    This article presents a synthetic and structured view of the determination of law, aligned with the line of thought named methodical realism, which I subscribe. It also offers a critical view of other ius-philosophical lines of thought, which oppose to this rational method of finding what is fair. Nevertheless, the body of the article includes: a) an organized view on the necessity of affronting the judicial decision according to the postulates of the practical reason; b) a study of the different instruments offered to the interpreter for the determination of law; c) an ontological view of Law or the nature of things as the base for legal reasoning; and d) the methodology of the determination of Law, understood as a complex process of factual development and legal reasoning intended to determine what is fair in any particular case.

    Charles Dickens’ novel « Bleak House », being probably the finest among the works written by the English novelist, centers around the story of a trial. It is a case, Jarndice versus Jarndice, brought before the Court of Chancery, the « equity » jurisdiction, in the first half of the Nineteenth century, when the Chancery court distinguished itself for the dilatory and heavy procedure of it sessions. The story is a dark one, indulging in the description and comment of the ruin brought to suitors by such formalist and everlasting trial. Suitors are pushed to despair and the patrimony they are fighting for is finally consumed by the trial costs. The novel might thus be seen as an elaborate and poetic treatise on law, legal process, and the legal profession. The article intends to reconstruct the novel’s main critical arguments about law, lawyers, and the practice of court. It also tries to discuss a possible application of a minimalist philosophy of history to law. If in principle it is progress and its claim that could be considered as pragmatically inherent to legal practice, Dickens’ novel might be produced to give a pessimistic turn to this claim, and make of it a regressive incident. If law were not to satisfy the claim to progress that is performatively deducible through the claim to correctness of legal acts, the outcome would be the opposite: law would then be experienced as failure and, most intensely, despair.

    The present study aims to shed light on the existence of a relationship, not always obvious, yet undeniable, between law and literature. Although for decades law has been portrayed as sterile, free from moral or practical considerations and totally indifferent to each instance coming from the literary world, literature is full of legal implications and dimensions. I will focus on the literary production of Vasily Grossman because he represents a constant reminder of the violations of human rights in the twentieth century, and not only in the Soviet Union. He was one of the first to equate the horrors of the concentration camps to the gulags – Hitler to Stalin – to show that in every form of totalitarianism there is the total negation of man, the attempt to annihilate individual, moral, and legal identity, to which he referred as “the pervasiveness of evil”. According to the Russian writer, the only alternative to Absolute Evil (e. g. the persistent violation of human dignity) is striving towards a senseless, illogical, unreasonable metaphysical good. However, the kindness, Grossman notes, ought to save man. He thus begins an excruciating search for “the man inside man”. Every decision, every behavior of the characters in his works, reflects an ethical dimension, or rather results in an ethical choice. So, totalitarian regimes, through a war fought by any possible means, end up destroying the freedom of the individual. In this paper I will argue that throughout the literary production of the Russian writer, there are unresolved issues regarding the relationship between right and evil as well as between freedom and good.
