    This article presents a synthetic and structured view of the determination of law, aligned with the line of thought named methodical realism, which I subscribe. It also offers a critical view of other ius-philosophical lines of thought, which oppose to this rational method of finding what is fair. Nevertheless, the body of the article includes: a) an organized view on the necessity of affronting the judicial decision according to the postulates of the practical reason; b) a study of the different instruments offered to the interpreter for the determination of law; c) an ontological view of Law or the nature of things as the base for legal reasoning; and d) the methodology of the determination of Law, understood as a complex process of factual development and legal reasoning intended to determine what is fair in any particular case.

    This paper examines the distribution of the gasoline tax burden in the presence of increased electric vehicle adoption. Automobile manufacturers and even some states have ambitious goals to phase out gas-powered cars. However, in spite of these plans, the primary source of automobile infrastructure funding in the United States continues to be gasoline taxes. Less demand for gasoline threatens this source of revenue for maintaining roads and further shifts the burden of the tax toward consumers who can't afford the still relatively expensive electric vehicles. The analysis here illustrates the fundamental regressivity of the gasoline tax, then simulates the distributional impact of replacing the current gas tax with a lump-sum/income tax with different assessment rules designed to replace revenue generated by the gasoline tax. For example, many states are considering switching from a gas tax to a tax based on miles driven to shore up infrastructure funding. Alternatively, the required revenue could be paid equally across income quartiles or assessed based on income. Not surprisingly, the degree of regressivity of replacing the gasoline tax depends on how the tax is assessed across the income distribution.

    Companies are facing increased pressure to “walk the talk” on diversity, equity, and inclusion (DEI) in their operations. One specific call-to-action from stakeholders is the public disclosure of EEO-1s. Companies with 100+ employees are federally mandated to annually report the intersectional diversity data of their workforce in the EEO-1. We examine how consumers perceive the strategic decision companies make regarding whether to disclose workforce diversity information. We find no evidence that a company’s disclosure of its workforce diversity data negatively affects attitudes or perceived company commitment to diversity, even when it reveals racial disparities across job categories. Instead, we find that consumers perceive firms that disclose their workforce data more positively and to be more committed to DEI initiatives, relative to firms that choose not to disclose, particularly when these disclosures reveal diversity within the workforce

    Ride-hailing services have the potential to expand access to opportunities, but out-of-pocket costs may limit the benefits of ride-hail for low-income individuals. This paper examines how ride-hailing services can shape spatial and socioeconomic differences in access to opportunities while accounting for the trade-off between travel time and monetary costs. Using one year of aggregated Uber trip data for Rio de Janeiro in 2019 and a new multi-objective optimization routing method, we analyze the potential for ride-hailing services to improve employment accessibility when used as a standalone transportation mode and in conjunction with transit as a first-mile feeder service. We compare the accessibility Pareto frontiers of these transport mode alternatives with cumulative opportunity measures considering multiple combinations of travel time and monetary cost thresholds. We find that, compared to transit, ride-hailing can significantly expand accessibility as a standalone transport mode for relatively short trips (between 10 and 40 minutes), and as a first-mile feeder to transit in trips longer than 30 minutes. In both cases, the accessibility advantages of ride-hailing are mostly limited by relatively higher out-of-pocket costs. When we account for different affordability thresholds, the accessibility benefits of ride-hailing services accrue mostly to high-income groups. These findings suggest that policy efforts to integrate rideshare with transit are likely not going to benefit low-income communities without some form of subsidized fare discounts to alleviate affordability barriers. The paper also highlights how accounting for trade-offs between travel-time and monetary costs can importantly influence the results of transportation accessibility and equity studies, suggesting that this issue should be addressed in future research.

    We study determinants of COVID-19 vaccine donations from recipients' perspective, especially considering supply chain and institutional weakness (corruption) aspects. Results, based on data from more than 131 nations, show that strengthened supply chains reduced donations. The impacts of corruption and logistics performance likely persisted from pre-COVID times. More corrupt nations received fewer donations per capita, ceteris paribus. The results with respect to economic prosperity supported efforts to end vaccine apartheid, and island nations received more donations, as did nations with more bilateral vaccine deals. Finally, donations received through COVAX were driven by qualitatively similar factors, except corruption did not matter.

    Chronicling sixteenth-century Spain to the present day, Beyond Human aims to decentre the human and acknowledge the material historicity of more-than-human nature. The book explores key questions relating to ecological equity, justice, and responsibility within and beyond Spain in the Anthropocene. Examining relations between Iberian cultural practices, historical developments, and ecological processes, Maryanne L. Leone, Shanna Lino, and the contributors to this volume reveal the structures that uphold and dismantle the non-human–human dichotomy and nature-culture divide. The book critiques works from the Golden Age to the twenty-first century in a wide range of genres, including comedia, royal treatises, agricultural reports, paintings, satirical essays, horror fiction and film, young adult and speculative literature, poetry, graphic novels, and television series. The authors contend that Spanish cultural studies must expose the material historicity that entangles today’s ecological crises and ecosocial injustices with previous, future, and contemporary entities. The book argues that this will require the simultaneous decentring of the human and of the Anthropocene as an ecocritical framework.     Where they exist, tariffs for water supply and sanitation services face a tension between different policy objectives, such as ensuring the financial sustainability of service provision and ensuring access to all, including vulnerable and poor social groups. Governments (local and national) resort to a range of measures to reconcile these objectives and address social consequences of tariffs: tariff levels and structures, nudging, budgetary transfers, targeted social measures. The paper revisits most common practices and discusses their pros and cons, and requisites to make them work. It provides up-to-date analyses on a series of related issues, such as definitions of affordability, principle for cost recovery, benefits and costs of metering, elasticity of domestic water use to prices, fiscal transfers to water services. The paper is informed by recent academic research, data on selected countries, and interactions with OECD bodies.

    This paper investigates the likelihood of corporate insolvency and the potential implications of debt overhang of non-financial corporations induced by economic shock associated with the outbreak of COVID-19. Based on simple accounting models, it evaluates the extent to which firms deplete their equity buffers and increase their leverage ratios in the course of the COVID-19 crisis. Next, relying on regression analysis and looking at the historical relationship between firms’ leverage and investment, it examines the potential impact of higher debt levels on investment during the recovery. Against this background, the discussion outlines a number of policy options to flatten the curve of crisis-related insolvencies, which could potentially affect otherwise viable firms, and to lessen the risk of debt-overhang, which could slow down the speed of recovery.
