    In an increasing number of sectors, concerns are rising that foreign firm participation may pose risks to public order. Many developed countries have adopted or extended their investment screening mechanisms to control inward foreign direct investment in strategically important sectors over the last years. This paper documents the development of investment screening in OECD and EU countries and provides the first discussion from an economic perspective. We review existing and propose new explanations for the adoption of investment screening. Our exploratory quantitative analysis suggests that countries with higher levels of technological development and with a stricter regulatory environment for foreign investment are more likely to introduce investment screening. Contrary to the popular wisdom, we do not find evidence that higher Chinese inward investments are associated with the implementation of investment screening.

    While many countries have become ever more open and welcoming for foreign investment, the awareness of risks for national security stemming from or related to international investment has increased. Many governments have thus introduced policies that seek to protect their national security with the smallest possible impact on investment flows. Guidelines for recipient country investment policies relating to national security adopted at the OECD in 2009 provide recommendations for the design and implementation of such policies. This paper reviews commonalities and differences of policies implemented in 54 countries with a special focus on arrangements in 17 economies that have explicit policies in this area. It offers a comparative analysis of countries’ investment policy approaches to address national security concerns stemming from foreign investment; classifies the different forms of restrictions to address these concerns; identifies differences between restrictions on ownership and acquisitions; and presents how countries define the scope of application of their policies. The study also assesses how countries have implemented some of the key principles set out in the 2009 Guidelines in actual policy in order to meet their need to safeguard national security while reducing the impact of these policies on international investment.

    The author shows that the US as the world's largest investor abroad so far shuns the most dynamic host region East Asia including China and instead continues to focus on investment in Europe. In contrast, Germany follows a different path. Similar to trade, German companies have been very active as investors, especially in China. The author explains the discrepancies in the regional structure of FDI by (1) differences in the sectoral focus: US in services and Germany in manufacturing, (2) differences in the regulatory framework protecting national security in the two home countries: much stronger in the US than in Germany especially against China, and (3) differences in Chinese policy interventions: stronger in services than in manufacturing. It can be expected that rising tensions between China and the US will lead to stronger trends of technological self-reliance on both sides, a higher local content of production and more importance of protecting national security. Against this backdrop, US companies with their low presence in China might face less challenges than German companies which are more subject to path dependency given their high presence in China. Der Autor zeigt, dass die USA als weltgrößter Auslandsinvestor bislang die dynamischste Gastregion Ostasien, insbesondere China, meiden und stattdessen weiterhin auf Investitionen in Europa setzen. Deutschland geht einen anderen Weg. Ähnlich wie im Handel waren deutsche Unternehmen als Investoren vor allem in China sehr aktiv. Der Autor erklärt Unterschiede in der Regionalstruktur der amerikanischen und deutschen Auslandsinvestitionen durch (1) Unterschiede in der sektoralen Ausrichtung - USA im Dienstleistungssektor, Deutschland im Verarbeitenden Gewerbe-, (2) Unterschiede im regulatorischen Rahmen zum Schutz der nationalen Sicherheit in den beiden Herkunftsländern - in den USA viel stärker als in Deutschland, insbesondere gegenüber China - und (3) Unterschiede in den politischen Interventionen Chinas - im Dienstleistungssektor stärker als im Verarbeitenden Gewerbe. Der Autor erwartet, dass zunehmende Spannungen zwischen China und den USA dazu führen, dass beide Seiten die technologische Eigenständigkeit fördern, zunehmende heimischen Wertschöpfungsanteile anstreben und dem Schutz der nationalen Sicherheit hohe Bedeutung beimessen werden. US-amerikanische Unternehmen mit ihrer relativ geringen Präsenz in China könnten sich geringeren Herausforderungen gegenübersehen als deutsche Unternehmen, die aufgrund ihrer starken Präsenz in China eher einer Pfadabhängigkeit ausgesetzt sind.

    Investment Screening Mechanisms (ISM) are legal rules created to control and assess the entry of direct investments from foreign jurisdictions. This discussion paper is premised on the observation of a marked increase in the institutionalization and implementation of ISM in recent years, regardless of the type of domestic economy. It selects fifteen ISM for a descriptive analysis of their organizational structures and procedures, including: Australia, Canada, China, Germany, India, Japan, South Korea, Mexico, Portugal, Russia, South Africa, Spain, the United Kingdom, the United States, and the European Union. Although the criteria for controlling and evaluating foreign investment contains national security as a shared concern, this paper identifies a significant diversity regarding the profile of the institutions responsible for investment screening, including their scope and their procedures for assessment. As a final remark, the paper raised critical concerns about ISM based on its analysis and the literature.

    Kenya’s refugee policy has morphed over time due to factors that include security threats, regional geo-politics and strategic interests. This policy brief addresses the relevance of national and regional geo-strategic interests for refugee policy in Kenya. It provides a historical overview of refugee policy in the country, highlighting the factors that account for policy fluctuations, contradictions and differential treatment of refugees hosted in Kenya, which is one of the pilot countries for the implementation of the Comprehensive Refugee Response Framework (CRRF). For policy-makers seeking to localise international refugee governance frameworks, it is important to situate frameworks such as the CRRF within the relevant national contexts because refugee hosting does not take place in a political vacuum or an ahistorical context (Jaji, 2022). Kenya is an interesting case study because the contradictions in its refugee policy take a bifurcated approach, in which it has approved the implementation of the CRRF’s main objective to promote refugees’ self-reliance in northwestern Kenya, where it hosts the mainly South Sudanese refugees in Kakuma camp and simultaneously put on hold the implementation of the same in the north-east in Dadaab camp, which predominantly hosts Somali refugees. Over the years, the government of Kenya has threatened to close the two camps, the most recent threat being in April 2021, when it announced that it wanted UNHCR to repatriate refugees within 14 days. Although the implementation of KISEDP made closure of Kakuma refugee camp a logical course of action, the non-implementation of GISEDP in Garissa County raised concern in humanitarian circles regarding the fate of Somali refugees if Dadaab camp were to be closed without an integrated settlement similar to Kalobeyei. The geo-political context accounts for the policy discrepancies and ambivalence evident in how the Kenyan government has implemented the CRRF in Turkana County but not in Garissa. The complex relations between Kenya and Somalia are salient for the implementation of the CRRF in Garissa County, where the majority of Somali refugees in Kenya are hosted. Kenya and Somalia are locked in a maritime border dispute, which cannot be overlooked in trying to understand Kenya’s policy towards Somali refugees. The government of Kenya views Somalis as a threat to national security and blames them for the terrorist attacks in the country. Based on an analysis of these factors, we offer the following recommendations: International processes such as the CRRF should be sensitive to the security and geo-political interests of host countries. Security issues between Kenya and Somalia have a uniquely negative impact on Somali refugees in Kenya, which makes humanitarian operations harder to implement in Garissa County. UNHCR and its partner organisations and funders should: encourage Kenya to implement GISEDP and provide sustained financial contributions under burden-sharing, which would provide more incentives for Kenya to remain committed to implementing the CRRF. clearly present the economic benefits of implementing the CRRF in terms of promoting self-reliance not only for the refugees, but also for Kenyans in both Turkana and Garissa counties. maintain support for Kenya’s efforts to engender selfreliance for refugees in north-western Kenya and commend the country for implementing the CRRF under KISEDP while also remaining aware of Kenya’s securitisation of Somali refugees in north-eastern Kenya. consider the insights from Kenya in addressing contextual issues in other host countries that have agreed to implement the CRRF.

    Openness to foreign investments is associated with risks. To mitigate these risks, many high-income countries have strengthened the control of foreign investments over the last decade in an increasing number of sectors considered critical. Investment screening distorts the market for cross-border investments in controlled sectors, which might lead to unintended economic effects. This is the first cross-country panel study to examine the economic effects of investment screening mechanisms. We combine deal-level data on cross-border mergers and acquisitions (M&A) for the period 2007-2022 with information on sectoral investment screening. Using a staggered triple difference design, we estimate a reduction of 11.7 to 16.0 percent in the number of M&A in a newly screened sector. The effects are driven by minority acquisitions and deals involving a foreign government or state-owned enterprises or US firms as investors. There is no reduction in the number of deals within the EU/EFTA, most of which are not subject to screening. The findings call policymakers' attention to weighing the benefits of national security and the economic costs of introducing investment screening.
