    It is widely believed today that the free market is the best mechanism ever invented to efficiently allocate resources in society. Just as fundamental as faith in the free market is the belief that government has a legitimate and competent role in policing and the punishment arena. This curious incendiary combination of free market efficiency and the Big Brother state has become seemingly obvious, but it hinges on the illusion of a supposedly natural order in the economic realm. This work argues that our faith in "free markets" has severely distorted American politics and punishment practices. The author traces the birth of the idea of natural order to eighteenth century economic thought and reveals its gradual evolution through the Chicago School of economics and ultimately into today's myth of the free market. The modern category of "liberty" emerged in reaction to an earlier, integrated vision of punishment and public economy, known in the eighteenth century as "police." This development shaped the dominant belief today that competitive markets are inherently efficient and should be sharply demarcated from a government run penal sphere. ThIs modern vision rests on a simple but devastating illusion. Superimposing the political categories of "freedom" or "discipline" on forms of market organization has the unfortunate effect of obscuring rather than enlightening. It obscures by making both the free market and the prison system seem natural and necessary. In the process, it facilitated the birth of the penitentiary system in the nineteenth century and its ultimate culmination into mass incarceration today

    We estimate the causal effects of parental incarceration on children's short- and long-run out-comes using administrative data from Sweden. Our empirical strategy exploits exogenous varia-tion in parental incarceration from the random assignment of criminal defendants to judges with different incarceration tendencies. We find that the incarceration of a parent in childhood leads to a significant increase in teen crime and significant decreases in educational attainment and adult employment. The effects are concentrated among children from the most disadvantaged families, where criminal convictions increase by 10 percentage points, high school graduation decreases by 25 percentage points, and employment at age 25 decreases by 29 percentage points. In contrast, there are no detectable effects among children from more advantaged families. These results suggest that the incarceration of parents with young children may significantly increase the intergenerational persistence of poverty and criminal behavior, even in affluent countries with extensive social safety nets.

    Penology in the Jim Crow South centered on the chain gang. Gangs ostensibly served three purposes: their severity served as a deterrent; their putting convicts to work on roads and other public improvements reduced the taxpayers' costs of infrastructure; and their discriminatory implementation reinforced the social order defined by Jim Crow. Drawing on insights from the economics of crime literature, this paper analyzes whether chain gangs reduced road maintenance costs. Using a fixed-effects design, the analysis finds that the costs of using gangs in road maintenance were marginally lower on average than using wage labor. The results are consistent with county officials choosing between convict and free labor in manner consistent with minimizing taxpayers' costs

    Correctional facilities commonly lack climate control, producing a setting absent endogenous responses to hot weather like avoidance, adjustment, and mitigation. We study daily weather variation across the state of Mississippi, and show that high temperatures increase intense violence among the incarcerated. Days with unsafe heat index levels shift both the intensive and extensive margins of violence, raising daily violent interactions by 20%, and the probability of any violence by 18%. Our setting cleanly identifies the effect of heat on violence, and highlights previously unobserved social costs of current facility infrastructure. Rising global temperatures could substantially increase violence absent adjustment

    This paper studies the effect of a restorative justice intervention targeted at youth ages 13 to 17 facing felony charges of medium severity (e.g., burglary, assault). Eligible youths were randomly assigned to participate in the Make-it-Right (MIR) restorative justice program or to a control group in which they faced criminal prosecution. We estimate the effects of MIR on the likelihood that a youth will be rearrested in the four years following randomization. Assignment to MIR reduces the likelihood of a rearrest within six months by 19 percentage points, a 44 percent reduction relative to the control group. Moreover, the reduction in recidivism persists even four years after randomization. Thus, our estimates show that juvenile restorative justice conferencing can reduce recidivism among youth charged with relatively serious offenses and can be an effective alternative to traditional criminal justice practices
