    "Vision traditionally occupies the height of the sensorial hierarchy. The sense of clarity and purity conveyed by vision, allows it to be explicitly associated with truth and knowledge. The law has always relied on vision and representation, from eye-witnesses to photography, to imagery and emblems. The law and its normative gaze can be understood as that which decrees what is permitted to be and become visible and what is not. Indeed, even if law’s perspectival view is bound to be betrayed by the realities of perception, it is nonetheless productive of real effects on the world. This first title in the interdisciplinary series ‘Law and the Senses’ asks how we can develop new theoretical approaches to law and seeing that go beyond a simple critique of the legal pretension to truth. This volume aims to understand how law might see and unsee, and how in its turn is seen and unseen. It explores devices and practices of visibility, the evolution of iconology and iconography, and the relation between the gaze of the law and the blindness of justice. The contributions, all radically interdisciplinary, are drawn from photography, legal theory, philosophy, and poetry."

    We may consider labour as boon or bane ‒ man’s existence is not conceivable without labour. The expulsion from the Garden of Eden can be understood as a punishment for the consumption of the forbidden fruit from the tree of knowledge, but it can likewise be interpreted as the perfection of God’s creation. Hence only beyond Eden, God’s creature becomes man. He or she becomes human by cultivat-ing the earth, by working. Labour is not only a necessary evil in order to secure existence, nor does it serve as a means for self-preservation, but also for self-fulfillment. Labour is the epitome of the ability of self-being and thus of man’s liberty. Mögen wir Arbeit als Fluch betrachten oder als Segen – das Sein des Menschen ist ohne Arbeit nicht denkbar. Man kann die Vertreibung aus dem Garten Eden als Strafe für den unerlaubten Genuss der Frucht vom Baume der Erkenntnis ver-stehen, man kann sie aber auch als Vollendung der göttlichen Schöpfung deuten. Denn erst jenseits von Eden wird das Geschöpf Gottes Mensch. Er wird Mensch, indem er die Erde bebaut, indem er arbeitet. Arbeit ist nicht nur ein notwendiges Übel zur Sicherung der Existenz, sie dient nicht nur der Selbsterhaltung, sondern auch der Selbstentfaltung. Arbeit ist der Inbegriff des Selbstseinkönnens und damit der Freiheit des Menschen.

    Taste usually occupies the bottom of the sensorial hierarchy, as the quintessentially hedonistic sense, too close to the animal, the elemental and the corporeal, and for this reason disciplined and moralised. At the same time, taste is indissolubly tied to knowledge. To taste is to discriminate, emit judgement, enter an unstable domain of synaesthetic normativity where the certainty of metaphysical categories begins to crumble. This second title in the ‘Law and the Senses’ series explores law using taste as a conceptual and ontological category able to unsettle legal certainties, and a promising tool whereby to investigate the materiality of law’s relation to the world. For what else is law’s reduction of the world into legal categories, if not law’s ingesting the world by tasting it, and emitting moral and legal judgements accordingly? Through various topics including coffee, wine, craft cider and Japanese knotweed, this volume explores the normativities that shape the way taste is felt and categorised, within and beyond subjective, phenomenological and human dimensions. The result is an original interdisciplinary volume – complete with seven speculative ‘recipes’ – dedicated to a rarely explored intersection, with contributions from artists, legal academics, philosophers, anthropologists and sociologists.

    At the heart of this book are some trials conducted in Athens in the fourth century BCE. In each case, the charges involved a combination of supernatural activities, including potion-brewing and cult activity; the defendants were all women. Because of the brevity of the ancient sources, and their lack of agreement, the precise charges are unclear; the reasons for taking these women to court, even condemning some of them to die, remain mysterious. This book takes the complexity and confusion of the evidence not as a riddle to be solved, but as revealing multiple social dynamics. It explores the changing factors—material, ideological, and psychological—that may have provoked these events. It focuses in particular on the dual role of envy (phthonos) and gossip as processes by which communities identified people and activities that were dangerous, and examines how and why those local, even individual, dynamics may have come to shape official civic decisions during a time of perceived hardship. At first sight so puzzling, these trials come to provide a vivid glimpse of the sociopolitical environment of Athens during the early to mid-fourth century BCE, including responses to changes in women’s status and behaviour, and attitudes to particular supernatural/religious activities within the city. This study reveals some of the characters, events, and local social processes that shaped an emergent concept of magic: it suggests that the legal boundary of acceptable behaviour was shifting, not only within the legal arena, but also with the active involvement of society beyond the courts.

To manifest itself, touch makes a movement outwards, beyond the body, and relies on a specific physical involvement other senses do not require: to touch is already to be active and to activate. This fundamental ontology makes touch the most essential of all senses. This volume in the Law and the Senses series attempts to illuminate and reconsider the complex and interflowing relations and contradictions between the tactful intrusion of the law and the untactful movement of touch. Compelling contributors from arts, literature and social science disciplines alongside artist presentations explore touch’s boundaries and formal and informal ‘laws’ of the senses. Each contribution unveils a multi-faceted new dimension to the force of touch, its ability to form, deform and reform what it touches.     Traditionally, the Netherlands has enjoyed being a test market for many ideas in the media. But over the last decade, progress has been severely hampered by lengthy discussions on the future structure of just one sector of media, namely public broadcasting via radio and television. The narrow approach results in a lot of paper, speeches and theories, but little in the way of definitive policy making. In a report to the government, published in February 2005, the Scientific Council for Government Policy (WRR) argued for very different approaches to policy making. The recommendations are not only much broader than "broadcasting"; they tackle the challenges of making robust policy from new angles. Instead of trying to repair the old compass, the approach has been to find new instruments to help policymakers navigate the stormy and often confusing waters ahead. Perhaps the problem in the Netherlands is not accepting the new media, but rather accepting that the role "old" media has undergone a paradigm shift. Since the bulk of the WRR findings were published in the Dutch language, this summary is intended to provide readers outside the Netherlands with an insight into the issues at stake - and the solutions suggested by the WRR.     It is a medieval truism that the poet meddles with words, the lawyer with the world. But are the poet’s words and the lawyer’s world really so far apart? To what extent does the art of making poems share in the craft of making laws, and vice versa? Framed by such questions, Piers Plowman and the Reinvention of Church Law in the Late Middle Ages examines the mutually productive interaction between literary and legal "makyngs" in England’s great Middle English poem by William Langland. Focusing on Piers Plowman’s preoccupation with wrongdoing in the B and C versions, Arvind Thomas examines the versions’ representations of trials, confessions, restitutions, penalties, and pardons. Thomas explores how the "literary" informs and transforms the "legal" until they finally cannot be separated. Thomas shows how the poem’s narrative voice, metaphor, syntax and style not only reflect but also act upon properties of canon law, such as penitential procedures and authoritative maxims. Langland’s mobilization of juridical concepts, Thomas insists, not only engenders a poetics informed by canonist thought but also expresses an alternative vision of canon law from that proposed by medieval jurists and today’s medievalists

    Corporate Romanticism offers an alternative history of the connections between modernity, individualism, and the novel. In early nineteenth-century England, two developments—the rise of corporate persons and the expanded scale of industrial action—undermined the basic assumption underpinning both liberalism and the law: that individual human persons can be meaningfully correlated with specific actions and particular effects. Reading works by Godwin, Austen, Hogg, Mary Shelley, and Dickens alongside a wide-ranging set of debates in nineteenth-century law and Romantic politics and aesthetics, Daniel Stout argues that the novel, a literary form long understood as a reflection of individualism’s ideological ascent, in fact registered the fragile fictionality of accountable individuals in a period defined by corporate actors and expansively entangled fields of action.Examining how liberalism, the law, and the novel all wrestled with the moral implications of a highly collectivized and densely packed modernity, Corporate Romanticism reconfigures our sense of the nineteenth century and its novels, arguing that we see in them not simply the apotheosis of laissez-fair individualism but the first chapter of a crucial and distinctly modern problem about how to fit the individualist and humanist terms of justice onto a world in which the most consequential agents are no longer persons

    At the zone of intersection between imagery, law, and the economy, the defamatory image is charged with a particularly explosive significance. While a "pedagogy of shame" was used in the Late Middle Ages in order to punish debtors and other violators of contracts, the defamatory image remains to this day a vehicle for the moral denunciation and pejorative depiction of individuals who have violated the law. The contributions in this volume discuss the "magical force" exerted by defamatory imagery as well as the role of public humiliation in legal practice, including the "pittura infamante" and the general use of imagery in law Im Grenzbereich von Bild, Recht und Ökonomie erhalten Bilder der Infamie und Diffamierung eine brisante Bedeutung. Wo im Spätmittelalter über eine Pädagogik der Scham die Schuldner bestraft werden sollten, um dem Schuld- und Vertragsrecht Beihilfe zu geben, stellen Schandbilder bis heute ein Mittel der moralischen Verurteilung und der diffamierenden Darstellung rechtswidrig handelnder Personen dar.     In Zeiten der Globalisierung und der Entgrenzung und Infragestellung staatlicher Souveränität erhält die Frage nach der Legitimität des Staates besondere Brisanz. Wenn Macht durch das Konzept der Legitimität in gerechtfertigte Herrschaft überführt werden soll, bedarf die Legitimität als solche genauer Betrachtung. Dabei ist nicht nur zu fragen, worauf die Anerkennung einer Rechtsordnung beruht, sondern auch, wie ihre Anerkennungswürdigkeit begründet werden kann. Die Vielschichtigkeit des Legitimitätsbegriffs legt es dabei nahe, ihn aus unterschiedlichen Perspektiven zu betrachten und diese Perspektiven zu einem möglichst umfassenden Gesamtbild zusammenzufügen. Das Spektrum der an diesem Band beteiligten Disziplinen umfasst die Ethnologie, die Psychologie, die Rechtswissenschaft, die Staatstheorie, die Politikwissenschaft und die Philosophie. Er gliedert sich in folgende thematische Blöcke: Empirische Zugänge, Sozialwissenschaftliche Zugänge, Theoretische Zugänge und Entwicklungsfragen. Mit Beiträgen von Hermann Amborn, Eva Birkenstock, Sergio Dellavalle, Andreas Funke, Andreas Glöckner, Tobias Herbst, Ulf Kemper, Lando Kirchmair, Anna Katharina Mangold, Andreas Niederberger, Utz Schliesky, Peter Seyferth, Rüdiger Voigt, Claudia Wirsing und Sabrina Zucca-Soest In these times of globalisation and the denationalisation and questioning of state sovereignty, the question of the legitimacy of the state has become particularly explosive. If power is to be transformed into justified rule through the concept of legitimacy, legitimacy as such requires close examination. In this context, it is not only necessary to ask what the recognition of a legal system is based on, but also how its recognition can be justified. The complexity of the concept of legitimacy suggests that it should be considered from different perspectives and that these perspectives should be combined to form a comprehensive overall picture. The spectrum of disciplines involved in this volume includes ethnology, psychology, law, state theory, political science and philosophy. Denn für Schleiermacher war nicht die Hermeneutik, sondern die philosophische Ethik die Basis aller Geisteswissenschaften, und diese waren ihm deshalb nicht interpretierende, sondern ethisch-geschichtliche Wissenschaften. Die Hermeneutik aber ist in seinem System ebenso wie Staatslehre, Ästhetik und Religionsphilosophie von jener Ethik abhängig; von einer Ethik, die eine praktische Philosophie im umfassendsten Sinne und eine Theorie der modernen Kultur ist.

    Die jüdische Hermeneutik der Tora wird in dieser Studie mittels der Exegese Benno Jacobs und im Vergleich zur literarkritischen Schule Julius Wellhausens beleuchtet. Beispielhaft wird dies anhand von drei Themenblöcken dargestellt: der Kult als Symbolsprache; die Tora als das "wahre praktische Evangelium"; das Studium der Tora als Offenbarung. Im geoffenbarten Gesetz der Tora sah Jacob die "magna charta für Menschenwürde und Völkerglück". Im jüdischen Schrittum wird dieses Gesetz sehr kreativ und theologisch innovativ ausgelegt. Diese Darstellung der jüdischen Hermeneutik richtet sich sowohl an Alttestamentler als auch an Theologen, die am christlich-jüdischen Dialog interessiert sind

    It is a medieval truism that the poet meddles with words, the lawyer with the world. But are the poet’s words and the lawyer’s world really so far apart? To what extent does the art of making poems share in the craft of making laws, and vice versa? Framed by such questions, Piers Plowman and the Reinvention of Church Law in the Late Middle Ages examines the mutually productive interaction between literary and legal "makyngs" in England’s great Middle English poem by William Langland. Focusing on Piers Plowman’s preoccupation with wrongdoing in the B and C versions, Arvind Thomas examines the versions’ representations of trials, confessions, restitutions, penalties, and pardons. Thomas explores how the "literary" informs and transforms the "legal" until they finally cannot be separated. Thomas shows how the poem’s narrative voice, metaphor, syntax and style not only reflect but also act upon properties of canon law, such as penitential procedures and authoritative maxims. Langland’s mobilization of juridical concepts, Thomas insists, not only engenders a poetics informed by canonist thought but also expresses an alternative vision of canon law from that proposed by medieval jurists and today’s medievalists

Wie wurden rechtliche Verhältnisse kartographiert? Diese zentrale Frage hat eine europäische Perspektive, die uns nach Entwicklungen und Einflüssen fragen lässt. Die Untersuchung gilt einerseits den Objekten der Raumdarstellung – wie Karten, Gemälden und Skizzen – andererseits den mit ihnen sich verbindenden performativen Praktiken. Der Band enthält eine englische Übersetzung der Einleitung und einen Ausblick in die zukünftige Dokumentation von historischen Karten In the pre-modern era, spatial relationships were not only described textually, but also depicted with performative practices.     Corporate Romanticism offers an alternative history of the connections between modernity, individualism, and the novel. In early nineteenth-century England, two developments—the rise of corporate persons and the expanded scale of industrial action—undermined the basic assumption underpinning both liberalism and the law: that individual human persons can be meaningfully correlated with specific actions and particular effects. Reading works by Godwin, Austen, Hogg, Mary Shelley, and Dickens alongside a wide-ranging set of debates in nineteenth-century law and Romantic politics and aesthetics, Daniel Stout argues that the novel, a literary form long understood as a reflection of individualism’s ideological ascent, in fact registered the fragile fictionality of accountable individuals in a period defined by corporate actors and expansively entangled fields of action.Examining how liberalism, the law, and the novel all wrestled with the moral implications of a highly collectivized and densely packed modernity, Corporate Romanticism reconfigures our sense of the nineteenth century and its novels, arguing that we see in them not simply the apotheosis of laissez-fair individualism but the first chapter of a crucial and distinctly modern problem about how to fit the individualist and humanist terms of justice onto a world in which the most consequential agents are no longer persons
