    Europäisches Verordnungsrecht kann oft nur unter Rückgriff auf nationale Vorschriften durchgeführt werden. In der Anwendung kommt es so zwangsläufig zu einer Verschränkung zwischen europäischer und nationaler Rechtsordnung. Bei Verordnungsnormen stellen sich aufgrund der direkten Anwendbarkeit grundlegend andere Probleme als beim europäischen Richtlinienrecht. Clara Schulze Velmede zeigt die unterschiedliche Problemlage in theoretischer wie in praktischer Hinsicht und untersucht, welche dogmatischen Regeln und rechtstheoretischen Annahmen diesem Ineinandergreifen der Rechtsordnungen zugrunde liegen. Das so entwickelte methodische Grundkonzept für die rechtsordnungsübergreifende Rechtsanwendung wird in einem praktischen Teil anhand ausgewählter Fallbeispiele aus der Datenschutz-Grundverordnung (DSGVO) überprüft, was auch genuin datenschutzrechtliche Erkenntnisse zutage fördert.europäischem Verordnungsrecht Kapitel 3. The implementation of EU law usually requires a recourse to the legal rules and concepts of national law. Since EU regulations are directly applicable, the national judge applying the law is confronted with thoroughly different problems than when applying purely national law based on European directives. These problems have long been neglected, both practically and theoretically. Following the analysis of these particular issues, the author develops a methodical approach to deal with the application of regulation law in a multi-layered legal system. This concept is then applied to selected GDPR example cases, which in addition gives new insights into current legal issues in data protection law

    What conditions drive or impede the transfer and reception of laws and how? In other words, what is the social explanation of legal transplantation; one of the most common forms of legal change? The answers to these questions are important not only for social and legal scholars, but also for designers of legal reforms. This book presents an interdisciplinary attempt to explain the legal transplantation process by identifying conditions that shaped transplantation of EU regulatory rules to Central Eastern Europe. Based on a critical review of literature, the author developed an analytical framework for describing the pattern of legal transplantation. The comparison of general approximation in Lithuania and Poland revealed the determining importance of institutional and ideational conditions, whereas structural and psychological conditions, differently from what is often claimed in the literature, appeared to be less important. Indeed, during the early period of integration, both countries opted for American legal transplants despite growing proximity with the EU. During pre-accession institutional and ideational conditions were responsible for delay in approximation in Lithuania and progress in Poland. Analysis of transplantation of EU competition policy and state aid control rules confirmed the importance of institutional and ideational conditions, although different from sets of conditions in general approximation process --Back cover

    Das Unionsrecht geht jeglichem nationalen Recht vor – diese Entscheidung fällte der EuGH bereits im Jahre 1964. Doch inwieweit entspricht dieser Grundsatz der verfassungsrechtlichen Realität in den Mitgliedstaaten? Alina Berger analysiert dies anhand der Rechtsprechung der Verfassungsgerichte in Deutschland, Frankreich und Spanien, wobei deren Haltung jeweils als integrationsfördernd oder integrationshemmend eingeordnet werden kann. Zu diesem Zweck stellt sie zunächst Bedeutung und Reichweite des Anwendungsvorrangs dar, bevor sie auf die Frage eingeht, inwieweit die Verfassungsgerichte den Anwendungsvorrang positiv gewährleisten und inwieweit sie ihn überhaupt verfassungsrechtlich gewährleisten können. Im abschließenden Rechtsprechungsvergleich arbeitet die Autorin bestehende Defizite heraus und demonstriert mögliche Lösungswege für die Effektivierung des Anwendungsvorrangs. European Union law takes precedence over national law regardless of its priority, and is something that the European Court of Justice decided back in 1964. But does this correspond to the constitutional reality of member states? Alina Berger analyses this by looking at German, French and Spanish rulings and taking into account whether the courts' attitudes support or obstruct integration. To this end, the author first of all determines the meaning and scope of European law primacy before addressing the question of how far the constitutional courts provide for it and how far they are constitutionally enabled (or hindered) to do so. Her concluding comparison identifies persisting deficiencies and possible solutions.

    What conditions drive or impede the transfer and reception of laws and how? In other words, what is the social explanation of legal transplantation; one of the most common forms of legal change? The answers to these questions are important not only for social and legal scholars, but also for designers of legal reforms. This book presents an interdisciplinary attempt to explain the legal transplantation process by identifying conditions that shaped transplantation of EU regulatory rules to Central Eastern Europe. Based on a critical review of literature, the author developed an analytical framework for describing the pattern of legal transplantation. The comparison of general approximation in Lithuania and Poland revealed the determining importance of institutional and ideational conditions, whereas structural and psychological conditions, differently from what is often claimed in the literature, appeared to be less important. Indeed, during the early period of integration, both countries opted for American legal transplants despite growing proximity with the EU. During pre-accession institutional and ideational conditions were responsible for delay in approximation in Lithuania and progress in Poland. Analysis of transplantation of EU competition policy and state aid control rules confirmed the importance of institutional and ideational conditions, although different from sets of conditions in general approximation process --Back cover
