    Knowledge in the Age of Digital Capitalism proposes a new critical theory concerning the functioning of capitalism and how we consider knowledge and information. This ambitious book systematically and lucidly introduces contemporary phenomena into the framework of cognitive materialism to address some of the great themes of the social sciences: knowledge, exploitation and social class in an account of capitalism as totality in the present day. Author Mariano Zukerfeld reinvigorates materialist study of communications, presenting a typology of knowledge to explain the underlying material forms of information, intellectual property and cognitive work in contemporary societies. Using current examples the book also examines concerns such as free labour and the pivotal role of intellectual property. The book offers nothing less than an introduction to the theory of cognitive materialism and an account of the entirety of the digital (or knowledge) capitalism of our time.

    Knowledge, Spirit, Law is a de facto phenomenology of scholarship in the age of neoliberal capitalism. The eleven essays (plus Appendices) in Book 1: Radical Scholarship cover topics and circle themes related to the problems and crises specific to neoliberal academia, while proposing creative paths around the various obstructions. The obstructions include metrics-obsessed academia, circular and incestuous peer review, digitalization of research as stalking horse for text- and data-mining, and violation by global corporate fiat of Intellectual Property and the Moral Rights of Authors. These issues, while addressed obliquely in the main text, definitively inform the various proscriptive aspects of the essays and, via the Introduction and Appendices, underscore the necessity of developing new-old means to no obvious end in the production of knowledge — that is to say, a return to forms of non-instrumentalized intellectual inquiry. To be developed in two concurrent volumes, Knowledge, Spirit, Law will serve as a “moving and/or shifting anthology” of new forms of expression in humanistic studies. Book 2: The Anti-Capitalist Sublime will be published in Autumn 2017.

    Medieval Hackers calls attention to the use of certain vocabulary terms in the Middle Ages and today: commonness, openness, and freedom. Today we associate this language with computer hackers, some of whom believe that information, from literature to the code that makes up computer programs, should be much more accessible to the general public than it is. In the medieval past these same terms were used by translators of censored texts, including the bible. Only at times in history when texts of enormous cultural importance were kept out of circulation, including our own time, does this vocabulary emerge. Using sources from Anonymous’s Fawkes mask to William Tyndale’s Bible prefaces, Medieval Hackers demonstrates why we should watch for this language when it turns up in our media today. This is important work in media archaeology, for as Kennedy writes in this book, the “effluorescence of intellectual piracy” in our current moment of political and technological revolutions “cannot help but draw us to look back and see that the enforcement of intellectual property in the face of traditional information culture has occurred before….We have seen that despite the radically different stakes involved, in the late Middle Ages, law texts traced the same trajectory as religious texts. In the end, perhaps religious texts serve as cultural bellwethers for the health of the information commons in all areas. As unlikely as it might seem, we might consider seriously the import of an animatronic [John] Wyclif, gesturing us to follow him on a (potentially doomed) quest to preserve the information commons.

Die aktuelle Komplexität der Problemstellung liegt nicht zuletzt in den unionsrechtlichen Rechtsänderungen.In praktischen Kollisionsfällen oder bei einer Anmelderecherche gilt es zu entscheiden, ob sich ein fremdes Zeichen – trotz andersartiger Ausgestaltung – hinreichend an eine Marke angenähert hat, um auf Basis des gemeinsamen Motivs eine Ähnlichkeit zu bejahen.Die Lösung wird im markenrechtlich legitimierten Schutzbereich verortet und die Zeichenähnlichkeit im Motiv im Zusammenhang der gedanklichen Verbindung beschrieben. Im Kontext von Urheber-, Design- und Lauterkeitsrecht sowie aktuellen Motivschutzfällen wird eine Neubewertung der Kriterien der begrifflichen Zeichenähnlichkeit für die Ähnlichkeit im Motiv unternommen.

    We study a platformâs incentives to delist IP-infringing products and the effects of holding the platform liable for the presence of such products on innovation and consumer welfare. For a given number of buyers, platform liability increases innovation by reducing the competitive pressure faced by innovative products. However, there can be a misalignment of interests between innovators and buyers. Furthermore, platform liability can have unintended consequences, which overturn the intended effect on innovation. Platform liability tends to increase (decrease) innovation and consumer welfare when the elasticity of participation of innovators is high (low) and that of buyers is low (high).

    This paper explores how regulatory responses to emerging IP issues in digital trade may develop at the international level and in particular how existing mechanisms might influence the chances of developing internationally agreed rules in this regard. The primacy of state sovereignty in intellectual property up to the late 19th century gave way to the important WIPO treaties, which still retained some independence of member states and based international regulatory responses directly on national experience. While more regulatory sovereignty was ceded in TRIPS, the WIPO Copyright Treaty and the WIPO Performances and Phonograms Treaty, the adoption of non-binding instruments (such as the WIPO Joint Recommendations in the area of trademarks) show the limits of decision making by consensus. International non-state solutions such as the Uniform DomainName Dispute-Resolution Policy (UDRP) established by the Internet Corporation for Assigned Names and Numbers (ICANN) have introduced separate, technically determined solutions to specific IP issues. Proliferating free-trade agreements (FTAs) have emerged as a new platform to agree to IPrelated regulatory responses that can be used to project the national solutions of a few dominant FTA-partners. However, these FTAs have also served to give legally binding status to internationally agreed non-binding recommendations. These diverse approaches are apparent in recent IPregulatory responses to emerging digital issues that are particularly relevant for digital business models, including inter alia Internet service provider (ISP) liability, "safe harbour" provisions and the issue of orphan works, where there appears to be less agreement. Still further behind to reaching any kind of agreement are the emerging issues of online exhaustion, data mining and IP-related questions of artificial intelligence.

    India's creative economy is large, but its untapped potential is even larger. This study provides the first reliable measure on the size of India's creative economy, explores the many challenges faced by the creative industries, and provides recommendations to make India one of the most creative societies in the world. India's creative economy-measured by the number of people working in various creative occupations-is estimated to contribute nearly 8% of the country's employment, much higher than the corresponding share in Turkey (1%), Mexico (1.5%), South Korea (1.9%) and even Australia (2.1%). Creative occupations also pay reasonably well-88% higher than the non-creative ones and contribute about 20% to nation's overall GVA. Out of the top ten creative districts in India, six are non-metros-Badgam (J&K), Panipat (Haryana), Imphal (Manipur), Sant Ravi Das Nagar (Uttar Pradesh), Thane (Maharashtra), and Tirupur (Tamil Nadu)- indicating the diversity and depth of creativity across India. Yet, according to United Nations Conference on Trade and Development, India's creative exports are only one-tenth of those of the People's Republic of China. To develop the creative economy to realize its full potential, Indian policymakers would like to: (i) increase the recognition of Indian culture globally; (ii) facilitate human capital development among its youth; (iii) address the bottlenecks in the Intellectual Property (IP) framework; (iv) improve access to finance; and (v) streamline the process of policymaking by establishing one intermediary organization. India must also leverage its G20 Presidency to put creative economy concretely on the global agenda.

    Der Band „Markenrechtlicher Motivschutz“ greift die immaterialgüterrechtliche Problematik eines Kennzeichenschutzes von Markenmotiven mit einem originären Theorieansatz auf: Das Markenmotiv ist als Auslegungsaspekt in einem mehrdimensionalen Schutzumfang der Marke rechtserheblich. Die aktuelle Komplexität der Problemstellung liegt nicht zuletzt in den unionsrechtlichen Rechtsänderungen.In praktischen Kollisionsfällen oder bei einer Anmelderecherche gilt es zu entscheiden, ob sich ein fremdes Zeichen – trotz andersartiger Ausgestaltung – hinreichend an eine Marke angenähert hat, um auf Basis des gemeinsamen Motivs eine Ähnlichkeit zu bejahen.Die Lösung wird im markenrechtlich legitimierten Schutzbereich verortet und die Zeichenähnlichkeit im Motiv im Zusammenhang der gedanklichen Verbindung beschrieben. Im Kontext von Urheber-, Design- und Lauterkeitsrecht sowie aktuellen Motivschutzfällen wird eine Neubewertung der Kriterien der begrifflichen Zeichenähnlichkeit für die Ähnlichkeit im Motiv unternommen.

    We develop a positive model of multinational firm behavior and analyze a firm’s incentive to transfer an intellectual property (IP) right of uncertain value offshore ex ante, i.e. before its success or failure is realized. With an asymmetric treatment of losses in the home country, the multinational firm will transfer its IP to a foreign low-tax country to avoid potentially negative profits at home. In addition, similar incentives exist to transfer the IP to a jurisdiction where tax rates are comparable or even higher than at home if the foreign jurisdiction offers a more symmetric treatment of losses.

    Public authorities in many jurisdictions are concerned about the proliferation of illegal content and products on online platforms. In this paper, we provide an economic appraisal of platform liability that highlights the effects of a stricter liability rule on several key variables such as prices, terms and conditions, business models, and investments. We also discuss the impact of the liability regime applying to online platforms on competition between them and the incentives of third parties relying on them. Finally, we analyze the potential costs and benefits of measures that have received much attention in recent policy discussions.
