    Angkor, the temple and palace complex of the ancient Khmer capital in Cambodia is one of the world’s most famous monuments. Hundreds of thousands of tourists from all over the globe visit Angkor Park, one of the finest UNESCO World Heritage Sites, every year. Since its UNESCO listing in 1992, the Angkor region has experienced an overwhelming mushrooming of hotels and restaurants; the infrastructure has been hardly able to cope with the rapid growth of mass tourism and its needs. This applies to the access and use of monument sites as well. The authors of this book critically describe and analyse the heritage nomination processes in Cambodia, especially in the case of Angkor and the temple of Preah Vihear on the Cambodian/Thai border. They examine the implications the UNESCO listings have had with regard to the management of Angkor Park and its inhabitants on the one hand, and to the Cambodian/Thai relationships on the other. Furthermore, they address issues of development through tourism that UNESCO has recognised as a welcome side-effect of heritage listings. They raise the question whether development through tourism deepens already existing inequalities rather than contributing to the promotion of the poor.

    In early modern Europe, international law emerged as a means of governing relations between rapidly consolidating sovereign states, purporting to establish a normative order for the perilous international world. However, it was intrinsically fragile and uncertain, for sovereign states had no acknowledged common authority that would create, change, apply, and enforce legal norms. In Imagining World Order, Chenxi Tang shows that international world order was as much a literary as a legal matter. To begin with, the poetic imagination contributed to the making of international law. As the discourse of international law coalesced, literary works from romances and tragedies to novels responded to its unfulfilled ambitions and inexorable failures, occasionally affirming it, often contesting it, always uncovering its problems and rehearsing imaginary solutions.Tang highlights the various modes in which literary texts - some highly canonical (Camões, Shakespeare, Corneille, Lohenstein, and Defoe, among many others), some largely forgotten yet worth rediscovering - engaged with legal thinking in the period from the sixteenth to the eighteenth century. In tracing such engagements, he offers a dual history of international law and European literature. As legal history, the book approaches the development of international law in this period —its so-called classical age—in terms of literary imagination. As literary history, Tang recounts how literature confronted the question of international world order and how, in the process, a set of literary forms common to major European languages (epic, tragedy, romance, novel) evolved

    A number of UN conventions and declarations (on the Rights of Indigenous Peoples, the Protection and Promotion of the Diversity of Cultural Expressions and the World Heritage Conventions) can be understood as instruments of international governance to promote democracy and social justice worldwide. In Indonesia (as in many other countries), these international agreements have encouraged the self-assertion of communities that had been oppressed and deprived of their land, especially during the New Order regime (1966-1998). More than 2,000 communities in Indonesia who define themselves as masyarakat adat or "indigenous peoples" had already joined the Indigenous Peoples' Alliance of the Archipelago" (AMAN) by 2013. In their efforts to gain recognition and self-determination, these communities are supported by international donors and international as well as national NGOs by means of development programmes. In the definition of masyarakat adat, "culture" or adat plays an important role in the communities' self-definition. Based on particular characteristics of their adat, the asset of their culture, they try to distinguish themselves from others in order to substantiate their claims for the restitution of their traditional rights and property (namely land and other natural resources) from the state. The authors of this volume investigate how differently structured communities - socially, politically and religiously - and associations reposition themselves vis-à-vis others, especially the state, not only by drawing on adat for achieving particular goals, but also dignity and a better future.

Daneben räumt die Wiener Vertragsrechtskonvention in Art. 31 Abs. 3 lit. a Übereinkünften der Vertragsparteien eine wesentliche Rolle bei der Vertragsauslegung ein.Dieses Werk beleuchtet die Hintergründe repräsentativer Vertragsauslegung, untersucht ihre Wirkung, die Mechanismen ihres Zustandekommens, lotet ihre Grenzen aus und beurteilt schließlich, ob es sich dabei um ein sinnvolles Instrument handelt.

    For more than century before World War II, traders, merchants, financiers, and laborers steadily moved between places on the Indian Ocean, trading goods, supplying credit, and seeking work. This all changed with the war and as India, Burma, Ceylon, and Malaya wrested independence from the British empire. Set against the tumult of the postwar period,Boats in a Storm centers on the legal struggles of migrants to retain their traditional rhythms and patterns of life, illustrating how they experienced citizenship and decolonization. Even as nascent citizenship regimes and divergent political trajectories of decolonization papered over migrations between South and Southeast Asia, migrants continued to recount cross-border histories in encounters with the law. These accounts, often obscured by national and international political developments, unsettle the notion that static national identities and loyalties had emerged, fully formed and unblemished by migrant pasts, in the aftermath of empires. Drawing on archival materials from India, Sri Lanka, Myanmar, London, and Singapore, Kalyani Ramnath narrates how former migrants battled legal requirements to revive prewar circulations of credit, capital, and labor, in a postwar context of rising ethno-nationalisms that accused migrants of stealing jobs and hoarding land. Ultimately, Ramnath shows how decolonization was marked not only by shipwrecked empires and nation-states assembled and ordered from the debris of imperial collapse, but also by these forgotten stories of wartime displacements, their unintended consequences, and long afterlives

    Cyber espionage has become a common method for states to gather confidential information in cyberspace. The vast interconnectedness of the Internet provides a target-rich environment for states to engage in low-risk collection of large amounts of data at an unprecedented speed and scale. Cyber espionage may look different from traditional espionage, but it is essentially an expression of the tension between competing states. States use espionage, cyber or otherwise, to strengthen their own position and security in competition with political, military, or economic rivals. In this manner, cyber espionage is best understood as an integral part of an ongoing intelligence contest in cyberspace. This report explores how international law applies to peacetime cyber espionage. By taking stock of recent legal statements by states, this report specifically examines how states have interpreted the principles of territorial sovereignty and non-intervention in the cyber context. The report also analyses the legal implications of provision of intelligence and cyber support to Ukraine by Western states.

    For more than century before World War II, traders, merchants, financiers, and laborers steadily moved between places on the Indian Ocean, trading goods, supplying credit, and seeking work. This all changed with the war and as India, Burma, Ceylon, and Malaya wrested independence from the British empire. Set against the tumult of the postwar period,Boats in a Storm centers on the legal struggles of migrants to retain their traditional rhythms and patterns of life, illustrating how they experienced citizenship and decolonization. Even as nascent citizenship regimes and divergent political trajectories of decolonization papered over migrations between South and Southeast Asia, migrants continued to recount cross-border histories in encounters with the law. These accounts, often obscured by national and international political developments, unsettle the notion that static national identities and loyalties had emerged, fully formed and unblemished by migrant pasts, in the aftermath of empires. Drawing on archival materials from India, Sri Lanka, Myanmar, London, and Singapore, Kalyani Ramnath narrates how former migrants battled legal requirements to revive prewar circulations of credit, capital, and labor, in a postwar context of rising ethno-nationalisms that accused migrants of stealing jobs and hoarding land. Ultimately, Ramnath shows how decolonization was marked not only by shipwrecked empires and nation-states assembled and ordered from the debris of imperial collapse, but also by these forgotten stories of wartime displacements, their unintended consequences, and long afterlives
