    Es ist seit langer Zeit anerkannt, dass Gesetze richtlinienkonform auszulegen und fortzubilden sind. Ob auch Tarifverträge richtlinienkonform ausgelegt und fortgebildet werden müssen, ist jedoch ungeklärt. Die Tarifnormen wirken zwar ähnlich wie Gesetze. Zugleich sind Tarifverträge aber privatrechtliche Verträge. -- Die Arbeit beantwortet die Forschungsfragen differenziert. Die Gerichte für Arbeitssachen sind weder aufgrund des nationalen Rechts noch des Unionsrechts verpflichtet, Tarifverträge privater Tarifvertragsparteien richtlinienkonform auszulegen und fortzubilden. Demgegenüber sind Tarifverträge staatlicher Tarifvertragsparteien zugunsten der Arbeitnehmerseite richtlinienkonform auszulegen und fortzubilden. Abschließend beleuchtet die Arbeit den Richtlinieneinfluss in Konstellationen, in denen die Exekutive die Geltung tarifvertraglicher Regelungen erstreckt – also den Einfluss auf allgemeinverbindliche Tarifverträge sowie Rechtsverordnungen, die auf Grundlage von §§ 7, 7a AEntG erlassen werden. -- Die Arbeit wurde mit dem Dissertationspreis des Hamburger Vereins für Arbeitsrecht und dem KLIEMT.Arbeitsrecht-Dissertationspreis ausgezeichnet. / »Interpretation of Collective Bargaining Agreements in Conformity with EU Directives« -- National statutes must be interpreted in conformity with EU Directives. This dissertation explores whether national courts are obligated to also interpret collective bargaining agreements in conformity with directives according to Article 288 (3) TFEU or German national law. Collective bargaining agreements, on the one hand, often influence employment relationships in a similar fashion as statutes. On the other hand, these agreements are negotiated by private parties on whom directives in general may not impose obligations.

    Das Mehrebenensystem in Europa wirft – auch im Arbeitsrecht – bekanntlich schwierige Fragen nach dem Verhältnis der einzelnen Ebenen auf. Hierbei wurde der Internationalen Arbeitsorganisation (ILO) in Deutschland und der EU bisher zu wenig Aufmerksamkeit geschenkt. »ILO und EU« zielt darauf, diese Lücke zu schließen. -- Die Untersuchung gibt einen umfassenden Überblick über die Normen der ILO und zeigt auf, warum ILO- und EU-Normen in der Vergangenheit kollidierten. Die »berüchtigten« Laval- und Viking-Line-Entscheidungen des EuGHs bilden hierbei nur ein Beispiel. Ausgehend von einer Analyse des Status quo stellt der Autor Überlegungen an, wie das Unionsrecht mittels eines in Artikel 53 der Charta der Grundrechte der EU verankerten »Berücksichtigungsgebots« besser mit den Normen der ILO in Einklang gebracht werden kann. / »ILO and EU. On the Requirement to Take into Account the Standards of the International Labour Organisation when Interpreting Union Law« -- The author first gives a comprehensive overview of ILO standards. He explores why ILO and EU standards have collided in the past. The Laval and Viking Line rulings of the ECJ and the Troika measures are examined. Building on this, considerations are made as to how ILO law can be better ›taken into account‹ in Union law.

    Das Mehrebenensystem in Europa wirft – auch im Arbeitsrecht – bekanntlich schwierige Fragen nach dem Verhältnis der einzelnen Ebenen auf. Hierbei wurde der Internationalen Arbeitsorganisation (ILO) in Deutschland und der EU bisher zu wenig Aufmerksamkeit geschenkt. »ILO und EU« zielt darauf, diese Lücke zu schließen. -- Das Buch gibt einen umfassenden Überblick über die Normen der ILO und zeigt auf, warum ILO- und EU-Normen in der Vergangenheit kollidierten. Die »berüchtigten« Laval- und Viking-Line-Entscheidungen des EuGHs bilden hierbei nur ein Beispiel. Ausgehend von einer Analyse des Status quo stellt der Autor Überlegungen an, wie das Unionsrecht mittels eines in Artikel 53 der Charta der Grundrechte der EU verankerten »Berücksichtigungsgebots« besser mit den Normen der ILO in Einklang gebracht werden kann. / »ILO and EU. On the Requirement to Take into Account the Standards of the International Labour Organisation when Interpreting Union Law« -- The author first gives a comprehensive overview of ILO standards. He explores why ILO and EU standards have collided in the past. The Laval and Viking Line rulings of the ECJ and the Troika measures are examined. Die politischen Forderungen vieler Länder und auch Deutschlands wollen den Mindestlohn hierzu auf 60 Prozent des Bruttomedianlohns festsetzen. Auch die EU-Kommission tritt in ihrem Richtlinienentwurf über angemessene Mindestlöhnefür höhere Mindestlöhne ein und fordert die Mitgliedstaaten auf, sich an der Relation zum Bruttomedianlohn oder zum Bruttodurchschnittslohn zu orientieren. 60 Prozent des Medians werden dabei als möglicher Richtwert genannt, aber nicht explizit gefordert. [...] In many countries, a paradigm shift in minimum wage policy is discussed, or it has been implemented already. Instead of protecting employees from exploitation as a lower safety line, the minimum wage is intended to provide an adequate standard of living - if possible without government intervention. The political demands of many countries, including Germany, want to set the minimum wage at 60 percent of the gross median wage. In its proposal for a directive on appropriate minimum wages, the EU Commission also advocates higher minimum wages and calls on the member states to take the ratio to the gross median wage as a guideline. 60 percent is mentioned as a possible benchmark, but not explicitly demanded.
