    Jahrzehntelang arbeitete Philipp Lotmar immer wieder am Thema des Irrtums. In einem monumentalen Werk untersuchte er den Error in den unzähligen römischen Quellen in jedem Bereich des Rechts in und außerhalb des Corpus Iuris Civilis, vor allem, um eine breite Basis für seine Kritik an Karl Friedrich von Savignys tonangebender Irrtumslehre im Vertragsrecht zu schaffen. Lotmar konnte aber das Werk, das er für seine romanistische Hauptleistung hielt, nicht mehr vollenden und kam auch nicht mehr zur Publikation des ersten, fast fertigen Bandes. Der gesamte erste Band und die Einleitung zum zweiten Band, also die Teile des Werks, die Lotmar in eine publikationsfähige Form auszuarbeiten schaffte, wird nun der Öffentlichkeit übergeben. Auf diese Weise wird das wissenschaftliche Werk eines prägenden Zivilrechtslehrers, der heute außerhalb der Romanistik in erster Linie als Schöpfer des modernen Arbeitsrechts wahrgenommen wird, nun auch auf dessen angestammtem Forschungsgebiet, dem römischen Recht und der allgemeinen Privatrechtsdogmatik, fast hundert Jahre nach seinem Tod zugänglich. For decades, Philipp Lotmar has repeatedly and insistently focussed on the subject of error. In a monumental work, Lotmar set out to examine the countless relevant Roman sources in every area of law inside as well as outside the Corpus Juris Civilis, thus providing the material basis for his criticism of Karl Friedrich von Savigny's leading doctrine of errors in contract law. However, Lotmar could not complete the work he considered the crowning achievement of his research in the field of Roman law, nor did he succeed in publishing the first, almost finished volume. The entire first volume and the introduction to the second volume, i.e. those parts of the intended opus which Lotmar left behind in a form already fit for publication, will now be presented to the public. In this way, the scientific work of a formative civil law teacher, who today is perceived primarily as the creator of modern labor law, is thus finally being made available in his proper field of research, i.e. Roman law and general private law dogmatics, almost a hundred years after his death.

    Today’s critical discourses and theorizing vanguards agree on the importance of getting lost, of failure, of erring — as do life coaches and business gurus. The taste for a departure from progress and other teleologies, the fascination with disorder, unfocused modes of attention, or improvisational performances cut across wide swaths of scholarly and activist discourses, practices in the arts, but also in business, warfare, and politics. Yet often the laudible failures are only those that are redeemed by subsequent successes. What could it mean to think errancy beyond such restrictions? And what would a radical critique of productivity, success, and fixed determination look like that doesn’t collapse into the infamous ‘I would prefer not to’? This volume looks for an answer in the complicated word field branching and stretching from the Latin errāre. Its contributions explore the implications of embracing error, randomness, failure, non-teleological temporalities across different disciplines, discourses, and practices, with critical attention to the ambivalences such an impossible embrace generates.
