    Durch Kaiser Barbarossa erobert, anschließend trotzdem weitgehend autonome Kommune, schließlich durch innere Parteiungen äußerst zerrissen: Die lombardische Metropole Mailand durchlief im 12. und 13. Jahrhundert eine Zeit dramatischer Veränderungen. Das Buch fragt nach den Folgen dieser Umbrüche für die Legitimationsstrategien der Gerichte dieser Stadt. In der Verknüpfung aus datenbankgestützter, quantitativer Analyse und qualitativer Quelleninterpretation werden vier unterschiedliche Phasen und Formen der Legitimationsstiftung identifiziert. Aufgrund des zunehmenden Fehlens unangefochtener ›externer‹ Legitimationsquellen (Kaiser, Kommune), so die These, stellen die Gerichte Legitimation mehr und mehr selbst her, indem sie die Abarbeitung des Konflikts auf verschiedene, erst während des Verfahrens etablierte ›Gremien‹ (iurisperiti, iudici delegati,) verteilten. Um als ›legitimitätsstiftend‹ fungieren zu können, mussten diese ›Gremien‹ jedoch als weitgehend unabhängig voneinander auftreten. Neben der Partizipation der Parteien an den Beauftragungen spielten die Schrift sowie die Figur des Notars dabei eine entscheidende Rolle. Denn trotz gegebener administrativer und räumlicher Nähe gelang es, gestützt auf Schrift und Notar die Autonomie der einzelnen ›Gremien‹ zu evozieren

    Long description: Insbesondere bei grenzüberschreitenden Streitigkeiten sehen Verbraucher oftmals von einer gerichtlichen Durchsetzung ihrer Forderungen ab. Die dafür verantwortlichen Ursachen, internationale Zuständigkeit im Ausland sowie erheblicher Zeit- und Kostenaufwand, könnten durch eine außergerichtliche Forderungsrealisierung deutlich reduziert werden. Ausgehend von den Regelungen der Richtlinie 2013/11/EU zur alternativen Streitbeilegung in Verbraucherkonflikten vergleicht Jonas Kotzur die bisherige Praxis der Verbraucherschlichtung in Deutschland, den Niederlanden und Schweden und zeigt dabei deren Verbesserungspotential bei der Behandlung internationaler Sachverhalte auf. Im Anschluss daran entwickelt er Vorschläge zur Behandlung grenzüberschreitender Streitfälle, mit denen die derzeitigen Defizite behoben und die außergerichtliche Realisierung grenzüberschreitender Forderungen mit Hilfe der Verbraucherschlichtung effektiver gestaltet werden kann Long description: Various Problems can arise during cross-border disputes which deter consumers from exercising their legal rights.     Durch Kaiser Barbarossa erobert, anschließend trotzdem weitgehend autonome Kommune, schließlich durch innere Parteiungen äußerst zerrissen: Die lombardische Metropole Mailand durchlief im 12. und 13. Jahrhundert eine Zeit dramatischer Veränderungen. Das Buch fragt nach den Folgen dieser Umbrüche für die Legitimationsstrategien der Gerichte dieser Stadt. In der Verknüpfung aus datenbankgestützter, quantitativer Analyse und qualitativer Quelleninterpretation werden vier unterschiedliche Phasen und Formen der Legitimationsstiftung identifiziert. Aufgrund des zunehmenden Fehlens unangefochtener externer Legitimationsquellen (Kaiser, Kommune), so die These, stellen die Gerichte Legitimation mehr und mehr selbst her, indem sie die Abarbeitung des Konflikts auf verschiedene, erst während des Verfahrens etablierte Gremien (iurisperiti, iudici delegati,) verteilten. Um als legitimitätsstiftend fungieren zu können, mussten diese Gremien jedoch als weitgehend unabhängig voneinander auftreten. Neben der Partizipation der Parteien an den Beauftragungen spielten die Schrift sowie die Figur des Notars dabei eine entscheidende Rolle. Denn trotz gegebener administrativer und räumlicher Nähe gelang es, gestützt auf Schrift und Notar die Autonomie der einzelnen Gremien zu evozieren

    This paper examines the role of courts in promoting fulfillment of the right to education in developing country democracies, focusing on India and Indonesia-two countries that have experienced increased education rights litigation in recent years. The paper argues that this litigation has been part of broader struggles over education policy, inequality, and the capture of educational institutions by political and bureaucratic forces; and that the extent to which litigation has been used and led to policy changes has depended significantly on the nature of, and access to, the court system; the presence of support structures for legal mobilization; the ideology of the courts and judges; and the roles and willingness of litigants to pursue redress. Broadly, litigation has served the interests of the poor and marginalized, although gains have largely come through better access to education, while issues of improving quality have been less prominent

    Can changing the rules of the game affect government performance? This paper studies the impact of a simple procedural reform on the efficiency and quality of adjudication in Senegal. The reform gave judges the duty and powers to conclude pre-trial proceedings within a four-month deadline. The analysis combines a staggered rollout across the six civil and commercial chambers of the Court of Dakar and three years of high-frequency caseload data to construct an event study. The analysis finds a reduction in procedural formalism, as the length of the pre-trial stage decreases by 42.9 days (0.29 standard deviation) and the number of case-level pre-trial hearings is reduced, while judges are more likely to impose deadlines. The effect is similar for small and large cases, and fast and slow judges are equally likely to apply the reform. The evidence suggests that these efficiency gains have no adverse impact on quality, and the paper documents positive firm-level effects
