    We study the question whether a holder of standard essential patents (SEPs) should be allowed to choose the level in the value chain at which to offer a FRAND license to its SEPs. We give a pos-itive answer to this question for two reasons. First, the SEP holder and the social planner tend to choose the licensing level that, other things being equal, minimizes transaction costs. Second, the SEP holder maximizes total output, which is often aligned with social welfare maximization by the planner. These two factors make it likely that the SEP holder chooses the efficient level of SET licensing.

    This study aims to examine the impact of infrastructure on firm performance in nine CAREC countries: Afghanistan, Azerbaijan, Georgia, Kazakhstan, the Kyrgyz Republic, Mongolia, Pakistan, Tajikistan, and Uzbekistan. Empirical analysis is based on the enterprise survey for 2009, 2013, and 2019. Infrastructure is measured by the duration of power outages, electricity expenses as the share of total sales, access to broadband internet and efficiency of customs. Firm performance was measured by total sales, share of utilized capacity, dummy variable if firm exports, and the share of export sales. Results indicate that firm performance measured through sales and capacity utilization is negatively affected by the duration of power outages and electricity expenses. Moreover, access to broadband internet significantly increases the total sales and export sales of small firms, while efficiency of customs increases the exporting activities of medium and large firms. These findings underline that for the development of private sector and international trade in CAREC countries, sustainable access to, and quality of, electricity, telecommunications, and customs efficiency are important objectives for government policy.

    This paper analyses interconnection in telecommunications markets in the Southern African Development Community (SADC) region, focusing on cross-border roaming as well as international interconnection. These issues have been identified as critical for cross-border integration and regulatory alignment. The paper argues for a greater alignment of regulatory approaches across the SADC region to promote competition, lower prices, and innovation. This is done by investigating the regional experience in terms of the cross-country integration of telecommunications markets through international calls and roaming services. The investigation and analysis find that there are currently low levels of alignment in regulation between SADC member states thanks to varying national policies across various countries. In addition, information regarding operator costs is asymmetric, making regulation challenging, as this affects the extent to which the relationship between costs and retail prices can be observed and regulated. Direct consultation between the SACD, regulators, competition agencies, and other stakeholders is recommended in order to address these issues. Another important finding is that advances in technology have meant significant increases in demand for broadband and data services, resulting in a surge in demand for over-the-top services. Attention therefore needs to be paid to the harmonization of regulation regarding Internet-related services. Here, fixed services can play a valuable role in providing high speeds and high volumes of data at a lower cost, which is important considering the difficulties that landlocked SADC countries face in providing low-cost Internet services.

    The size of the digital sector is significant and comprises various activities, processes and industries. The interdependence of different markets within and across segments of the digital value chain implies that barriers to entry and expansion in one industry can have far reaching effects on the growth of the rest of the digital sector and the economy, more widely. Ensuring robust competition across the digital value chain is therefore of paramount importance. Internet connectivity is the most critical element of the value chain as it links the various participants in the digital sector to the final users or consumers. It is also the segment that has highest barriers to entry. Although natural barriers exist, regulatory and strategic barriers further constrain competition. Thus, access regulations will need to be strengthened and enforced. An open access framework and increased transparency will facilitate the growth of broadband. Adapting M&A guidelines, effective cross-sectoral regulatory cooperation, and investment in training will also reduce barriers to entry and expansion. Partnerships between the private and public sectors will be necessary as well to significantly reduce the digital divide in the country. The telecommunications industry has been dominated by two vertically integrated firms, which are also expanding their service portfolios to other segments. While vertical integration along the digital value chain could create efficiencies, significant market power could also enable anti-competitive conduct and limit innovation. In the digital age, competitive pressures must be built into the entire value chain by lowering barriers to entry and expansion, removing bottlenecks to innovation, and reducing switching costs. Further analysis of particular segments or specific bottlenecks and anti-competitive practices will be useful in crafting appropriate regulatory approaches.

    Across different metrics, the ICT performance of the Philippines remains subpar compared to ASEAN members and other countries at the same level of development. The quality of the country's ICT regulatory environment, composed of regulatory authority, regulatory mandate, regulatory regime, and competition model, is significantly below what is considered international best practice, consequently impeding the use of various technological solutions available to bridge the gap in digital inequality. Although significant policy changes have recently been introduced, more reforms are needed to achieve inclusive and accelerated digital connectivity. Priorities include reforming the licensing regime, formulating a spectrum policy and plan, and reinventing the NTC to ensure regulatory independence.
