The New York Convention is universally known as one of the most important instruments on international commercial arbitration. It owes much of its success to being an international treaty which sets forth uniform rules. The Convention’s uniform enforcement regime not only lowers the parties’ transaction costs of identifying under which circumstances an award will be recognized and enforced across jurisdictions. It also ensures that States cannot simply justify the failure to comply with their obligations under the Convention on the basis of domestic law ... (taken from the praface)

Bringing together articles by some of the leading policy-makers, including previous WTO Director-Generals, practitioners, scholars of international trade law, government officials, international civil servants, members of the WTO Appellate Body, and judges from a number of international tribunals, this volume assesses the first ten years of the World Trade Organization. It examines: the relationship and balance between political governance and dispute settlement; the functioning of the dispute settlement procedures and various reform proposals; the contribution of the Appellate Body to the development of international trade law; and treaty interpretation in a number of international dispute settlement fora such as the WTO, the International Court of Justice, the European Court of Justice, and the Tribunal for the Law of the Sea. The book has its origins in a series of events commemorating the tenth anniversary of the creation of the Appellate Body.

Whether arbitration is only as good as the arbitrator is a question that has often been asked. Indeed, an arbitration procedure can be a quick and efficient means of dispute resolution that can save parties a lot of money compared to a court procedure. However, arbitral awards, unlike court judgements, are not subject to ordinary judicial remedies and there is no recourse available against an award which is substantially wrong. Therefore, anyone interested in international arbitration, whether experienced arbitrator or in-house counsel working with contracts and arbitration clauses, should read this compilation of expert views on thorny issues like: Clashes between arbitrator and litigants; Arbitral discrimination under English and EU law; The arbitrator's relation with third parties; Confidentiality issues; Rules of law vs. freedom of the arbitrator. Invaluable companion for practitioners and scholars alike, this publication looks at the relationship between the qualities of the arbitrators and the arbitrators' "work-products", namely the award and the arbitral process itself.--Publisher description
