The central aim of the volume is to recover this historical dimension, with particular reference to the so-called Major Declamations, a collection wrongly attributed to Quintilian, and now generally thought to be the work of several authors of the second and third centuries AD. Accordingly, many of the twenty studies collected here seek to anchor the Maiores to their period, exploring their chronology and authorship; their relationship to rhetorical education, Greek declamation, and philosophy; their depiction of earlier history; and their reflection of contemporary socio-cultural trends. Other essays concern their connection with legal theory and practice, and the relationship between juridical and declamatory language, real and fictitious court cases. A final set of studies focuses on the period when the collection was assembled (fourth century AD), reconstructing the late-antique forebear of all the extant manuscripts, speculating on the criteria which may have governed the selection of the pieces. The medieval reception of the Maiores is also investigated

    Scholars have read Tertullian of Carthage, especially his obsessions with Roman officials and juridical procedures, as a window into early Christian martyrological discourses and the concerns of real Christian communities. Conversely, this article argues that Tertullian is better understood as an unexceptional part of a larger cultural phenomenon of fantasies of Roman power and juridical scenes. The Roman Empire took hold in the minds of its provincial subjects through its curious combination of symbolic presence and concrete administrative absence. Various geographic and genre-specific examples suggest a prevalence of fantasy life around certain articulations of Roman power, as colonial subjects tried to make sense of intensified social change. Juridical scenes in particular promised truth, resolution, and clarity where there was little to be found. This article situates Tertullian within such social ambiguities, ones that defined life in Roman Carthage, and demonstrates that Tertullian's stark renditions of Roman authorities in confrontation with Christians are largely fabricated from literary sources. This context and Tertullian's writings paint a historical picture of the emergence of the term "Christian" (as epithet and then self-identification) as simply one concentrated instance of such fantasies and juridical attachments.

Der Autor beleuchtet Motiv und Inhalt der Instruktion und bedenkt die juristische Natur und den Status der Instruktion, besonders die Approbation in Forma specifica. Dabei betont er die Inkonsequenz der Form Instruktion im Hinblick auf die Gültigkeit für die Kirche. Der Autor unterstreicht den Dualismus von spirituellen und Laiendiensten, die Einheit des Weihesakraments.     ‘The Territorialities of U.S. Imperialism(s)’ sets into relation U.S. imperial and Indigenous conceptions of territoriality as articulated in U.S. legal texts and Indigenous life writing in the 19th century. It analyzes the ways in which U.S. legal texts as “legal fictions” narratively press to affirm the United States’ territorial sovereignty and coherence in spite of its reliance on a variety of imperial practices that flexibly disconnect and (re)connect U.S. sovereignty, jurisdiction and territory. At the same time, the book acknowledges Indigenous life writing as legal texts in their own right and with full juridical force, which aim to highlight the heterogeneity of U.S. national territory both from their individual perspectives and in conversation with these legal fictions. Through this, the book’s analysis contributes to a more nuanced understanding of the coloniality of U.S. legal fictions, while highlighting territoriality as a key concept in the fashioning of the narrative of U.S. imperialism.

    In exploring the constituent elements of our modern-day nation state, this contribution wishes to highlight those areas in which anachronism might arise in Old Testament interpretations of ‘state’. This might happen due to the influence of deeply-rooted modern-day conceptions, according to which a state consists of a people group living within a distinct territory, governed by a body holding jurisdiction over both people and territory. This contribution explores pre-exilic, exilic, and post-exilic biblical texts containing the elements of people, land, and king, asking whether these texts wish to convey a political or rather a theological message.
