    Unter welchen Bedingungen dürfen Gerichte in Deutschland digitale Anwendungen zur Entscheidungsfindung einsetzen? Das Werk zeigt die engen Grenzen und einen Lösungsweg hierfür auf. Neben rechtstheoretischen und durch die computerspezifische Arbeitsweise gesetzten Grenzen ist der durch das Grundgesetz und das Europarecht abgesteckte Rechtsrahmen zu beachten. Im Zentrum der Bearbeitung steht die Garantie der richterlichen Unabhängigkeit, die durch den Technikeinsatz nicht infrage gestellt werden darf. Zur Auflösung des daraus resultierenden Konflikts wird ein Zertifizierungsverfahren für determinierte Programme vorgeschlagen. Schließlich werden konkrete Anwendungsbeispiele beleuchtet.

    This paper examines how labor mobility restrictions such as non-compete clauses in employment contracts affect the incentives and resulting behavior of employees. Using the investment industry as a testing laboratory, we find that mutual fund managers respond to heightened career concerns due to increased enforceability of non-compete clauses by increasing effort, reducing downside risk, engaging less in tournaments, making their portfolios similar to the portfolios of their benchmarks or peers, and increasing window-dressing. These concerns are, however, moderated by the presence of more developed internal labor markets, which allow managers to substitute restricted across-family mobility with within-family mobility.

    This paper takes stock of the protection of trade secrets for a sample of 37 countries, provides historical data for the period since 1985, and considers the relationship of the stringency of the protection of trade secrets to relevant economic performance indicators. The paper finds that there has been a notable increase in the stringency of trade secrets protection in a broad sample of countries during the period from 1985 to 2010. The paper also finds a positive association between the stringency of trade secrets protection and key indicators of innovation and international economic flows. Further details of the methodology and additional country data can be found in the background paper provided in phase I of the OECD trade secrets project [OECD Trade Policy Paper No. 162].

    This paper takes stock of the available legal protection for trade secrets (undisclosed information) in a broad sample of countries. Drawing on national and international material, the paper develops and presents an indicator of the stringency of protection of trade secrets (the Trade Secrets Protection Index) and provides an assessment of variation in the available protection. The result is a finding that while the sample countries have some similarities, notably with respect to definition and scope of trade secrets, they have many more substantial dissimilarities with respect to implementation of protection for trade secrets. For example, differences are particularly pronounced in evidence gathering and discovery, protection of trade secrets during litigation, technology transfer requirements and the effectiveness of legal systems with respect to enforcement. This diversity is reflected in the wide range of scores in the Trade Secrets Protection Index. Such variation in the stringency of protection for trade secrets may influence firm-level decision-making and may have implications for some aspects of economic performance (in particular, in relation to innovation).

    The present article examines the question whether or not different types of firms tend to protect their innovations with varying mechanisms. Against the background of the Expected-Utility Theory (EU-Theory), firms are differentiated by their size, technological field and their degree of internationalization. According to the EU-Theory modelling, it is hypothesized that large, high-tech and strongly internationalized firms show a stronger tendency to use formal instruments, e.g. patents, to protect their innovations, whereas small and medium-sized (SME), low-tech and weakly internationalized companies follow the strategy of protecting their innovations with informal instruments, e.g. secrecy, to maximize their expected utility. A twofold approach is followed to analyze the theoretical model. For the empirical testing a large-scale survey about 540 records of patenting companies in Germany is used. Differences in attitudes towards protection mechanisms and differences in the actual IPR-management behavior between firms are analyzed. The results show that the attitudes towards protecting innovative achievements only differ slightly by firm type. Large differences can be revealed on the behavioral level which, together with other findings, leads to the conclusion that mostly SMEs are forced to use certain protection mechanisms to keep pace with large companies and technological precursors in fast growing markets. -- Intellectual property : patents : secrecy, expected utility ; rational choice

This article reconciles both opposing views in a unifying framework, accounting for the main aspects causing the discrepancy: imperfect protection, patenting costs, and simultaneous innovations. Theoretical results on the relation between patenting and innovation size are then confronted with survey data for small European firms. Using a binary size measure, we find strong support for the traditional view that firms patent their most important innovations, but a continuous size measure reveals an inverted-U relation between patenting and size, as predicted by the unifying framework. -- filing fees ; imitation ; innovation ; probabilistic patent rights ; R&D ; simultaneous innovation ; trade secrets

    Patents have long been regarded as the 'gold standard' of intellectual property protection. In "Little patents and big secrets: managing intellectual property", Anton and Yao (2004) call this traditional view into question by finding that firms keep their most important innovations secret. This model modifies key assumptions made by Anton and Yao by accounting for patenting costs, patentability standards, and the fact that patents provide protection in competitive situations where secrecy fails. The latter aspect counteracts the empirically substantiated fact that, in situations where both appropriation mechanisms are applicable, secrecy provides more protection. It is found that firms keep small inventions secret, use both mechanisms for medium inventions, and patent their most important innovations. This result reestablishes the traditional view that patents are crucial to provide R&D incentives and is yet consistent with main empirical findings on the issue. -- heterogeneous inventions ; innovation size ; intellectual property rights ; patents ; patent filing fees ; patentability standards ; renewal fees ; secrecy ; technology evolution
