    For years, businesses have complained about the costs of regulatory compliance. On the other hand, society is becoming increasingly aware of the environmental, safety, health, financial, and other risks of business activity. Government oversight seems to be one of the answers to safeguard against these risks. But how can we deregulate and regulate without jeopardizing our public goals or acting as a brake on economic growth? Many instruments are available to assess the effects of laws regulating business, including the regulatory impact assessment (RIA), which contains cost/benefit analysis, cost-effectiveness analysis, risk analysis, and cost assessments. This book argues that public goals will be achieved more effectively if compliance costs of the enterprises are as low as possible. Highlighting examples from a wide spectrum of industries and countries, the authors propose a new kind of RIA, the business impact assessment (BIA), designed to improve both business and public policy decision making.

    Die Abfallentsorgung ist zu einem der zentralsten Probleme der modernen Industriegesellschaft geworden. Eine Reform des bestehenden Abfallrechts soll dieses Problem bewältigen helfen. Die hier vorliegende interdisziplinäre Untersuchung beschäftigt sich hauptsächlich mit der Frage, ob die Vorrangklausel des geltenden Bundesabfallgesetzes als taugliche Grundlage für die Bewältigung des Abfallproblemes gelten kann. Dazu wird derGesetzestext einer umfassenden juristischen Interpretation unterzogen; es findet eine realitätsnahe Analyse der relevanten technischen, volks- und betriebswirtschaftlichen Aspekte statt. Die im Abfallgesetz enthaltene Vorrangklausel der Abfallverwertung stellt danach bei korrekter Auslegung der Merkmale "technisch möglich", "Mehrkosten", "Zumutbarkeit", "Vorhandensein oder Schaffung eines Marktes" einen ausgewogenen Kompromiß zwischen ökonomischen und ökologischen Sachzwängen dar. Für aktuelle Reformüberlegungen, namentlich auch für den kürzlich vorgelegten Referentenentwurf des Umweltministeriums, gilt diesbezüglich vor dem Hintergrund: "If it is not necessary to change the law, it is necessary not to change" (so das Fazit in Anlehnung an die englische Gesetzgebungstradition)

    Hauptbeschreibung Kai Schollendorf untersucht, mit Hilfe welcher Methoden das höchste "Schiedsgericht" der Welthandelsorganisation (WTO) völkerrechtliche Verträge auslegt. Im ersten Teill stellt er zunächst die in Wissenschaft und völkerrechtlicher Praxis entwickelten Methoden der Vertragsauslegung dar. Anschließend weist er nach, daß diese Methoden, die Eingang in Art. 31 und 32 der Wiener Vertragsrechtskonvention gefunden haben, zum Bestand des Völkergewohnheitsrechts zählen. Im zweiten Teil beschreibt der Autor zunächst das organisatorische Gefüge der WTO sowie die unter deren Dach zusammengefaßten materiellen Regeln des Welthandelsrechts. Anschließend stellt er den Streitbeilegungsmechanismus der WTO dar, an dessen Spitze die Berufungsinstanz, der Appellate Body, steht. Eine der zentralen Aufgaben dieses Gremiums ist es, auf eine einheitliche Auslegung der WTO-Verträge hinzuwirken. Die Besonderheit, daß dieser Spruchkörper deutlich mehr Fälle zu entscheiden hat, als alle anderen weltweit agierenden Gerichte, prädestiniert ihn zum Gegenstand der vorliegenden wissenschaftlichen Untersuchung. Im dritten, zentralen Teil der Arbeit untersucht Kai Schollendorf anhand der seit 1995 ergangenen Schiedssprüche des Appellate Body, wie dieses Gremium die existierenden Auslegungsmethoden aufgreift und anwendet.
