    Stiftungen spielten im Mittelalter eine außerordentliche Rolle bei der Förderung von Kirche und Religion, von Bildung und sozialer Fürsorge. Sie wirkten - gerade in der städtischen Gesellschaft - auf alle Bereiche des menschlichen Lebens ein. Und sie sollten ungeachtet ihrer sonstigen Zwecke immer auch dem Seelenheil der Stifter dienen. Ausgehend von einem neuen, sozialhistorischen Stiftungsbegriff, wird in diesem Buch das gesamte Stiftungswesen einer spätmittelalterlichen Stadt in den Blick genommen. Im Mittelpunkt des Interesses stehen langfristige Veränderungen und Einflussfaktoren des Stiftungsverhaltens. Besondere Aufmerksamkeit gilt dabei den Jenseitsvorstellungen der Akteure: Der Glaube an das Fegefeuer fand in Stralsund erst im Laufe des 15. Jahrhunderts größere Verbreitung und konnte auch dann die Vorstellung von einem entscheidenden Gerichtsurteil am Jüngsten Tag keineswegs völlig verdrängen.

    Abstract: The Carnegie Report on the Balkan Wars could neither pacify the regional conflicts nor ban future ethnic violence. Yet it signifies a highly symptomatic moment in early 2 0th-century US Big Philanthropy. In order to assess its historical relevance, this article traces the report’s historical setting in contemporary US American political and legal debates from 1 910 to the early 1920s. Two major features stand out: First, the report testifies to the contemporary programmatic creed and political leanings of its most renowned trustees – such as Elihu Root, James T. Shotwell, James Brown Scott and Nicholas Murray Butler – who envisioned an international
    world order based on increasingly professionalized international law. Most of them judicial experts, some of them staunch republican foreign policy elites, others more progressive intellectuals,they felt authorized to scientifically analyse and advise international diplomacy. Second, however, the Carnegie Men’s emphasis on law-based internationalism was no static endeavour. It rather succumbed to the turmoils of their time. Under the unfavourable auspices of World War I since 1914 and, even more so with the United States entering the war in 1 917 and during
    the complicated peace negotiations in 1 918/19, the philanthropic experiment of propagating a law-based vision of the world order was gradually transformed into a new version of conciliarist internationalism based on close cooperation with the new League of Nations in the early 1920s

    Der „mutmaßliche Stifterwille“ bildet in der Stiftungspraxis eine Art „Allzweckwaffe“, die es der selbstständigen Stiftung bürgerlichen Rechts ermöglichen soll, sich von den Vorgaben in ihrer Satzung flexibel zu lösen. Dieser Flexibilität steht die konzeptionelle Unverfügbarkeit der Stiftung grundsätzlich entgegen. Der Autor leitet aus der allgemeinen Rechtsgeschäfts- und Methodenlehre die möglichen Funktionen des Arguments sowie vor allem dessen rechtliche Grenzen ab: Entgegen der vorherrschenden Doktrin kommt ihm eine korrigierende Funktion nur dort zu, wo Stifter oder Behörde einfache Satzungsregelungen zur Disposition gestellt haben und der ursprüngliche Stiftungszweck als privatautonomer Bezugspunkt zur Korrektur vorhanden ist. In practice the "presumed founder's will" forms a kind of "all-purpose weapon" intended to enable the independent foundation under German civil law to flexibly escape from the stipulations in its statutes. This flexibility is fundamentally opposed by the conceptual non-availability of the foundation. The author derives the possible functions of the argument as well as, above all, its legal limitations from the general doctrine of legal transactions and methods: Contrary to the prevailing doctrine, it has a corrective function only where founders or authorities have made simple provisions of the statutes available for disposition and the original purpose of the foundation still exists as a private-autonomous point of reference for correction.
