    The main reason why Latin America is a cultural diverse region is because of the indigenous peoples who inhabit it. That is why indigenous peoples' interests on their cultural property have to be taken into account when this matter is to be legally regulated in Latin American countries. In order to ascertain whether that has occurred, the book explores relevant legal instruments at the international and regional levels and compares national norms in some Latin American countries, particularly those concerning ownership. It concludes that recognition of indigenous interests in Latin American law on cultural property is still a pending task. Die Arbeit beschäftigt sich mit der Frage: Wie ist der Schutz von Kulturgütern in Lateinamerika rechtlich geregelt, und in welcher Weise werden indigene Kulturgüter innerhalb solcher Regelungen berücksichtigt? Die Frage besteht aus zwei Teilen. Der erste Teil betrifft eine vergleichende Analyse der geltenden Regelungen über den Schutz materieller Kulturgüter Lateinamerikas. Unterstrichen wird dabei ein Aspekt des Rechtsschutzes von Kulturgütern, nämlich die Regelung des Eigentums. Der zweite Teil der Frage, der sich auf die Berücksichtigung der materiellen Kulturgüter der indigenen Völker bezieht , wird bei der Untersuchung der verschiedenen Rechtsinstrumente beachtet. Dabei geht die Arbeit von der Annahme aus, dass die indigenen Völker ein Interesse an der Kontrolle der mit ihrer Kultur verbundenen Güter haben, welches von den Rechtsnormen in der Regel nicht in Betracht gezogen wird.

    Kann Eigentum an Kultur sinnvoll sein? Das Interesse, Cultural Property dem Markt zuzuführen oder dies zu verhindern und hierdurch kollektiven oder individuellen, ideologischen oder ökonomischen Gewinn zu schaffen, gestaltet sich unter den stark divergierenden Bedingungen, die Akteure in einer postkolonialen, spätmodernen Welt vorfinden. Die interdisziplinäre DFG-Forschergruppe zur Konstituierung von Cultural Property beleuchtet diese seit einigen Jahren in der Öffentlichkeit mit wachsender Brisanz verhandelte Frage. Die Forschergruppe fragt nach der Konstituierung von Cultural Property im Spannungsfeld von kulturellen, wirtschaftlichen, juristischen und hiermit auch gesellschaftspolitischen Diskursen. Dies bedingt auch die in dieser fokussierten Form neue Zusammenarbeit von Fachwissenschaftler/innen aus Kultur- und Sozialwissenschaften sowie Rechts-und Wirtschaftswissenschaften. Die Unterschiedlichkeit des disziplinären Zugriffs auf einen Forschungsbereich zeigt sich in den in diesem Band vermittelten ersten Ergebnissen aus der laufenden Forschung genauso deutlich wie die Notwendigkeit, disziplinäre Standpunkte in gemeinsamer Arbeit zusammenzuführen, um den Konstituierungsprozess von Cultural Property zu verstehen.

By the start of the twenty-first century, as the Ecuadorian economy collapsed and its ties with international finance became strained, flower exporters rebuilt their businesses around the profitability of their indigenous labor force, drawing local communities deeply into new plantation systems taking over the highlands.In A Feast of Flowers, Christopher Krupa goes inside Ecuador's booming cut-flower industry to chronicle the ways its capitalist pioneers built a booming export industry around a racial ideology, turning indigenous people's purported differences into resources for industrial expansion. At the core of this racial system is a belief, central to postcolonial science and politics in Ecuador, in capitalism's unique capacity to change people's racial identity and to liberate oppressed populations from racial subordination. Aufgrund der Nähe des Rechts auf Autonomie zum politisch umstrittenen Selbstbestimmungsrecht der Völker und der Verschiedenartigkeit der Autonomie anstrebenden Gruppen hat das Völkerrecht bislang weder eine klare Position zum Inhalt der Autonomie noch zu seinem normativen Status entwickelt.Der Autor gewährt daher zunächst einen Einblick in die Typisierungen kollektiver Autonomierechte und erläutert die völkerrechtlichen Begriffe »Volk«, »indigenes Volk« und »Minderheit«.     We conducted a resume correspondence experiment to measure discrimination in hiring faced by Indigenous Peoples in the United States (Native Americans, Alaska Natives, and Native Hawaiians). We sent employers realistic resumes for common jobs (retail sales, kitchen staff, server, janitor, and security) in 11 cities and compared interview offer rates. We signaled Indigenous status in one of four different ways. Based on 13,516 applications, we do not find hiring discrimination in any context. These findings hold after numerous robustness checks, although our checks and discussions raise multiple concerns that are relevant to audit studies generally.

    El Principio 10 de la Declaración de Río sobre el Medio Ambiente y el Desarrollo (1992) señala de manera expresa que la mejor manera de tratar las cuestiones ambientales es propiciando de modo oportuno la participación de todos los ciudadanos, en el nivel que corresponda. En este contexto, este documento tiene como objetivo desarrollar el marco jurídico y jurisprudencial del Perú, uno de los países signatarios de dicha Declaración, en materia de derechos de acceso a la información, participación y justicia en asuntos ambientales, con énfasis en el sector minero, de modo de identificar buenas prácticas y lecciones aprendidas en el caso peruano, que contribuyan a mejorar los marcos normativos e institucionales tanto del país como de la región en su conjunto.     Los países de América Latina del siglo XXI están experimentando una profundización de sus democracias, proceso que va de la mano con la reflexión y mirada crítica al desarrollo y con el creciente convencimiento de que este debe centrarse en la igualdad con una perspectiva de derechos. Esto supone enfrentar las desigualdades que persisten en la región, en particular aquellas que afectan a los pueblos indígenas, que han sido históricamente excluidos y discriminados. Conlleva, además, garantizar el igual disfrute de los derechos humanos de las personas indígenas y, al mismo tiempo, el derecho a ser colectivos diferentes. Este siglo se inicia con el reconocimiento de los derechos de los pueblos indígenas y su innegable protagonismo en las agendas nacionales e internacionales. En las postrimerías del Segundo Decenio Internacional de los Pueblos Indígenas cabe preguntarse entonces cuánto y cómo se ha avanzado en la implementación de sus derechos, y cuánto y cómo se está avanzando en la construcción de democracias pluriculturales. Este estudio, elaborado en ocasión de la Conferencia Mundial sobre los Pueblos Indígenas, contribuye con evidencias empíricas a mostrar los indiscutibles logros de la región en esa esfera durante la última década, así como las contradicciones y dificultades experimentadas, y los desafíos urgentes que deben considerarse en los procesos de implementación y seguimiento de la agenda para el desarrollo después de 2015. La CEPAL reconoce en este documento el aporte de los pueblos indígenas a la construcción de un nuevo paradigma del desarrollo y ofrece recomendaciones de política para transitar desde los nuevos tratos hacia los nuevos pactos Prólogo .-- Capítulo I.     In recent years, the interdisciplinary fields of Native North American and Indigenous Studies have reflected, at times even foreshadowed and initiated, many of the influential theoretical discussions in the humanities after the "transnational turn." Global trends of identity politics, performativity, cultural performance and ethics, comparative and revisionist historiography, ecological responsibility and education, as well as issues of social justice have shaped and been shaped by discussions in Native American and Indigenous Studies. This volume brings together distinguished perspectives on these topics by the Native scholars and writers Gerald Vizenor (Anishinaabe), Diane Glancy (Cherokee), and Tomson Highway (Cree), as well as non-Native authorities, such as Chadwick Allen, Hartmut Lutz, and Helmbrecht Breinig. Contributions look at various moments in the cultural history of Native North America—from earthmounds via the Catholic appropriation of a Mohawk saint to the debates about Makah whaling rights—as well as at a diverse spectrum of literary, performative, and visual works of art by John Ross, John Ridge, Elias Boudinot, Emily Pauline Johnson, Leslie Marmon Silko, Emma Lee Warrior, Louise Erdrich, N. Scott Momaday, Stephen Graham Jones, and Gerald Vizenor, among others.
