    Das Gebot richtlinienkonformer Auslegung kann in seiner Bedeutung kaum überschätzt werden. Durch dieses Gebot wird der nationale Rechtsanwender in vielen Fällen mit der Problematik konfrontiert, eine nationale Vorschrift in Hinblick auf gewisse Vorgaben des EuGH auszulegen. Während dieses Thema von Anfang an hitzig in der deutschen Methodenlehre diskutiert und berücksichtigt worden ist, haben insbesondere die Juristen im Vereinigten Königreich mit ruhiger Hand zuverlässige Wege entwickelt, den europäischen Vorgaben gerecht zu werden. In Frankreich kann diesbezüglich sehr viel größere Zurückhaltung konstatiert werden. Der Vergleich verschiedener europäischer Rechtskulturen kann dem deutschen Juristen dazu dienen, für selbstverständlich gehaltene Prämissen zu hinterfragen und gegebenenfalls nochmals kritisch zu prüfen. Anstoß dazu will dieser Band geben

    Das Gebot richtlinienkonformer Auslegung kann in seiner Bedeutung kaum überschätzt werden. Durch dieses Gebot wird der nationale Rechtsanwender in vielen Fällen mit der Problematik konfrontiert, eine nationale Vorschrift in Hinblick auf gewisse Vorgaben des EuGH auszulegen. Während dieses Thema von Anfang an hitzig in der deutschen Methodenlehre diskutiert und berücksichtigt worden ist, haben insbesondere die Juristen im Vereinigten Königreich mit ruhiger Hand zuverlässige Wege entwickelt, den europäischen Vorgaben gerecht zu werden. In Frankreich kann diesbezüglich sehr viel größere Zurückhaltung konstatiert werden. Der Vergleich verschiedener europäischer Rechtskulturen kann dem deutschen Juristen dazu dienen, für selbstverständlich gehaltene Prämissen zu hinterfragen und gegebenenfalls nochmals kritisch zu prüfen. Anstoß dazu will dieser Band geben
