This gospel for interpretation is often the starting-point of judgments in the WTO. Its use in the WTO became established with the Appellate Body (AB) decision in the US-Gasoline case wherein it was pointed out that the general rule of interpretation set out in Article 31 of the VC had attained the status of a rule of customary or general international law. As such, it forms part of the 'customary rules of interpretation of public international law' which the Appellate Body has been directed, by Article 3(2) of the DSU [Understanding on Rules and Procedures Governing the Settlement of Disputes], to apply in seeking to clarify the provisions of the General Agreement and the other 'covered agreements' of the Marrakesh Agreement Establishing the World Trade Organization .... That direction reflects a measure of recognition that the General Agreement is not to be read in clinical isolation from public international law. Am Beispiel der Parlamentarischen Versammlung des Europarates untersucht die Studie Motivation und parlamentarisches Verhalten nationaler Parlamentarier aus 47 Mitgliedstaaten anhand von drei eigenen Datenerhebungen – Interviews, Online-Umfrage und Dokumentenanalyse. Due to the increasing shift in political decision-making from national parliaments to international organisations, the rise of international government is often assumed to be accompanied by the decline of national parliaments. As a reaction, several international organisations have established transnational parliamentary assemblies to increase parliamentarians’ participation in international negotiations. But their dual mandate reveals some contradictions: Why would national parliamentarians take on an additional time-consuming subsidiary job despite its low public and media attention and without any financial compensation? This study focuses on the motivation and parliamentary behaviour of national representatives from the 47 member states in the Parliamentary Assembly of the Council of Europe by evaluating three original data collections: interviews, an online survey and an analysis of plenary protocols.

    "The jurisprudence of the World Trade Organization (WTO) is replete with references to Articles 31-2 of the Vienna Convention (VC) on the Law of Treaties. This gospel for interpretation is often the starting-point of judgments in the WTO. Its use in the WTO became established with the Appellate Body (AB) decision in the US-Gasoline case wherein it was pointed out that the general rule of interpretation set out in Article 31 of the VC had attained the status of a rule of customary or general international law. The interpretative process involved in this jurisprudence constitutes a form of legislative activity, and is therefore of great significance not only to the parties to disputes, but to the membership of the WTO.
