftlichen Disziplinen - darunter z.B. Soziologie, Politikwissenschaft, Anthropologie, Rechtswissenschaft, Kriminologie, Ethnologie und Philosophie. Sie geben den LeserInnen einerseits einen fundierten Überblick im Sinne einer Bestandsaufnahme. Andererseits werden zentrale Fragestellungen zukünftiger Forschungen und damit Perspektiven des Feldes skizziert. Neben den theoretischen und methodischen Grundlagen der Rechtsforschung entsteht so anhand von beispielhaften Forschungsfragen ein multiperspektivisches Bild der wissenschaftlichen Befassung mit Recht als sozialem Phänomen in den verschiedenen Disziplinen. Der Schwerpunkt liegt dabei auf empirischen, zeitgenössischen und gesellschaftswissenschaftlichen Fragestellungen in den Bereichen „Funktion, Genese und Wirkung Recht“, „Anwendung und Durchsetzung von Recht“ sowie „Wandel von Recht“. Hierin zeigt sich der Charakter der interdisziplinären Rechtsforschung als einer Grundlagendisziplin, die auf eine lange Forschungstradition in Rechtssoziologie, Rechtstatsachenforschung und Rechtswirkungsforschung aufbaut. Die HerausgeberInnen Dr. Christian Boulanger ist Wissenschaftlicher Mitarbeiter an der Humboldt-Universität zu Berlin.
