    Dieser Band schließt die Lücke zwischen Normen, rechtswissenschaftlichen Auslegungen und konsensfähigen humanwissenschaftlichen empirischen Ergebnissen zur Konkretisierung des unbestimmten Rechtsbegriffs Kindeswohl. Die rechtlichen Grundlagen und die zu beachtenden Urteile der höchsten Gerichte zum Kindeswohl stellt der erste Teil des Buches dar; sie sind das Gerüst für den zweiten Teil, der die humanwissenschaftlichen übereinstimmenden empirischen Fakten präsentiert. Die Humanwissenschaften liefern hier ein zu den rechtlichen Entscheidungskriterien korrespondierendes Wertesystem und damit einen Maßstab, das Kindeswohl im Einzelfall zu beurteilen und die Entscheidungsfindung auf eine faktenbasierte Grundlage zu stellen. Dieser interdisziplinäre Ansatz einer humanwissenschaftlichen Kommentierung der rechtlichen Kindeswohlkriterien kann Familienrichtern, Sachverständigen und beruflich involvierten Personen als Arbeitshilfe zur Verfügung gestellt werden.

    Can a policy intervention in the stressful first year after a birth affect marital stability? We examine this question using a large expansion in maternity benefits in 1982 in the Baltic countries of Estonia, Latvia and Lithuania. The program provided partially paid leave until the child's first birthday and included a small cash payment at birth. We use individual-level panel data and compare the Baltics with similar East European countries using a difference-indifferences framework. Maternity benefits decrease divorce within the first year after birth. This decrease persists for at least a decade, indicating that couples avoided divorce altogether rather than simply delaying it. While mothers extended their leave by several months, they returned to full-time work afterwards, consistent with egalitarian gender norms in the labor market.

    We estimate the effect of parental separation on the risk and trust attitudes of German adolescents using a large household survey dataset, which allows us to match respondents to their siblings and parents. Our results indicate that adolescents from separated families are less trusting but have the same risk tolerance as adolescents from non-separated families, even after conditioning on the attitudes of parents and other controls. This trust deficit persists into early adulthood. Moreover, for both trust and risk, we find that separation attenuates the transmission of preferences from father to child. Additional analyses point to reduced parental involvement and greater family conflict as potential mechanisms.

    We test whether households that face prospective home equity losses during a house price downturn use divorce to shed debt. We study the Dutch context, where qualifying homeowners can buy into a mortgage guarantee scheme that insures the lender against borrower default and transfers the risk to the public. Divorce is one of the major events that obliges the guarantor to repay outstanding residual debt after (foreclosure) sale. We argue in this paper that divorce is endogenous to holding underwater mortgages, and hence constitutes a choice that can be used for strategic use of the insurance. Using administrative data, we find a significant, 44% increase in the probability to divorce for households with an underwater mortgage. This effect is causal to being insured. The identification relies on a regression discontinuity design, that exploits the fact that the insurance is only available for properties with values below a legislated qualification threshold. The house price crisis (2008-2013) provides an unexpected shock to house values, leaving about 40% of owners with an underwater mortgage. Their home equity averages to about €-50.000. Couples with similar characteristics just above the qualification threshold experienced significantly less often a divorce than couples just below the threshold. We interpret this behavioral response as moral hazard, also because the induced divorcees reunite at a higher rate than other divorcees.

    Many countries have enacted legislation over the past few decades making divorce easier. Some countries have legalized divorce where it had previously been banned, and many have eased the conditions required for a divorce, such as allowing unilateral divorce (both spouses do not have to agree on the divorce). Divorce laws can regulate the grounds for divorce, division of property, child custody, and child support or maintenance payments. Reforms can have a range of social effects beyond increasing the divorce rate. They can influence female labor supply, marriage and fertility rates, child well-being, household saving, and even domestic violence and crime.

    Policies that extend the school day in elementary school provide an implicit childcare subsidy for families. As such, they can affect parents' time allocation and family dynamics. This paper examines how extending the school day affects families by focusing on marriage dissolution. We exploit the staggered adoption of a policy that extended the availability of full-time elementary schools across different municipalities in Mexico. Using administrative data on divorces, we find that the extension in the school day by 3.5 hours leads to a significant increase in divorce rates. Moreover, the effect grows with every year of municipalities' exposure to full-time schooling. Increased female employment due to the availability of childcare is likely to be one of the mechanisms that relaxed restrictions to marriage dissolution.

    Social norms can mitigate the effectiveness of formal institutions, in particular the way legal reforms may affect women's autonomy. We examine this question in the context of ethnic variation in traditional post-marital cohabitation, i.e. matrilocality versus patrilocality. We use within-country variation in ethnic kinship practices in Indonesia, exploiting a major legal reform that exogenously fostered women's access to justice and their ability to divorce. We theoretically establish that compared to women of patrilocal tradition, matrilocal women should divorce relatively more after the reform and, for those in stable marriages, experience a relative increase in empowerment. We test these predictions using double-difference estimations with fixed effects. We confirm the relative increase in divorce among matrilocal women and, for those who stay married, a relative improvement in a wide range of outcomes for them and their children. We also predict higher benefits for matrilocal women experiencing a larger drop in divorce costs, which we test with triple-difference estimations exploiting the distance to courthouses. Our results encourage tailored policies that may transcend cultural contexts and overcome the adherence to informal laws.
