    In a popular sense, 'law' connotes the rules of a society, as well as the institutions that make and enforce those rules. Although laws are created and interpreted in legislatures and courtrooms by individuals with very specialized knowledge, the practice and making of law is closely tied to other systems of knowledge. To emphasize this often downplayed connection, Rehumanizing Law examines the law in relation to narrative, a fundamental mode of human expression.Randy D. Gordon illustrates the bridge between narrative and law by considering whether literature can prompt legislation. Using Upton Sinclair's The Jungle and Rachel Carson's Silent Spring, Gordon shows that literary works can figure in important regulatory measures. Discussing the rule of law in relation to democracy, he reads Melville's Billy Budd and analyzes the O.J. Simpson and Rodney King cases.This highly original and creative study reconnects the law to its narrative roots by showing how and why stories become laws

    Is the procedural autonomy of EU Member State a myth or a reality? What should this concept be taken to mean? Starting from the analysis of requirements and principles regulating, generally speaking, the relationships between Member States` and EU law, this book provides a definition of procedural autonomy able to account for the concept`s inherent limits. Out of an analysis of the more relevant EU jurisprudence, the author identifies the rationale underlying the interventions of the ECJ on issues of procedural autonomy and the common logic that emerges from it, and reveals how, in an unchanged context of `procedural autonomy` of the Member States, national procedural law becomes more and more `functionalized` to the requirements of effectiveness of substantive EU law. As such, we should speak of a `functionalized procedural competence` rather than of procedural autonomy. But this is by no means a case of "Paradise Lost." The book includes a foreword by Prof. Jürgen Schwarze, one of the founding fathers of European Administrative Law.     Main description: Dass das Recht ohne Sprache und die Arbeit mit und an Sprache nicht gedacht werden kann, zeigt die Fülle sprachtheoretischer (und hier vor allem semantischer) Überlegungen in der juristischen Interpretationstheorie und Methodenlehre. Gesetzesauslegung und -anwendung ist so immer zugleich eine semantische Tätigkeit. Nicht alle der in juristischen Arbeiten diskutierten sprach- und bedeutungstheoretischen Annahmen entsprechen jedoch dem Stand der modernen Sprachwissenschaft. Auch folgt ihre Rezeption anscheinend den vorgegebenen Konfliktlinien juristischer Methodenschulen ("subjektive" oder "objektive" Lehre; Auslegung oder Analogie; Rechtsanwendung oder Rechtsfortbildung; Präzisionsideale der Logischen Semantik oder Freiheiten der Hermeneutik usw.). Nur selten bewirkt die Aufnahme sprachtheoretischer Annahmen eine Infragestellung liebgewordener rechtstheoretischer Grundpositionen selbst. Das Buch soll durch die aus der Sicht eines Sprachwissenschaftlers vorgenommene Bestandsaufnahme, Analyse und Kritik der juristischen Semantik und Sprachtheorie einen Überblick über die Diskussionslage geben und zugleich Auswege aus scheinbaren Dilemmata des juristischen Methodenstreits aufzeigen.

    Through an examination of six plays by Shakespeare, the author presents an innovative analysis of political developments in the last decade of Elizabethan rule and their representation in poetic drama of the period. The playhouses of London in the 1590s provided a distinctive forum for discourse and dissemination of nascent political ideas. Shakespeare exploited the unique capacity of theatre to humanise contemporary debate concerning the powers of the crown and the extent to which these were limited by law. The autonomous subject of law is represented in the plays considered here as a sentient political being whose natural rights and liberties found an analogue in the narratives of common law, as recorded in juristic texts and law reports of the early modern era. Each chapter reflects a particular aspect of constitutional development in the late-Elizabethan state. These include abuse of the royal prerogative by the crown and its agents; the emergence of a politicised middle class citizenry, empowered by the ascendancy of contract law; the limitations imposed by the courts on the lawful extent of divinely ordained kingship; the natural and rational authority of unwritten lex terrae; the poetic imagination of the judiciary and its role in shaping the constitution; and the fusion of temporal and spiritual jurisdiction in the person of the monarch. The book advances original insights into the complex and agonistic relationship between theatre, politics, and law. The plays discussed offer persuasive images both of the crown's absolutist tendencies and of alternative polities predicated upon classical and humanist principles of justice, equity, and community. 'It is now canon in progressive U.S. legal scholarship that to focus solely on the text of our Constitution is myopic. We look as well for 'constitutional moments', moments when the zeitgeist is so transformed that our fundamental legal charter changes with it. In this breathtakingly erudite book, Paul Raffield argues that the late-Elizabethan period was such a 'constitutional moment' in England, a moment literally 'played out' for the polity by the greatest dramatist of all time. A lawyer and a thespian, Raffield handles both legal and literary sources with exquisite care.
