    Silent Parties ist ein auf acht historischen Rechtsfällen basierendes Gesamtkunstwerk. Die Arbeit des Künstlerduos benandsebastian im Auftrag des Gerichts von Aarhus konzentriert sich auf nicht-menschliche Protagonisten in der Rechtsgeschichte und untersucht Fälle, in denen Tiere oder Roboter im Mittelpunkt von Rechtsstreitigkeiten standen. Von einem Verfahren aus dem 15. Jahrhundert, in dem ein Hahn wegen des angeblichen Legens eines Eis vor Gericht stand, bis hin zu einem aktuellen Fall, in dem verhandelt wurde, ob lebensgroße, singende und tanzende Roboter einer amerikanischen Restaurantkette als lebende Darsteller behandelt werden sollten. benandsebastian haben mit Expert*innen aus den Bereichen Recht, Robotik, Ethik, Anthropologie und Kognitionswissenschaft zusammengearbeitet, um herauszufinden, auf welche Weise Nichtmenschen in der Rechtsgeschichte zwar stumme, aber dennoch für das Denken ihrer Zeit aufschlussreiche Parteien waren

    Almost a decade has passed since the outbreak of the economic crisis; from its original nucleus, its effects have quickly affected the social and geopolitical fields. Such wide impact and its complex implications make the crisis an object susceptible of multiple readings. The particular aim of the studies collected in this volume is to explore the impact of the crisis on law, culture and society, in order to test the depth of the problem, by comparing the analytical perspectives obtainable from legal and human sciences. The book focuses on three main issues: the crisis as a social object, in order to consider the crisis in terms of its attributing force; the problem of democracy, which is becoming an increasingly central question now, as the changes imposed by the crisis have begun to settle down; the interdisciplinary challenge that, in time of crisis, questions paradigms of knowledge, competences and methods, in order to enable an heuristic dialogue between human, social and legal sciences.

After being found guilty, Wilde spent two years in prison, emerged bankrupt, and died in a cheap hotel room in Paris a few years after his release.     Mit dem eigenhändigen Unterschreiben geht es zu Ende. Zunehmend übernehmen digitale Signaturen ihre Rolle. Was aber wird überhaupt die individuell-eigenhändige Unterschrift gewesen sein? Die materiale Form, in der Unterschriften heute gegeben werden, ist nicht kontingent, sondern Ergebnis komplexer historischer Transformationen. Unterschreiben ist deshalb nur vorderhand ein einfacher Schreibakt, was bereits daran zu erkennen ist, dass selbst berühmte Philosophen wie Friedrich Nietzsche, Walter Benjamin oder Jacques Derrida sich an ihr abarbeiten und zwar nicht allein in der Theorie: Sie unterschreiben selbst, zum Teil unter Pseudonym oder als Gott Dionysos. Zentraler Ort, an dem der komplexe Rechtsakt des Unterschreibens verhandelt wird, ist die Literatur. Wer den Geschichten zwischen Literatur und Recht folgt, kann lernen, Unterschriften zu lesen und begreifen, dass sie auch im Recht operative Fiktionen sind

    Circumventing the Law probes the rabbinic logic behind the use of loopholes, the legal phenomenon of finding and using gaps within law to achieve otherwise illegal outcomes. The logic of ha aramah, a subset of rabbinic legal circumventions mostly defined as a tool for private life, underpins both well-known circumventions, such as selling leaven before Passover, and lesser-known mechanisms, such as designating an animal intended for sacrifice blemished before birth to allow it to be slaughtered for food instead. Elana Stein Hain traces the development of these loopholes over time, revealing that rabbinic literature does not consistently accept or reject loopholes. Instead, rabbinic Judaism applies categories of evasion (prohibited), avoidance (permitted), and avoision (contested) to loopholes on a case-by-case basis. The intended outcome of a given loophole determines its classification, as does the legal integrity of the circumventive process in question.Yet these understandings of loopholes are not static-instead, rabbinic attitudes toward loopholing change over time. Early works display an objective, performative understanding of the self and of intention, but evolve over time to reflect more subjective and intimate understanding of the self and intention. This evolution redefines what legal integrity means in Jewish legal philosophy.Circumventing the Law brings readers through the Second Temple period to the modern era to see how loopholing has evolved over millennia. With a focus on late antiquity, Stein Hain explores tannaitic literature, the Palestinian Talmud, and contemporaneous Greco-Roman and Persian thought to show that when warranted, Jewish rhetoric and philosophy around understandings of loopholes was a unique phenomenon that relied on changes in understanding the definition of integrity itself, a key finding for scholars of Jewish Studies and of religious and of secular law writ large "This book traces rabbinic thought on the near-universal phenomenon of legal circumventions, finding licit ways to achieve otherwise illegal outcomes. Rabbinic literature does not fully reject or accept loopholing, but instead determine acceptability based on whether their outcome and their process maintain the values and the integrity of the law"--

Die materiale Form, in der Unterschriften heute gegeben werden, ist nicht kontingent, sondern Ergebnis komplexer historischer Transformationen. Unterschreiben ist deshalb nur vorderhand ein einfacher Schreibakt, was bereits daran zu erkennen ist, dass selbst berühmte Philosophen wie Friederich Nietzsche, Walter Benjamin oder Jacques Derrida sich an ihr abarbeiten und zwar nicht allein in der Theorie: Sie unterschreiben selbst, zum Teil unter Pseudonym oder als Gott Dionysos. Zentraler Ort, an dem der komplexe Rechtsakt des Unterschreibens verhandelt wird, ist die Literatur. Wer den Geschichten zwischen Literatur und Recht folgt, kann lernen, Unterschriften zu lesen und begreifen, dass sie auch im Recht operative Fiktionen sind

    "For more than a century before World War II, traders, merchants, financiers, and laborers steadily moved between places on the Indian Ocean, trading goods, supplying credit, and seeking work. This all changed with the war and as India, Burma, Ceylon, and Malaya wrested independence from the British empire. Set against the tumult of the postwar period, Boats in a Storm centers on the legal struggles of migrants to retain their traditional rhythms and patterns of life, illustrating how they experienced citizenship and decolonization. Even as nascent citizenship regimes and divergent political trajectories of decolonization papered over migrations between South and Southeast Asia, migrants continued to recount cross-border histories in encounters with the law. These accounts, often obscured by national and international political developments, unsettle the notion that static national identities and loyalties had emerged, fully formed and unblemished by migrant pasts, in the aftermath of empires. Drawing on archival research conducted in India, Sri Lanka, Myanmar, London, and Singapore, Kalyani Ramnath narrates how former migrants battled legal requirements to revive prewar circulations of credit, capital, and labor, in a postwar context of rising ethno-nationalisms that accused migrants of stealing jobs and hoarding land. Ultimately, Ramnath shows how decolonization was marked not only by shipwrecked empires and nation-states assembled and ordered from the debris of imperial collapse, but also by these forgotten stories of wartime displacements, their unintended consequences, and long afterlives."

    Die 11. Tagung zu »Literatur und Recht« im Nordkolleg Rendsburg beschäftigte sich mit dem ebenso spannenden wie unerschöpflichen Themenkreis Recht, Sprache, Kunst und Literatur mit ihren Ein-und Ansichten sowie mit aktuellen Debatten. In den Vorträgen ging es etwa um Äußerungsdelikte im Internet, Kunstfälschungsprozesse, die Rolle der Rhetorik im Recht, Humor und Recht, die möglichen Auswirkungen der #MeToo Debatte auf Musik und Recht sowie um Juristen und Juristinnen auf (kriminellen) Abwegen. Es war eine Tagung der Vielfalt. Das zeigt, dass das Thema quicklebendig ist und dass die Funken, die beim Aufeinandertreffen von Recht, Kunst und Literatur entstehen, in allen Farben und in alle Richtungen sprühen. Ein Fest der Freiheit des Denkens waren die drei Rendsburger Tage auf jeden Fall The eleventh conference on "Literature and Law" held at the Nordkolleg Rendsburg examined the topics of law, language, art, and literature, which are just as exciting as they are inexhaustible, as well as current debates. The talks held addressed issues such as offensive speech online, art forgery trials, legal rhetoric, humor and the law, the impact of the #MeToo debate on music and the law, as well as lawyers who have (criminally) gone astray

    In The Geography of Injustice, Barak Kushner argues that the war crimes tribunals in East Asia formed and cemented national divides that persist into the present day. In 1946 the Allies convened the Tokyo Trial to prosecute Japanese wartime atrocities and Japan's empire. At its conclusion one of the judges voiced dissent, claiming that the justice found at Tokyo was only "the sham employment of a legal process for the satisfaction of a thirst for revenge." War crimes tribunals, Kushner shows, allow for the history of the defeated to be heard. In contemporary East Asia a fierce battle between memory and history has consolidated political camps across this debate. The Tokyo Trial courtroom, as well as the thousands of other war crimes tribunals opened in about fifty venues across Asia, were legal stages where prosecution and defense curated facts and evidence to craft their story about World War Two. These narratives and counter narratives form the basis of postwar memory concerning Japan's imperial aims across the region. The archival record and the interpretation of court testimony together shape a competing set of histories for public consumption. The Geography of Injustice offers compelling evidence that despite the passage of seven decades since the end of the war, East Asia is more divided than united by history

    Spontaneous norms, or simply norms, can be defined as rules of conduct that emerge without intentional design and in the absence of purposeful external coordination. While the law and economics scholarship has formally analyzed spontaneous norms, the analysis has typically been limited to scenarios where agents possess complete information about the interaction structure, including others' understanding of desirable and undesirable outcomes. In contrast, this paper examines spontaneous norms under the assumption of agent heterogeneity and private preferences. By employing a game-theoretical framework, the analysis reveals that norms' lifecycle can be divided into a formative phase and a long-run phase. The formative phase crucially shapes the norm's content and is itself critically dependent on the initial beliefs that agents hold about each other. Moreover, spontaneous norms are resilient to minor shocks to the belief structure but disintegrate when the magnitude of shocks becomes significant. In the final part, the paper highlights the broader implications of its findings, indicating applications in general law and economics, legal anthropology and history, and the sociology of social norms.

    Through analysis of 5 plays by Shakespeare, Paul Raffield examines what it meant to be a 'stranger' to English law in the late Elizabethan and early Jacobean period. The numbers of strangers increased dramatically in the late sixteenth century, as refugees fled religious persecution in continental Europe and sought sanctuary in Protestant England. In the context of this book, strangers are not only persons ethnically or racially different from their English counterparts, be they immigrants, refugees, or visitors. The term also includes those who transgress or are simply excluded by their status from established legal norms by virtue of their faith, sexuality, or mode of employment. Each chapter investigates a particular category of 'stranger'. Topics include the treatment of actors in late Elizabethan England and the punishment of 'counterfeits' (Measure for Measure); the standing of refugees under English law and the reception of these people by the indigenous population (The Comedy of Errors); the establishment of 'Troynovant' as an international trading centre on the banks of the Thames (Troilus and Cressida); the role of law and the state in determining the rights of citizens and aliens (The Merchant of Venice); and the disenfranchised, estranged position of the citizen in a dysfunctional society and an acephalous realm (King Lear). This is the third sole-authored book by Paul Raffield on the subject of Shakespeare and the Law. The others are Shakespeare's Imaginary Constitution: Late Elizabethan Politics and the Theatre of Law (2010) and The Art of Law in Shakespeare (2017), both published by Hart/Bloomsbury
