    Ist eine schutzsuchende Person auch bzw. bereits dann »Flüchtling« nach Art. 1 A Nr. 2 und nach Art. 33 Abs. 1 Genfer Flüchtlingskonvention vor Abschiebung geschützt, wenn sie sich in ihrem Herkunftsland im privaten Bereich unbeeinträchtigt zu ihrer Religion bekennen könnte und nur verfolgt werden würde, wenn sie sich nach ihrer Rückkehr öffentlich zu ihrer Religion bekennen würde? -- Jonas Dörschner erläutert, wie das Bundesverfassungs- und Bundesverwaltungsgericht diese Frage bis zum Erlass der sog. Qualifikationsrichtlinie beantwortet haben, und untersucht, ob ihre Auslegung mit der Richtlinie vereinbar ist. Er gelangt dabei zu dem Ergebnis, dass die Auslegung der beiden Gerichte, der Flüchtlingsstatus sei in der genannten Situation noch nicht begründet, mit der Richtlinie vereinbar ist. Sein Ergebnis stellt er abschließend dem Urteil des EuGH vom 5. September 2012, C-71/11, C-99/11, gegenüber

    Ist eine schutzsuchende Person auch bzw. bereits dann »Flüchtling« nach Art. 1 A Nr. 2 und nach Art. 33 Abs. 1 Genfer Flüchtlingskonvention vor Abschiebung geschützt, wenn sie sich in ihrem Herkunftsland im privaten Bereich unbeeinträchtigt zu ihrer Religion bekennen könnte und nur verfolgt werden würde, wenn sie sich nach ihrer Rückkehr öffentlich zu ihrer Religion bekennen würde? -- Jonas Dörschner erläutert, wie das Bundesverfassungs- und Bundesverwaltungsgericht diese Frage bis zum Erlass der sog. Qualifikationsrichtlinie beantwortet haben, und untersucht, ob ihre Auslegung mit der Richtlinie vereinbar ist. Er gelangt dabei zu dem Ergebnis, dass die Auslegung der beiden Gerichte, der Flüchtlingsstatus sei in der genannten Situation noch nicht begründet, mit der Richtlinie vereinbar ist. Sein Ergebnis stellt er abschließend dem Urteil des EuGH vom 5. September 2012, C-71/11, C-99/11, gegenüber.
