    Die Abfallentsorgung ist zu einem der zentralsten Probleme der modernen Industriegesellschaft geworden. Eine Reform des bestehenden Abfallrechts soll dieses Problem bewältigen helfen. Die hier vorliegende interdisziplinäre Untersuchung beschäftigt sich hauptsächlich mit der Frage, ob die Vorrangklausel des geltenden Bundesabfallgesetzes als taugliche Grundlage für die Bewältigung des Abfallproblemes gelten kann. Dazu wird derGesetzestext einer umfassenden juristischen Interpretation unterzogen; es findet eine realitätsnahe Analyse der relevanten technischen, volks- und betriebswirtschaftlichen Aspekte statt. Die im Abfallgesetz enthaltene Vorrangklausel der Abfallverwertung stellt danach bei korrekter Auslegung der Merkmale "technisch möglich", "Mehrkosten", "Zumutbarkeit", "Vorhandensein oder Schaffung eines Marktes" einen ausgewogenen Kompromiß zwischen ökonomischen und ökologischen Sachzwängen dar. Für aktuelle Reformüberlegungen, namentlich auch für den kürzlich vorgelegten Referentenentwurf des Umweltministeriums, gilt diesbezüglich vor dem Hintergrund: "If it is not necessary to change the law, it is necessary not to change" (so das Fazit in Anlehnung an die englische Gesetzgebungstradition)

    Biographical note: Der Autor ist Professor an der Ludwig-Maximilians-Universität München und geschäftsführender Vorstand des Instituts für Handels-, Wirtschafts- und Arbeitsrecht. Erweiterte Fassung eines Vortrages, gehalten vor der Juristischen Gesellschaft zu Berlin am 21. Juni 2000. Die Veröffentlichung behandelt einen bislang in seiner Bedeutung vielfach unterschätzten Gedanken der Privatautonomie und versucht, mit Hilfe des Funktionsgedankens einige Phänomene zu erklären, die bislang nicht überzeugend eingeordnet werden konnten. Am Beispiel des Gesellschaftsrechts wird die Bedeutung von Funktionsbedingungen privatrechtlicher Subsysteme untersucht und geprüft, inwieweit und auf welche Weise das Recht auf Störungen der Funktionsbedingungen reagiert. Behandelt werden exemplarisch die Kernbereichslehre, das Mehrheitsprinzip, die eigenkapitalersetzenden Gesellschafterdarlehen.
